Trading Hut Sub-Tenancy

THIS AGREEMENT is made the First Day of April One thousand nine hundred and ninety-two BETWEEN THE TRUSTEES OF THE DARTFORD ROAD ALLOTMENTS ASSOCIATION (hereinafter called "the Association") acting by RICHARD JOHN WILTSHIRE the Secretary for the time being of the Association of the one part and THE WEST DARTFORD ALLOTMENT AND GARDEN SOCIETY (hereinafter called "the Society") acting by DONALD L. LOOK the Hon. Secretary for the time being of the Society of the other part

WHEREBY IT IS AGREED as follows:

1.1 The Society hereby assumes all responsibility for the maintenance of the two trading huts and intervening compound (hereinafter called "the Trading Facilities") as defined by the lease under which the Association holds the Dartford Road Allotment Site (hereinafter called "the Site") and which are located near to the Devonshire Avenue entrance to the Site entirely at its own expense including the cost of any planning permissions and in accordance with the terms which are included in the lease under which the Association holds the Site

1.2 The Society will not act or permit its membership to act in any way that would contravene the terms of the lease under which the Association holds the Site

1.3 The Society will not act or permit its membership to act in any way which would impede the rights of the Association as defined by the terms of the lease under which the Association holds the Site or to hinder access to the Site

1.4 The Society will use the Trading Facilities solely for the purposes permitted by the lease under which the Association holds the Site

1.5 The Society will effect a suitable policy of insurance to cover the Trading Facilities and its activities on the Site and to the satisfaction of the Secretary for the time being of the Association which policy shall be of the standard defined by the lease under which the Association holds the Site

1.6 The Society will quietly vacate the Trading Facilities upon the legal termination of this Agreement without any claim whatsoever for compensation against the Association other than as provided for by law

 
2.1 The Association will not act or permit its membership to act in any way that would contravene the terms of this Agreement

2.2 The Association will permit the Society and its membership adequate access to the Trading Facilities from Devonshire Avenue as and when required

2.3 The Association will not attempt to levy any charge upon the Society in respect either of the Society's use of the Trading Facilities or of the Society's right of access except with the full and willing agreement in writing of the Hon. Secretary for the time being of the Society

2.4 The Association will provide to the Society a single copy of the relevant sections of the lease under which the Association holds the Site

 
3 This Agreement shall continue until determined in any of the following manner or events:

3.1 By the Association giving not less than three month's previous notice in writing to the Hon. Secretary for the time being of the Society in the event that the terms of this Agreement are contravened in any respect by the Society

3.2 By the Society giving not less than three month's previous notice in writing to the Secretary for the time being of the Association

3.3 By the determination of the lease under which the Association holds the Site
