Australia: Five men convicted of terrorist “conspiracy”

After spending nearly four years in “super-max” prison cells, five Sydney Islamic men were convicted last Friday on charges of “conspiring to commit acts in preparation for a terrorist act” and now face possible life imprisonment. They will go before a pre-sentence hearing in December.

[Scapegoats for the Coalition of the Killing's resource war's in the Middle East.]

The guilty verdicts in the New South Wales Supreme Court followed one of Australia’s lengthiest trials—nearly 12 months—and one of the longest recorded jury deliberations—23 days. That the jury took so much time suggests doubts and concerns among the 12 jurors. A defence lawyer, David Dalton SC, said there were “significant grounds” for appeal.

[Australia has changed the rules and standards of evidence for criminal trials in relation to scapegoats and patsies.]

Mass media outlets greeted the verdict with claims that the men had been “conspiring to plan a devastating terrorist attack in Sydney” (Daily Telegraph) and had been “part of Australia’s largest terrorist network” (Sydney Morning Herald).

[The mass corporate media are part of the Rothschild, Rockefeller and Bilderberg groups of zionist, neo-cons who at this time are trying to implement a 'one world government' and a NEW World Order, spell it backwoods, OWN.]

In reality, the five were arrested, charged and convicted without any evidence of a specific terrorist plot. Federal crown prosecutor Richard Maidment SC emphasised in his closing address to the jury that no such evidence was required to convict.

Together with last year’s seven-month trial in Melbourne of 12 men that ended with an array of convictions, and some acquittals (see “
Contradictory verdicts in Australia’s largest terrorism trial”), the prosecution arose from the former Howard government’s November 2005 declaration of an “imminent” terrorist threat.

Most of the men placed on trial in Melbourne and Sydney were arrested in the country’s largest ever house raids, involving more than 600 state and federal police and intelligence officers. Code-named “Operation Pendennis”, the arrests came
just four days after Howard, supported by the Labor Party and the Greens, used a supposed terrorist emergency to recall the Senate to rubberstamp the first instalment of far-reaching extensions to anti-terrorism laws introduced since 2002.

[The house raids are 'fishing expeditions of suburbs'. Their objective is to find as much common handyman hardware, common internet and reading material, or anything that they can use as a conspiracy theory against a person. And to claim that material was going to be used for terrorist activity. But if police raid a whole suburb without probable cause then no doubt they could easily find such material. They don't need 'probable cause'. In other words they don't need to state what it is they're looking for prior the raid? Nor why they are raiding etc...]

A crucial amendment substituted the words “a terrorist act” for “the terrorist act” in all the federal legislation. The change permitted people to be arrested and jailed, potentially for life, without the prosecution having to produce evidence that an actual terrorist act was being prepared, let alone carried out.

[To convict innocent people for thought crime due to police provocations.]

Within weeks of the spectacular arrests, the controversial anti-terror bills were passed in their entirety, imposing two new forms of detention without chargepreventative detention and control orders (a form of house arrest). They also outlawed “advocacy” of terrorism, and expanded sedition to include voicing support for groups resisting Australian military interventions, such as those in Iraq, Afghanistan, East Timor and Solomon Islands.

Backed by the Labor opposition, the Howard government utilised the “emergency” to try to overcome mounting public scepticism in the “war on terror” and growing opposition to the interventions in Afghanistan and Iraq. It was also used to justify the introduction of police-state powers that could be employed to deal with political dissent and social unrest.

For all the claims of an “imminent” threat, the arrested men had been under intense electronic and physical surveillance by the police and the Australian Security Intelligence Organisation (ASIO) for at least 16 months, and in some cases since 2000. Their phones were tapped, houses bugged and movements tailed. The Australian Federal Police intercepted 97,480 calls, recorded 16,400 hours of listening material and intercepted more than 26 gigabytes of Internet traffic—
all without any evidence of a concrete terrorist plot.

The arrests were accompanied by sensational media claims of plans to blow up strategic sites and kill thousands of people. In Melbourne, the target was claimed to be an Australian Rules Football grand final. That allegation was discredited and abandoned during last year’s trial. In Sydney, police fed the media with accusations of plans to attack the Harbour Bridge, the Opera House and the Lucas Heights nuclear reactor. These claims were dropped even before the Sydney trial commenced last November.

[Because the claims were just plain rubbish and propaganda.]

The Sydney jury heard from 300 witnesses, examined 3,000 exhibits, watched 30 days of surveillance tapes and listened to 18 hours of phone intercepts. But, there was still no evidence of an actual target or plan. Instead, prosecutor Maidment told the jury: “This was a case that relied on circumstantial evidence, creating a picture in the nature of a mosaic or a large jigsaw puzzle.”

[Cost of trial and police/ASIO operation 9 Million

The men were all provided with legal assistance (a barrister, junior and instructing solicitor each) throughout the trial through Legal Aid. It has been estimated the the combined cost of the case - for the defence and the prosecution by the crown - is about $9 million! And you can also bet that Legal Aid won't appeal?]

The crown prosecutor continued: “The crown does not suggest that the evidence reveals that they had reached any firm conclusion as to what precise action was to be carried out.” The jury only needed to be satisfied that there was an “understanding” to commit a terrorist act. “You do not even need to have spoken it. An agreement, in this context, can be reached by an understanding,” Maidment said.

[The operation by ASIO, (an Australian terrorist organisation) and the Australian federal police cost about $37.2 million! That is the price of fear-mongering propaganda and for providing draconian laws, and not including the cost of keeping innocent people in jail. Keeping our nation from the real truth about the Coalition of the Killings illegal and degrading war crimes against humanity, including occupation's and genocide - and that is wrong and very costly.

A key part of the “mosaic” was that the group was motivated by “a perception that the participation of Australia in the conflict in Iraq and Afghanistan ... were acts of aggression against the wider Muslim community”. By this test, any opponents of the US-led wars in the Central Asian region could be accused of being prepared to support terrorist-related activity.

Maidment further insisted that the group’s mindset was exemplified by the reactions of two of the men when arrested. The jury heard that one shouted: “Sharia law is going to prevail throughout this land. It is going to be ruled by it.” Another told police: “May Allah curse you, your children and your wives.”

[Cursing ASIO, police and authorities for their wrongdoing, framing, setting them up and using them as scapegoats for their illegal and degrading resource war's in the Middle East and the occupation and genocide of Afghanistan and Iraq.]

