Subject and Scope of Application

1. Subjects:

    All enterprises from all economic sectors that voluntarily register to take part in e-customs procedures are encouraged, but in the first stage they must satisfy the following conditions:

a) To have sound finance position: being certified by the domestic tax agency for good implementation of declaration and payment of taxes as prescribed; 

b) Not to violate the Customs Law more than 01 (one) time that is under authority of the Heads of the Customs Department of provinces, inter-provinces and centrally-run cities or of the Customs Departments at higher level within 01 (one) year up to the date of registration for e-customs procedures participation;

c) To achieve the import and export turnover and/or a number of customs declarations which are reached to the level provided by the General Director of General Department of Customs in accordance with each stage of e-customs procedure pilot  implementation;

d) To be ready for connection to the network of E-customs Sub-departments or to use services of customs procedure clearance agents for carrying  out e-customs procedures.

From now to December 31, 2005, the Heads of Customs Departments of Hai Phong and Ho Chi Minh City base on the actual situation to choose at least 50 enterprises to participate the e-customs procedures.

2. Scope of Application:

a) From now to December 31, 2005, e-customs procedures shall be only applied to imported and exported goods under a sale and purchase contract of enterprises that were registered to carry out e-customs procedures for their imported and exported goods in the E-customs Sub-departments under Customs Departments of Hai Phong and Ho Chi Minh City.

b) From January 1, 2006 onward, scope of application shall be extended to the other types of imported and exported goods and in Customs Departments of other provinces, inter-provinces and centrally-run cities in compliance with the orientation of pilot e-customs procedures deployment in the period of 2005-2006 in accordance with Decision No. 149/2005/QĐ-TTg dated June 20, 2005 of the Prime Minister.
