285/365: "Case Dismissed" I've been dealing with this for a while. A few years ago, I paid off and closed an account with Capital One. Suddenly, I started getting threatening letters from a company called Midland Funding. Letters that said things like "You have 30 days or we're going to sue. This notice is from a debt collector." WTF? The thing is, they never gave me any info. Just an absolutely outrageous payoff amount and an offer to settle out of court. I was more than happy to go to court. It was stressful, but I knew I would win. BUT, I was handling the whole thing myself...Pro Se. So of course, there's always the chance that something can go wrong. It did. For the law firm of Pressler and Pressler. What went wrong for them, was me. A little simple fact checking would have gone a long way for them. Instead, they wasted time, effort and money pursuing a case they couldn't win. In NJ you are required to enter mediation before a trial. I sat at the table with the unbiased third party and the lawyer representing the plaintiff and listened to their side of the story. Then I made my offer: "You can agree to a motion to dismiss with prejudice in this room behind closed doors, or I can get in front of the judge and get the same result in public so the rest of your defendants can see how I do it. But the bottom line is, I am leaving here today with paperwork in hand that says Dismissed with Prejudice. The choice of how I get it is yours." The attorney called her boss, then signed the papers. I work too hard to take that kind of crap from some schuyster law firm that bullies people.