The prosecutor said: “Those kind of sentiments ... betray a state of mind that is consistent with people who are prepared to do just what the crown has alleged; namely, to engage in preparation for the commission of terrorist acts involving the discharge of weapons or the use of weapons or the use of firearms or the use of the detonation of explosive devices, thus, threatening, property, lives and injury.”

[Just plain rubbish and propaganda. No action was taken against the war criminal Australian government for committing war crimes against humanity.]

According to this logic, any religious fundamentalist, or for that matter, anyone opposed to the current legal order, could be declared guilty of a potentially heinous conspiracy.

Once the verdicts were announced, new contradictions emerged. The jury was not told that before the trial commenced, four alleged co-conspirators had pleaded guilty to lesser charges of committing acts in preparation for a terrorist act, or possessing items connected with the preparation of a terrorist act.

Two of the men had already been released on parole. With time served since his arrest in November 2005, one was freed in May after three years and six months in jail. The other was released last week after three years and 11 months in custody. With a history of psychiatric illness and drug abuse, he had been deemed mentally unfit to plead and his sentence was discounted due to his mental ill-health.

The third “co-conspirator” is serving a minimum term of 10 and a half years, while the name of the fourth, who has been jailed for a minimum of 14 years, remains the subject of a court suppression order.

[Co-conspirator = police informant.]

These plea bargains raise many questions, not least whether deals were struck for any of the four to provide evidence against the others. The four did not testify and police told journalists that none provided information. However, some may have received lesser sentences for assisting the police in ways that deliberately did not expose them to defence cross-examination at the trial.

During the Melbourne trial, the prosecution (also led by Maidment) was forced to abandon its reliance on star witness, Izzydeen Atik, a former member of the group who received a reduced sentence for turning police witness and testifying that the plot involved attacking the football grand final. Defence lawyers cross-examined Atik, exposing a long record of fraud, forcing the judge to warn jurors not to rely on his evidence because he was a conman, liar and social security fraudster.

The Melbourne trial also highlighted the role of police provocateurs in entrapping disaffected, and sometimes mentally unstable, individuals. An undercover infiltrator offered the alleged ringleader, Muslim cleric Abdul Nacer Benbrika, cheap ammonium nitrate and, while being secretly filmed by police, took Benbrika to a remote hilltop to show him how to detonate the explosive. Were similar acts of provocation and entrapment involved in Sydney?

Many other unanswered questions remain about the Sydney trial. Before it began, there were 110 days of pre-trial arguments, during which the presiding judge, Justice Anthony Whealy, delivered 65 judgments. All but two of the judgments were suppressed. Whealy wrote a total of 100 non-publication and suppression orders.

From what has been reported publicly, the prosecution case was based substantially on covertly recorded conversations between some of the men about wanting to do “something big” to stop Australia’s involvement in the US-led wars.
In various instances, these statements were apparently made defiantly after the men became aware that their conversations were being bugged. Again, however, there was no evidence, apart from purchases of ammunition and chemicals, that the men seriously intended to do anything.
[Police provocateurs in entrapping disaffected, and sometimes mentally unstable, individuals. I.E. Would you like to buy some of this.....?]

The much-publicised trials in Melbourne and Sydney were conducted under the Rudd Labor government. While Labor has dropped the discredited term “war on terrorism”, its modus operandi is no different from Howard’s.
[The Coalition of the Killing's resource war's in the Middle East.]

In August this year, in the second largest police-intelligence, [? police are not intelligent], raids ever conducted in Australia, around 400 officers searched 19 homes around Melbourne at dawn, arresting four Lebanese- and Somali-Australians over alleged plans to attack a Sydney army base. (See: “
Australian police carry out sweeping new ‘anti-terror’ raids”).
[Again a police and authorities 'fishing expedition' without probable cause rules, I.E. stating what they're supposedly looking for and exactly where etc...So they can then find something and make claims based only on what they found on the day and not anything outlined or specific.]

Just a week later, the government unveiled measures to further boost the anti-terrorism laws, [scapegoat and patsy laws], including expanding the definition of terrorism to cover psychological harm, rather than physical harm, and creating new offences such as terrorist hoaxes, threats and “inciting violence”. Other changes would permit “emergency” police searches of homes without warrants, make it even harder to get bail and streamline secrecy measures for semi-public trials. (See: “
Australia: Rudd government toughens anti-terror laws”).

If a terrorist attack were to occur in Australia, political responsibility would lie directly with the Howard and Rudd governments. Just as Howard joined the Bush administration’s criminal invasions of Afghanistan and Iraq, Rudd is following Obama in escalating the onslaught in Afghanistan and now neighbouring Pakistan. And, like his predecessor, Rudd is exploiting the fertile recruiting ground for Islamic fundamentalism created by these policies to bring forward laws that tear up basic legal and democratic rights.
[Everyone in Australia today should be very concerned as the government has changed criminal rules and standards of evidence. For all those rednecks out there attacking muslims because you've been programed by the likes of  the Globalists, Murdoch's, Zionist and mass media, fear-mongering propaganda, then soon YOUR RIGHTS WILL BE TAKEN AWAY FROM YOU JUST LIKE THE MUSLIMS. IMAGINE GETTING LIFE BECAUSE THE GOVERNMENT SAYS SO! THAT'S NOT JUSTICE! All these matters should be appealed to the High Court and all draconian laws repealed, forthwith. Otherwise Big Brother Wins and You die. Mark My Words.]

Another major terrorist trial begins in Australia

[11 November 2008]

Govt, police 'let off the hook' Haneef inquiry

Australia holds grudges against the Howard Government and corrupt police and officials. Doctor Mohamed Haneef says he will seek compensation for false imprisonment, [assault] and defamation after he was arrested on [scapegoat-propaganda] charges.
An [alleged] independent inquiry by retired NSW judge John Clarke QC has found no evidence to link Dr Haneef to the [alleged] attempted terrorist attacks in London and Glasgow which led to his arrest in July 2007.

Dr Haneef says he is satisfied by the Clarke report's findings.

"This report will go some way to restoring the reputation of me and my family," he said.

In his report, Justice Clarke said he was "mystified" by former immigration minister Kevin Andrews' decision to cancel the Indian-born doctor's visa after he was granted bail. The case against Dr Haneef later collapsed and the charges were dropped.

The inquiry found that Mr Andrews did not reflect deeply enough on his department's advice, but his decision was not politically motivated and he did not act improperly.

