MOUNTAIN LODGE VACATION RENTAL AGREEMENT

I, {{REQ_NAME}} ("Guest"), as of {{CURRENT_LDATE}}, agree to rent from Ed and Ruth Marin (collectively, the "Owner") the premises located at 319 Glen Meadow Road, Swanton, Maryland 21561 for the period commencing on {{REQ_ARRIVE}} at 4:00 pm and ending on {{REQ_DEPART}} at 11:00 am.

AGREEMENT. The Owner and Guest agree as follows: Above Guest is an adult over the age of twenty-eight (28) and will be an occupant of the unit during the entire reserved period. Any other occupants will be family members, friends or responsible adults.

This Agreement shall be subject to the following terms and conditions:

2. Balance Due. For this rental period, Guest agrees to pay a total of $___________ immediately.

3. Cancellation of Reservation. If you cancel your reservation, we reserve the right to keep your payment, less the security deposit. If we are able to rebook the property for all or part of the rental period, we will refund your payment or a prorated share, as appropriate. No refunds will be made due to inclement weather or poor road conditions.

4. Security Deposit. Your security deposit is fully refundable within fourteen (14) days after termination of occupancy provided that real and personal property are in the same condition as when occupancy commenced and all terms of this agreement are met. Guest is liable for all replacements and repairs that are outside what is considered normal wear and tear.

5. Accomodations. The house you are renting is a 5 bedroom, 3.5 bath chalet on a one acre lot. There are 3 Queen size beds, 4 twin beds and 2 roll-away beds. The property has access to a private dock slip (slip 24) in the Glenfield Development. The house includes a hot tub, pool table, air hockey table, 8 TVs (one  big screen), DVD players, 4 gas fireplaces and a fully equipped kitchen. 6. What We Supply. The property is fully furnished and equipped with basic housekeeping items including pillows, blankets, coffeemaker, pots, pans, flatware and dishes. If you are interested in the provision of Linens, such as pillow cases, bed sheets, and bath and kitchen towels, they can be provided for an additional charge of $85.

7. What You Should Bring. 

 If you are staying more than 4 nights at our home, we will provide only a limited supply of toilet paper and paper towels to get you started on your first day of vacation. You should plan on making a trip to the grocery store to replenish these items as you need them. We should have available enough garbage bags and dish washing detergent for your use.  You will also need to bring linens such as pillow cases, bed sheets, bath and kitchen towels, unless you pay the additional fee for linens.  

If you are staying less than 5 nights at our home, we will provide paper towels, dish washing detergent and garbage bags and other dispensable items.  The preceding notwithstanding, we try to provide enough paper towels, garbage bags, dish washing detergent and toilet paper for rentals of four nights or less.  However, due to the unfortunate frequency of theft of these items, we can’t guarantee availability of these items.  If you need these items, we will reimburse you for the cost to replenish these items or call us and our manager will deliver any necessary items.  You will also need to bring linens such as pillow cases, bed sheets, bath and kitchen towels, unless you pay the additional fee for linens.  

8. No Rebates. Guest shall not be entitled to any compensation due to inoperative appliances. Owner will, however, upon being notified of any malfunction, make every effort to have any such appliances promptly repaired. TVs, VCRs, DVD players, grill, hot tub, fireplaces and other such amenities are not guaranteed. No refunds will be made if they are inoperable due to breakdown.  Owner reserves the right to enter the premises to make any necessary repairs.

9. Maximum Occupancy. I agree to have no more than twelve (12) people occupy the property.

10. Pets. Up to two well behaved dogs are allowed, but incur an additional charge of $50.00 per dog. You MUST clean up after your dog(s). That includes properly disposing of all waste material. If any waste material is found on the property, a portion of your security deposit may not be refunded.

11. Tenant Liability. Guest agrees to accept liability for any damages caused to the property (other than normal wear and tear), including, but not limited to, landscaping, misuse of appliances, and/or equipment furnished. If damages are in excess of the security deposit being held, Guest agrees to reimburse the Owner for costs incurred to repair/replace damaged items.

12. Eviction from Property. Guest and all other occupants will be required to vacate the premises and forfeit the rental fee and security deposit for any of the following:

· Occupancy exceeding the maximum capacity allowed (12).

· Smoking inside the residence.

· Causing damage to the premises rented or to any of the neighboring properties.

· Any other acts which interferes with neighbors' right to quiet enjoyment of their property.

13. Hold Harmless. The Owner does not assume any liability for loss, damage or injury to persons or their personal property. Neither do we accept liability for any inconvenience arising from any temporary defects or stoppage in supply of water, electricity or plumbing. Nor will the Owner accept liability for any loss or damage caused by weather conditions, natural disasters, acts of God, or other reasons beyond its control.

14. Additional Terms and Conditions. The undersigned, for himself/herself, his/her heirs, assignors, executors, and administrators, fully releases and discharges Owner from any and all claims, demands and causes of action by reason of any injury or whatever nature which has or have occurred, or may occur to the undersigned, or any of his /her guests as a result of, or in connection with the occupancy of the premises and agrees to hold Owner free and harmless of any claim or suit arising therefrom. In any action concerning the rights, duties or liabilities of the parties to this agreement, their principals, agents, successors or assignees the prevailing party shall be entitled to recover reasonable attorney fees and costs.

15. Deep Creek Lake. The waters of Deep Creek Lake and the Buffer Strip surrounding the lake are subject to regulations by the State of Maryland. Guest agrees to abide by all regulations established by the State of Maryland for the use of the waters of Deep Creek Lake and the Buffer Strip.

16. Miscellaneous Matters.

  • I agree to vacate said premises upon the termination of this agreement at the hour and date shown above. Before vacating, I will:
    • Collect all garbage and place in outside containers
    • Place all used dishes and kitchen items in the dishwasher and start a wash cycle
    • Remove all perishables and food items from the refrigerator
    • Turn off all lights and appliances
    • Close and lock the premises
  • I agree that if any of the terms of this rental agreement are not abided by, the owner may deduct the necessary costs from the security deposit.
  • When agreed to by Guest and accepted by owner, this shall constitute a legal rental agreement.
