Pie in the Sky: How Joe Hill's Lawyers Lost His Case, Got Him Shot, and Were Disbarred
It could be said that the Joe Hill murder trial rates as one of the most important trials in Utah's history. Hill, a prolific Labor Union songwriter, was accused of murdering a Salt Lake City shopkeeper and his son during a robbery in 1914. In Pie in the Sky, author and trial lawyer Kenneth Lougee analyzes this case and explains the errors that were committed during the trial, which resulted in Hill's guilty verdict and subsequent execution. Interested in more than Hill's guilt or innocence, Lougee provides a thorough discussion of the case-including Hill's background with the Industrial Workers of the World, the political and religious climate in Utah at the time, the particulars of the trial, and the failings of the legal process. In this analysis, Lougee focuses on those involved in the trial, most especially the lawyers, which he describes in the text as "the worst pieces of lawyering of all time". Pie in the Sky presents a breakdown of this case from a lawyer's perspective and shows why this trial is still a matter of interest in the twenty-first century.

The second year of law school draws to an end in early May, and it hits me that this is near being over. The ten years that I've spent off and on in college is coming to an end. It's time to start thinking about what I'll be doing in another year and where I want to live. But before I get ahead of myself a cautionary tale about being careful who you work for and empty promises. A buddy of mine called me up with news that he had gotten a job clerking with an attorney for the summer and that if I wanted the same opportunity to call up this guy. I go and interview and immediately like the guy. He offers to let us live in a trailer he has on his property for the summer, says he'll install cable and a phone for us and carry us out to eat once a week for lunch. And all we would be doing is research and drafting a criminal brief or two for the Mississippi Supreme Court. Easy enough. The place is only 80 miles from where I was living so I didn't have to move much. That first weekend I carry some food items in an ice chest and leave the ice chest on the front porch. The next morning it's missing. I inquire about it and "Nope, I haven't seen it." We start work and it's relatively easy, but no cable or phone is forthcoming. We don't want to rattle the cage so we never ask about it. And no shit, but the very last day we're there that summer I happen to walk by the attorney's truck. There in the back is my mofacking ice chest in all it's plastic glory. Two years later I'm working in Jackson and start talking to an attorney who's in court and from a town near the one I had worked in that summer. I make mention of who I had worked for. The attorney's face immediately changes and says "It's a shame about L__." He had not disclosed $10,000 on a client's bankruptcy petition, which is a federal crime. A year later he pleads guilty to a felony and is permanently disbarred. Moral of the story: Don't steal your law clerks ice chest, fool!

Lynn Stewart, who was prosecuted and disbarred for legally representing those the government thinks should have no legal representation. A radical human rights attorney, she has been falsely accused of helping terrorists. Now convicted, she faces 30 years in prison. On Tuesday, April 9, 2002, she was arrested and agents searched her Manhattan office for documents. She was arraigned before Manhattan federal Judge John Koetl. This is an obvious attempt by the U.S. government to silence dissent, curtail vigorous defense lawyers, and install fear in those who would fight against the U.S. government's racism, seek to help Arabs and Muslims being prosecuted for free speech and defend the rights of all oppressed people.