[Why didn't Andrews act improperly by going about denying his own departments advice? Therefore, self-explanatory that his decision was politically motivated, more likely than not, for his then boss John Howard and therefore he did act improperly. So the general public ought not be satisfied as they are told more lies and white washed about an ex-minister and totally corrupt Howard government propaganda.]

Justice Clarke also called for an independent reviewer to be appointed to oversee Australia's anti-terrorism laws, and for changes to the way the Australian Federal Police (AFP) and Immigration Department operate.

The report found that the Australian Federal Police commander who led the investigation, Ramzi Jabbour, had "lost objectivity" and the senior prosecutor, Clive Porritt, gave advice that was "obviously wrong and should never have been given".

The AFP refused to say whether Commander Jabbour still worked for the force. The Commonwealth Director of Public Prosecutions would not say whether Mr Porritt was still working, though he was effectively demoted last year.

The report also includes damaging insights into the handling of the case by two senior Howard government cabinet members, Kevin Andrews and Philip Ruddock.

The report says Mr Ruddock, the then attorney-general, failed to question the fundamental differences between the AFP's and ASIO's assessments of Dr Haneef, even though he had responsibility for both agencies - a shortcoming that "might be viewed as troubling". And it concludes the effort to oversee the affair by the Prime Minister's Department was "affected by misconceptions and miscommunication".

Dr Haneef says he does not hold resentment towards any particular person or government agency.

"I mean, whatever any wrong that has been done, definitely the Government should take a proactive role and should address them," he said.

The Federal Government says it will implement all 10 recommendations from the judicial review.

But Treasurer Wayne Swan says the Government will need time to consider the issue of compensation for Dr Haneef.

"It's too early to judge all of those matters," he said.

"The Clarke report is out there for people to comment on and make judgements about, but it's too early to be talking compensation."

Poor treatment

Dr Haneef's lawyer, Peter Russo, says the Clarke report should remove any doubt that his client was poorly treated by authorities.

"How the Australian public perceive all of this is difficult to say, but I hope that the doubters out there now know that Mohamed had done nothing wrong," he said.

The Clarke report found there was poor co-ordination between intelligence and police agencies, but Attorney-General Robert McClelland says none of the agency heads will be asked to step down.

"We don't adopt the view of life that you execute one to educate a thousand," he said.

[This was more than poor co-ordination - this was fabricated propaganda using scapegoats and supposed witches, to continue to bolster support and quell dissent in the illegal and degrading resource wars in the Middle East.

This was a corrupt government and its police agency creating their own crimes and fear-mongering based on nothing accept John Howard’s agenda. Heads should roll and one of those heads has to be Mick 'Guilty' for covering up pre-meditated state-terror and over a number of years during the John Howard corrupt government.

ASIO and the Federal Police blatantly lied to the Australian people and worse still will do it again if nothing is done about it. Why don't we adopt a view that there are bad apples who are all too willing to do a dirty governments bidding?]

Meanwhile, Queensland Health Minister Stephen Robertson says Dr Haneef would be welcome to work in the state again.

"Dr Haneef's qualifications were appropriate to his position at the Gold Coast Hospital," he said.

"If he sought to return to Queensland, there, in our view, is no barrier to him resuming his career in Queensland should he wish to apply for a position with Queensland Health."

Professor George Williams from the University of New South Wales says the report should have urged the Government to completely scrap provisions allow continuing detention.

"Instead of recommending that that be changed, that the law not actually have an unlimited period of detention, it simply says that that should be reviewed, thereby leaving it up to the Government to make its own decision and not presenting the Government with a clear mandate for change," he said.

"It needed to go further in recommending changes to the law. It needed also to deal in a better way with some of the problems in the decision to cancel Dr Haneef's visa."

The Greens says the Government has failed to hold police and intelligence agencies to account for their mishandling of the case.

Greens Senator Scott Ludlum has [said] no-one is taking responsibility for errors.

"I think it's absolutely extraordinary, given the scale of the successive bungles that were made, some obviously politically motivated and some perhaps not, I think it's really extraordinary that no-one, that at the end of the day, the buck seems to stop with no-one," he said.

The Greens say the Federal Government is risking another bungled investigation like the Haneef case unless counter-terrorism laws are overhauled immediately.

Senator Ludlum says it's extremely likely the same thing wil happen again unless changes are made.

"In Australia under Prime Minister John Howard, we passed some of the most aggresive and draconian terror laws in the world," he said.

"It's really no surprise that what happened to Dr Haneef was able to occur. And as long as all those laws are still on the books there's nothing to stop the same happening again to anybody."

Mr McClelland said the arrest and detention of Dr Haneef for longer than allowed was "totally unacceptable" and followed failings that included "errors of judgment … inadequate procedures … inadequate testing and contesting of competing advice … lack of attention identifying the role of different agencies … and lack of appropriate training and direction from the leadership of several agencies".

Quote: Any corrupt head of state, like ex-Prime Minister and War Criminal John Howard. Or Minister of any government of the crown like ex-Attorney General Philip Ruddock and ex-Immigration minister Kevin Andrews. Or Police force heads of ASIO or the AFP, officer's that bent the law for any other head of state, like the fall guy for Mick Guilty, Commander Ramzi Jabbour and fall guy for the Howard government, DPP prosecutor Clive Porritt - like corrupt war criminal John Howard - should be identified as a traitor to the Australian people and tried for their crimes.

These are all people who could have potentially covered-up, or made up tall stories and some will say did cover up for the Howard government's complicity in state terror.

The real reason for hundreds of other deaths. Deaths identified as from other causes that were (not valid reasons given because of discrepancies in the evidence that suggests other reasons about why they died) like those deaths in the Bali Bombings and the Sieve X.

So when these ministers and police are identified as having lied to the Australian people or acted improperly then they should be held to account for it and not just brushed aside like nothing happened.

How many more lies did ex-ministers and police tell the Australian people about the alleged war on terror? (war on resources in the Middle East). How many innocent people, scapegoats and witches are locked up for it now? How many more will be locked up for it later? All the Australian people want is the truth, Now!

Terror trial: criminalising speech
This self-serving drive results in injustices against the individuals targeted, but it also endangers freedoms for all of us. So far the Muslim community has been targeted but this could spread to include activist groups in the future if people are unwilling to defend their civil liberties.

State provocations, security and Socialist Alternative The failure of the protest organisation Socialist Alternative (SA) to issue any serious response to revelations that a police agent provocateur spent a considerable period of time working within their ranks provides a revealing insight into the class character of the organisation and the opportunist nature of its politics.

Police provocateur infiltrates political and protest groups
In a series of articles published last month, Melbourne's Age newspaper revealed that a covert police agent recently infiltrated several left-wing political and activist groups, including Socialist Alternative, Stop the War Coalition, Unity for Peace, and Animal Liberation Victoria. Beginning in 2006, the agent provocateur was involved in anti-Iraq war demonstrations—including last year's Asia-Pacific Economic Cooperation (APEC) protests in Sydney—animal liberation actions, and participated in planning meetings for a protest to be held against a weapons fair in South Australia.

Use of police infiltrators raises fresh questions about “terrorist” raids in Australia According to the report, which has been confirmed by lawyers, the infiltrator acted as a provocateur to incite and entrap the alleged leader of the group, Islamic cleric Nacer Benbrika. There is a good faith exception which seems to me to be a reversal of proof. In other words, the practical effect of the new legislation is that a person accused of doing any of the things in the new Criminal Code [?] bears the onus of showing he or she did not act with a seditious intent. This is repugnant to the notions of fair process. [Repugnant knowing that it was presented by war criminal John Howard as well.]

CANBERRA: And welcome to Canberra on the first Tuesday in November for the race that doesn't stop the nation. The Anti-Terrorism Cup. The final horses are being brought into the barriers, and we are almost ready for the start. "Cross the Floor" from the Joyce stables is looking very frisky. English horse "Shoot to Kill" is playing up, with jockey T Blair struggling to keep his mare under control. Blair has had a lot of trouble in foreign races lately, with "Dossier" causing massive problems in the Middle East two years ago. She is now in, and ready to go.

Constitution: Defending Against State Terror and Despots
Australia has no major laws that are not derivatives of English Law and all of our major laws rely on British court precedents for interpretation and implementation. These laws and our Constitutional Monarchy system create a situation where, even if Howard and all State Premiers vote unanimously on the Anti-Terrorist laws, and every ALP/Dem/Lib/Nat/Green party hack also votes unanimously on their laws, and even if such laws are given Royal Assent, those laws are still void.

Preventive Detention: A Shield or A Sword?
There is a consensus among educated Australians that Preventive Detention is inimical to the democratic evolution of our country. Many are those who argue that given the standards of our time preventive detention is an unnecessary evil.

Cracks in terror solidarity
In remarks that are at odds with the Premier, Morris Iemma's determined support for the legislation, Mr Debus said yesterday: "I think I share the concern about the legislation with plenty of other people. I don't query that we need to have very tough responses to the threat of terrorism [actually though, the community do query it because the actual threat of terrorism is coming from the Government] and I don't query that the premiers have signed off on a framework last month.

ASIO laws: Don't be silenced
The secrecy surrounding the proposed national anti-``terror'' legislation stands in stark contrast to previous ASIO and "anti-terror'' laws that have been subject to scrutiny by parliamentary committees and public hearings.

Despoja: Stanhope hero of the hour
Natasha Stott Despoja has described Mr Stanhope as the "hero of the hour". Senator Despoja says there is meant to be a vote on the draft legislation in the week beginning November 7.

Stanhope stands his ground
Stanhope: It is bizarre to think legislation of this significance can be rushed into Parliament without consulting a single Australian.

Australia: Draconian laws draw rights watchdog's ire
Human Rights Watch has condemned Australia's proposed anti-terrorism laws as a "shocking departure" from its historical championing of the rights of the individual.

Australia: Rattling the cage
Recently, the federal government announced a controversial new 'counter-terrorism' package. Civil libertarians were quick to raise the spectre of a police state . Yet Muslim groups argued that the new security regime is already having an impact on the democratic freedoms and everyday safety of their communities.

Anti-terrorism laws put rights at risk: Fraser
Former prime minister Malcolm Fraser says Australians could be treated unfairly under the Government's anti-terrorism [draconian] laws unless a human rights act is introduced.

They know where you live
Twenty-four hours after the country's leaders agreed to draconian counter-terrorism laws this week, the Attorney-General, Philip Ruddock, was playing down media claims that ASIO believed there were 800 would-be suicide bombers living in Australia.

When Terrorism Outlaws Democracy
On September 27, 2005, Australian democracy surrendered to terrorism. On that day, a coalition of willing federal and state leaders agreed to anti-terrorism legislation that will enable police persecution of the Muslim community and threaten dissidents with imprisonment. In a country without a Bill of Rights, the prospect of more draconian Terror Laws delivers ultimate control through fear. Australia, with its history of penal colonies, racism and detention centers, is now set to become a police state.

Mein Kampf by John Howard
Months before Bali Au warships were seen invading Iraqi territorial waters in deliberate provocations under American protection. It was obvious that Howard had decided before Bali to join in an illegal and aggressive invasion of Iraq and in fact , when that happened, it was led by Au stormtroopers BEFORE the ultimatum given Baghdad had even run out!

Australia, USA, Iraq: Scott Parkin
The rapid and widespread response to the detention of US peace and global justice activist, Scott Parkin, has been heartening and effective on many levels. Actions have taken place in Melbourne, Sydney, Brisbane, Cairns and outside several Australian Consulates in the United States.

In anticipation of the special Council of Australian Governments (COAG) meeting on counter-terrorism [scapegoats for resource wars in the Middle East.] to be held on 27 September, I announce a number of proposals to further strengthen Australia's counter-terrorism laws [make arrangements for the government and its agents to lock up anyone they want to in prison for any alleged reason whatsoever.] These proposals are designed to enable us to better deter, prevent, detect and prosecute acts of terrorism.

Government warned Terror Laws "inherently dangerous, draconian and open to misuse" John North, Law Council of Australia: "In times of fear, it is easy for governments to impose ever (more) draconian laws."

The Terrorism of ASIO Laws
Wanda Fish asks Australian Senators to reject Howard's proposal to strengthen laws that already erode our basic legal rights. This legislation has the potential to turn ASIO agents into terrorists who can kidnap and detain innocent Australians simply because they "might know something".

Threat of terrorism overblown, says Kirby
The High Court judge Michael Kirby has urged Australia's security chiefs and judges not to exaggerate the risk of terrorism, saying that more people die of AIDS every day than were killed in the World Trade Centre in the September 11 [US false flag] attacks.

PM, Carr attacked as judge pulls plug
In November 2002, as chairman of the International Commission of Jurists, he told a Senate inquiry "it is patently clear" that proposed anti-terrorism legislation "is aimed at Muslims". His submission said the new laws would be "subverting [liberty] more effectively than terrorism could ever do".

Australia: Innocent man granted bail
Innocent man Izhar Ul Haque was granted bail today by the NSW Supreme Court. Justice Peter Hidden granted the 21-year-old Sydney medical student $200,000 bail.

Young men terrorised, tortured, and threatened with charges for no crime by Australia mate the lucky country. Lucky if you're not used for Howard's FEDERAL ELECTION and George Dubya's WAR ON LIBERTY! Who shot liberty? IGNORANCE!

Ul-Haque 'the man who wants to become a doctor'
The taskforce is investigating French man Willie Brigitte, who was tipped back home for a visa breach. Allegedly the Un-Australian Newspaper claimed he also attended training camps before his six-month stay in Sydney. Police have not alleged Mr Ul-Haque knew Brigitte. The Un-Australian just mentioned it because they are 'you guessed it' up John Howard's butt and they like the USA want 'you guessed it' our Federal Government. Well Yankee go home!

Izhar is one of the new victims of Australia's draconian civil liberties deprivation laws. He has been accused of visiting a group that was not proscribed until ten months after Izhar's alleged visit.

Howard gov't and media talks up terror
First it was the Lucas Height nuclear reactor Willie Brigitte was alleged to have been planing to blow up. ASIO alleged to have found some type of map as evidence late last year.

Big Bang Theory, ASIO
The most significant threat to Australia is Prime Minister John Howard. Howard has lied to the Australian people constantly. 2nd Renaissance -10 The War on Witches [150]
In 1484, Pope Innocent VIII issued a Papal Bull that became the rationale for establishing the Inquisition in Germany. The following excerpt from the Bull sets out the official view of the danger of witches to the community. The Bull and this this passage provided the sole excuse for the torture and cruel executions that were, ultimately, to be the fate of up to fifty percent of the population of some villages.

As we go to press (December 2002), both the Federal parliament and the NSW parliament are debating legislation that would give police and ASIO agents greater powers of search, interrogation and detention, and significantly erode the fundamental rights of citizens. In both cases, of course, the alleged purpose of the bills is to combat terrorism.

Special powers? Or political grandstanding?
In NSW, great slews of legislation over the past year have increased powers for everything from police to sniffer pups and train guards and vastly reduced the rights of individuals to engage in civil disobedience, freedom of expression and communication with each other.

Give peace a chance
Dowd has condemned the State and Federal Governments' anti-terrorism measures, claiming they erode rights and give encouragement to oppressive regimes.

The NSW Government is to introduce increased police powers bill. Legislation giving New South Wales police special powers to deal with an emergency terrorist situation [emergency scapegoat situation] will be introduced into the New South Wales Parliament today.

"It would start if candidates had a CV of real jobs, such as medicine (Senator Brown), or even zoo keeping (NSW Upper House Green Lee Rhiannon ). Which leaves the type of candidate summed up by Kerry Nettle, who was elected a NSW senator at the poll a year ago.

NSW Prisoners' linked to Osama Bin Laden: Ten News

NSW prisoners held in a "box within a box" with "no fresh air or sunlight" at the countries terrorist jail (HRMU) or High Risk Management Unit at Goulburn Correctional Centre, (a super-max prison in NSW), are said to have followed Osama Bin Laden from their isolated cells.

Sources say Bin Laden issued a fatwa on an Islamic website directed at Premier Bob Carr, Justice Minister John Hatzistergos, the Un-Australian Newspaper and "seriously" Channel Ten  television. Allegedly Osama Bin Laden issued a "Fatwa" that was posted on an Islamic Website this morning. Osama Bin Laden's demands included visiting NSW prisoners' at the HRMU for Xmas!
After a broadcast yesterday by Ten's Eyewitness News suggesting that " The prisoners were now devout Moslems who followed Osama Bin Laden".
Osama was overjoyed and could not believe that he has followers from Australia who look up to him from their hole in the ground and pray for mercy to have some form of constructive lifestyle. Some like Faheem Khalid Lodhi, and Zeky Mallah, who have not committed any crime and who have not been found guilty of committing any crime, yet remand, or a remand prison, is simply out of the question for these alleged terrorists. [? Scapegoats for the Coalition of the Killing's resource war's in the Middle East.]

Other prisoners even though they have been accused of internal disciplinary charges "not proven" because there is no charter for evidence to be relied upon to secure the allegations, by any " visiting justice or magistrate", are stuck in a tomb without any constructive lifestyle for 23 hours a day and have been treated like terrorist by the Justice Minister because, this language suits the neo-cons conspiracy theory.

This means because the "terrorist",
[scapegoats], being the most unpopular prisoners can be given "no support "in relation to the truth being told. Have no programs or any type of constructive lifestyle, no communication or dialogue. The Department of Corrective Services only have to warehouse them for lest cost and can use these people as propaganda to suit their rhetoric in the politics of fear for the HoWARd government.

However sources say Bin Laden is coming to their rescue! Allegedly Bin Laden posted on an Islamic website this morning a fatwa.

"Fatwa, fatwa, fatwa to, Premier Bob Carr, Justice Minister John Hatzistergos, the Un-Australian Newspaper and 'seriously' channel Ten", the statement said,

"And to all those infidels in Parliament house Macquarie Street Sydney, and Parliament House Canberra for their lies and propaganda".

So these sinister prisoner/terrorist/
scapegoats, locked up in chains could be up to something? For instance they might incite other terrorists,[scapegoats], to blow up the Long Bay twin towers?

But the truth is for a long time now suspected terrorists,
[scapegoats], and unpopular people are all treated more harshly in the NSW High Risk Management Super-max prison for terrorists, [scapegoats], mass murderers, child killers, pack rapists and unpopular people, ever since the HRMU was opened.

But now a few more keywords have been added to the "security classification" like AA will sit atop the existing classification system, which runs A1, A2, E1, B, E2, C1, C2, C3, with A levels representing maximum security, B medium, C minimum, and the E levels added for prisoners with escape histories.

"AA" = "terrorist" = "label" = "demon" = "no constructive lifestyle or programs for prisoners" and no responsibility for the Department to rehabilitate offenders while they're in jail.

Hatzistergos will introduce this classification to other state jails. That means overcrowded jails warehousing prisoners instead of rehabilitating prisoners will become the norm.
In short "no care taken and no responsibility taken by the government who is supposed to be rehabilitating prisoners". Prisoners claimed to be a terrorist or and alleged terrorist or a suspected terrorist, [scapegoats for the Coalition of the Killing's resource war's in the Middle East], with, [alleged], links, links and more links to an alleged terrorist, [scapegoat], can be warehoused.

Then they can become the most unpopular person by being suspected of "terror". So instead of actually being a "mass murderer, child killer or pack rapist" they can be all those monsters bundled into one, just because they're suspected of being a terrorist,
[framed and profiled by the authorities by using draconian laws], without even committing a crime. Make sense? Makes sense to me and that also does away with the, [usual criminal court rules of evidence, beyond a reasonable doubt and the rest], cutting the cost of "annihilating your opponents" in the politics of fear mongering for warmongers like, [war criminal], Prime Minister John Howard, [and ensuring a guilty verdict, to do nothing at no place at no time, alleged thought crimes.]

The "A1" rating now reserved for those prisoners considered,
[by war criminals], the greatest threat to community safety is to be topped by an "AA" classification imposed solely on inmates, [prisoners], with terrorist,[scapegoat], links? Terrorist links, links, links and terrorist cells, cells, cells. And they can bet it'll be all because "sources say," say, say and keep on saying it was them.

Any prisoner graded AA would be subject to even tighter security than the 113 "special high risk" inmates,
[prisoners], classified A1?

Perhaps now prisoners will get tortured with bags over their heads and have their cloths removed? What about electric shock treatment? That will get them talking? And if that doesn't work why not use "disco sleep depravation" that is "just in case they decide to hold out on us form their box within a box with no fresh air or sunlight"?

The NSW Minister for Justice, John Hatzistergos, said prisoners who posed a special risk to national security and the good order and security of the state's prisons would be classified AA "terrorist inmates".

That could be anyone of you, smiling faces out there in the community, but you won't be smiling for long after you're "chilled out at the Harm-U, all because you're suspected". As such, you would be housed only in the highest security facilities, would not have contact visits unless it was "deemed safe", and all mail not to or from a "defined exempt body" would be screened.

But this has been the case at the HRMU since its conception. All prisoner mail is interfered with and withheld,
we have proof. All prisoners housed there are denied visits, we have proof. Even mail from exempt bodies has been grossly examined by the Corrective Services, we have proof and support groups like Justice Action's mail has been blanket banned what about that!

AA inmates,
[prisoner/scapegoats], would have no recourse to the "official visitor" provisions available to other NSW prisoners and instead could take complaints to the Ombudsman?

The Ombudsman who incidentally has no power of veto over the Corrective Services Commissioners discretionary powers for the "Good Order and Security of the prison".

The Commissioner needs to show no proof regardless of the guilt or innocence of any prisoner whether they should be isolated for an alleged crime or for how long they should remain in isolation. All prisoners housed at the super-max prison have no recourse whatsoever!

The cabinet committee on counter-terrorism,
[fear mongering propaganda authorities], had approved the Crimes (Administration of Sentences) Amendment (Category AA Inmates) Regulation 2004 bill, which would be introduced to Parliament. [?]

But one of their reasons for doing this is because the Justice Minister and Cabinet now want to isolate and mistreat the states prisoners and make their current treatment legitimate as if they have done no wrong to date.

There is no visiting justice going into the prison and the Commissioner of Corrective Services has discretionary powers, which, the Ombudsman cannot veto. No proof about the reason why a prisoner should remain "isolated indefinitely" can be called for by the Ombudsman even though the Geneva Convention maintains isolation should be no longer than 32 hours and the fact that these prisoners are not at war with Australia?

As well as the AA level for male inmates,
[prisoners], a new Category 5 would be introduced for female prisoners, [scapegoats], whose highest security classification has been Category 4.

"We must prepare for the future and the contingency of holding convicted terrorists in our prisons," Mr Hatzistergos said. "This new high-security regime is tougher than the conditions imposed on the state's most violent and dangerous non-terrorist inmates - for instance criminals such as
Ivan Milat."

[Just mention the most unpopular person to get the rest of the public to agree with draconian legislation for scapegoats for the Coalition of the Killing, typical of the behaviour of a government stooge.]

But this preparation comes too late because for the prisoners who have not died in the HRMU from their treatment but have self harmed or become brain dead through mental illness have already been critically damaged by their experience.
Hatzistergos just wants to make it legal now? But it's a bit too late to cover his tracks because we have recorded the complaints long before the legislation was even thought about!

Ten reported, "Mr Hatzistergos did not say so, but AA inmates would probably be housed at the High Risk Management Unit at Goulburn, known as Super Max, where A1 inmates, including
Milat, are held?

[Typical of the media propaganda as well, to use the most unpopular person in their article to argue for the Ministers draconian laws or in this case Regulations.]

But Hatzistergos knows so! And has even done so! For a long time prior this supposed alleged legislation/Regulation,
so cut the crap!

According to the draft
regulation, the Commissioner for Corrective Services, Ron Woodham, would impose an AA classification on inmates,[prisoners], "who, in the opinion of the commissioner" "with his discretionary powers" "represent a special risk to national security".

[Scapegoats or Patsies for the Coalition of the Killing's resource war's in the Middle East, whereby the Coalition had pre war plans, committed illegal and degrading pre-emptive attacks on foreign nation states, occupations, genocide, maiming and torture of Afghanistan and Iraq. So who are the terrorists? Who represents the greatest risk to any nations National Security? War criminals like George Bush, Tony Blair and John Howard!]

This is an indictment on society and the community is being told lies, half-truths and propaganda to say the very least,
we have proof.

Hatzistergos: "For example, because of a perceived risk that they may engage in, or incite other persons to engage in, terrorist activities."

Terrorist prisoners held in a "box within a box" with no "fresh air or sunlight" at Goulburn HRMU may incite alleged terrorists in Long Bay to blow up Long Bay's Twin Towers?

Proposed AA inmates,
[prisoners], "should at all times be confined in special facilities within a secure physical barrier that includes towers or electronic surveillance equipment".

A segregation yard!

Mr Hatzistergos said the Department of Corrective Services had been working with "other states" to develop national guidelines for managing terrorists and suspected terrorists in custody.

"Officers from my department have closely examined the security strategies used by
Israeli and French prison authorities," he said. "This regime represents world's best practice for dealing with terrorists in custody."

There are two inmates,
[prisoners], in NSW charged with terrorism offences - Faheem Khalid Lodhi, accused of plotting an attack on Australia's energy supply infrastructure, and Zeky Mallah, accused of planning a suicide bombing.

Justice Denied In NSW Prisons
There used to be a (VJ) or Visiting Justice who would go into the prison and judge any claim or accusation that was made by any prisoner or prison guard. If it were found that a prisoner had offended then punishment was metered out.

Draconian Scapegoat laws: Every Breath You Take?

Draconian scapegoat laws for the Coalition of the Killing's resource war's in the Middle East.

Commonwealth Ombudsman calls for accountable terror laws?

Every breath you take and every move you make, every bond you break, every step you take. I'll be watching you?

Commonwealth ombudsman John McMillan expects there will be a need for better accountability as terrorism,
[? draconian scapegoat], laws are bolstered across Australia.

Every single day and every word you say, every game you play, I'll be watching you?

Professor McMillan says while state and federal police cooperate in national security, there is less certainty about whether the state or commonwealth ombudsman should handle complaints about law enforcement.

Professor McMillan was speaking at an Administrative Law Conference in Hobart.

Oh, can't you see, you belong to me? How my poor heart aches, with every step you take. Every move you make, every vow you break, every smile you fake, every claim you stake. I'll be watching you?

He says although new anti-terrorism legislation preserves the role of the ombudsman, there are still gaps.

[But it's not anti-terrorism legislation unless you lock up the government for war crimes. What kind of professor are you?]

McMillan: Where there are jurisdictional divisions, there can easily be jurisdictional gaps and confusion and I think we need now to sit back and reflect on whether the national accountability mechanisms are as efficient, harmonised and coordinated as the law enforcement systems to which they apply," he said.

Since you've gone. I've been lost without a trace. I dream at night, I can only see your face. I look around but it's you I can't replace. I feel so cold and I long for your embrace. I keep crying baby, baby please....

By the time the ombudsperson deals with your complaint you'll be defeated and War criminal's John Howard and Philip Ruddock will be on a pension at taxpayers expense.

That is unless they are taken to the Hague for their

What we really require is despot laws for Howard and his cronies. People in this country that are morally bankrupt should not be in a position of power. And people like McMillan who cover up for them are no better than they are.

There is a gap all right between the dog box...And the end of the leash...around the ombudsman's neck.

But the greatest gap is between the citizens, Ombudsman's powers, and the draconian legislation.

The only way to have accountable terrorism laws is to repeal them. Or defeat them on appeal to the High Court, which may strike out the legislation somewhere down the track.

Those people directly effected need to take out a civil damages claim against the government but you may need a 'lawyer with the will' and a heap of money for that.

Is the Ombudsman going to do that? I don't think so!

In the late '80's Sting recorded a new version of the song known as "Every Bomb You Make" which was played out over the closing credits of the UK satirical TV show "Spitting Image". The rewritten lyrics were:

Every bomb you make, every job you take, every heart you break, every Irish wake. I'll be watching you. Every wall you build, every one you've killed, every grave you've filled, all the blood you've spilled. I'll be watching you.

Oh, can't you see, you belong to me?

Labor seizes on Cosgrove's Iraq comments

Federal Opposition leader Mark Latham says recent comments by the head of Australia's Defence Forces bolster Labor's case to bring troops, [militants], home from Iraq by Christmas.

When the Ombudsman investigates police in most States and Territories of Australia they set about asking the police to investigate themselves to see if there is any validity to a complaint.

Summary of 'Ombudsmen's Jurisdiction in Prisons'

* Ombudsman's main power comes from publicity it generates and possibility of reporting to Parliament.

Victorian Ombudsman's power boosted

The Victorian Government has reacted strongly to continuing allegations of police corruption, with the Premier announcing a big boost to the State Ombudsman's power and resources.

Up there Khazal: Innocent man new bail laws
The New South Wales Supreme Court has asked innocent man Belal Khazal to increase to amount of surety offered, before the bail is formally continued.

Labor to back new draconian scapegoat laws?
The [alleged], federal opposition will support changes to the nation's terrorism, [? draconian scapegoat], laws, which the Government is expected to introduce to Parliament today.

Scapegoat bail laws pass NSW Parliament
New laws to make it difficult for people charged with terrorism offences, [scapegoats for the Coalition of the Killing's resource war's in the Middle East], to get bail have been whisked through the New South Wales Parliament after only being introduced earlier today.

Hatzsistergos defends speedy draconian laws
The New South Wales Government has been accused of "ramming" through a bill designed to make it much tougher for people to get bail if they are accused of terrorism-related offences, [scapegoats for the Coalition of the Killing's resource war's in the Middle East.]

Moroney moves to appeal Khazal bail decision
The federal government created the draconian laws, based on their resource war's in the Middle East and numerous, call to arms, false flag operations around the world. Then the government fear-mongered the general public about it, by using their media power, and then the federal government came up with their own solutions, about how to fix the problems, they themselves have created, for their own reasons. Now we have reduced, oversight, standards at law and reduced rules of evidence etc. Now Moroney wants to take away bail which proves the obvious.

New laws to stop bail for scapegoats
The New South Wales Attorney-General has rushed new laws into State Parliament to make it difficult for people charged with terrorism offences, [scapegoats for the Coalition of the Killing's resource war's in the Middle East], to get bail.

What's the Rush? Non Parole period for scapegoats
[Problem, Reaction, Solution. Firstly, the ASIO provocateur creates the problem, (approaches Jack Roche and asks...Can you take pictures of the Israel Embassy?) then (Roach thinks he's found a friend that also hates Israel) and then (ASIO set him up as the patsie), and then the Government gets a response from the corporate media and the general public about what to do about it. Then Ruddock finds the solution.]

Khazal: A stitch in time saves nine?
Lakemba man Belal Khazal, 34, was granted bail yesterday after appearing in Sydney's Central Local Court charged with activities related to terrorism. [Another Scapegoat for the Coalition of the Killing's resource war's in the Middle East.]

Channel Nine judge finds Saleh Jamal Guilty?
Why would a man carry out a shooting attack on a police station in Sydney's south-western suburbs? Because police wouldn't give him a licence? Because police owed him money?

AUSTRALIA'S involvement in the war in Iraq may have increased the terror threat at home and in the Middle East, ASIO chief Dennis Richardson said yesterday.

In parallel to Richardson's statement last week NSW Premier Bob Carr Introduced this legislation into NSW Parliament.

This is scary stuff where LAW/CRIME have come together as one in the name of "terrorism". Your home can been invaded by the most unlikely criminals NSW Police and the use of Force becomes a total reality in NSW homes.

Mr Richardson, the director-general of security at 'the nation's flop spy agency', told the Sydney Institute the Iraq war had been a useful propaganda tool for terror group al-Qaeda, helping it recruit many new followers.

"Iraq has provided al-Qaeda with propaganda and recruitment opportunities and it only stands to reason that they would have some success," he said.

"It has provided another justification or rationalisation for acts of terrorism.

[But the Iraq war was an act of terrorism and also provided Mr Richardson the "terrorist" director-general of security at the nation's flop spy agency the very same and perhaps better useful propaganda tools for terror group George Bush and the gang of 3 BUSH, BLAIR AND HOWARDWanted for pre-war plans, pre-emptive attacks on the Sovereign Nation States of Afghanistan and Iraq, subsequent occupations, genocide, maiming, rendition and torture.]

The Federal Government insists the Iraq war has not increased the risk of terrorism in Australia, saying the Bali bombings, which killed 88 Australians, occurred before troops went committed to Iraq.

[That's exactly the point though, as all these people said no to war with protests:

So, to fear-monger the Australian population to allow Australian politicians the political will to wage war... A call to arms, staged false flag, state sanctioned terror, military hardware 2nd Bali Bomb blast attack, was staged with the complicity of Indonesia and Australian authorities and blamed on the 'chicken farmers' first bomb blast, hence Mr Dennis Richardson's useful propaganda tool for terror group George Bush and the gang of 3, BUSH, BLAIR AND HOWARD.]

[Allegedly], Australian Federal Police commissioner Mick Keelty was forced to withdraw remarks earlier this year suggesting Australia could be more of a terror target because of Iraq.

[Allegedly], Mr Keelty made his comments after the deadly Madrid bombings in March, which were linked to Spain's involvement in the war.

[Another staged false flag attack and a call to arms fear mongering the Spanish to attack Iraq.]

Mr Richardson has generally backed the Government line that war on Iraq had not increased the threat of terrorist attack for Australia.

[Just plain rubbish and propaganda.]

While saying the formal threat level in Australia had not risen, [Mr Richardson left open the possibility that war may have motivated Islamic extremists in Australia who wanted to do harm.]

[That's the fear Richardson wants the Australian people to react to. Even thought all the terror has been created by the Australian government and the Coalition of the Killing nations. This also opens the door of your home the reason to "Break and Enter": NSW Police.]

Problem: Iraq War

Reaction: Protest

Solution: Draconian Laws at Home

Richardson: "(The war) has increased the threat of terrorism against Australian interests in the Middle East," he said.

"So far, Iraq has not had a significant impact on the security environment here in Australia and it has not led to any need to raise the formal threat levels.

Richardson: "It is possible that some new followers in Australia have been motivated primarily by Iraq and we cannot exclude the possibility of Iraq being a motivator for some people here in Australia who may want to do harm."

[What do we make of Richardson's statement? First he gives us a concession that is ' he agrees with the community that, when you illegally go to war on a sovereign nation someone might come back to hit you on the head for being ignorant'. But that information from supposed ' nations top spy agency is antiquated and academic. In short old news to gather support to invade your home, plant evidence and make claims about new terrorist suspects! And of course what a diligent spy agency we have?]

Still, Mr Richardson said Australia's involvement in Iraq was not the central driver behind terrorist attacks such as the Jakarta embassy bombing?

Why not? Fear drives people to take action.]

Richardson: "It's easy to get so caught up in the debate about Iraq you overlook the simple fact that al-Qaeda's intent and purpose was marked out long before Iraq and long before 9/11," he said.

[Err...Pre Afghanistan and Iraq war plans long before the USA, CIA, Reichstag false flag operation 9/11.]

"All the terrorist attacks outside Iraq during and since the war and committed by al-Qaeda or groups sharing its ideology would've occurred, in my view, with or without the war?

[Just plain rubbish and propaganda. False flag operations committed by spy agencies and state sanctioned terror blamed on the enemy they are attacking in Afghanistan and Iraq. Attacks created to get the political will to wage their illegal and degrading war. Why would people believe criminals who pre-emptively attacked someone?]

"That includes (the March 11 terrorist bombing of) Madrid and the attack on the Australian embassy in Jakarta on 9 September."?

"To the extent Iraq may have been a motivator, when you strip it down it has been an add-on, not the central driver."?

Despite the growing terrorist network,
[Bush, Blair and Howard], fuelled by the Iraq war, Mr Richardson said the coalition still had a crucial role to play in Iraq.

[Resource wars, and the subsequent occupation, genocide, maiming, rendition and torture to steal it.]

"In the context of global terrorism, the real potential downside would be in the US-led coalition losing its resolve and drifting away,"? he said. "That would embolden militant Islamists globally and could lead to the establishment in parts of Iraq of Afghanistan-type safe havens for terrorists in which training and other rebuilding could occur unhindered. At this stage, in my view, we have more to lose if the US-led coalition gives up then if it stays with the proper resourcing and commitment."?

[Just plain rubbish and propaganda. All war criminals should be charged with their crimes and brought to trial.]

The Bali Bombings were a direct US-Israeli response to the growing Peace marches and Anti War Movement in Australia that was ballooning at an alarming rate after 9-11 and after Bush announced he was waging illegal invasions. It also very quickly secured Indonesia's and Australia's subservience to the US and cemented involvement in the US led War on Terror, and subsequent illegal invasions of Iraq and Afghanistan.

Putting Your Finger on the Line: Biometric Identification Technology The NSW Department of Corrective Services has progressively been implementing biometric identification technology (BIT) for use on all entrants into maximum security prisons since August 1996. It currently operates in seven prisons in NSW and is scheduled for introduction at Parklea prison later this year. BIT has raised the ire of many community agencies, the legal fraternity and government authorities. The promotion of law and order means money to big business. Profits from insurance, security fixtures, patrol services and the like can only continue to grow if the perceived threat of uncontrollable crime wave escalates.
