Areas Of Practice

Domain Names and Social Media

Cybersquatting, typo-squatting and other forms of domain name abuse are rampant on the internet leading to diversion of customers, confusion, brand harm, and lost sales.  Through a combination of selection, counseling, enforcement, and, where appropriate, negotiation of domain sales or settlement, we have helped clients maximize returns from their online brand investments.  In particular, we have achieved the rare milestone of winning over 280 decisions under the Uniform Dispute Resolution Policy (UDRP) and the dispute policies of various country-code domain names. A number of these decisions may be viewed here.  Similar problems plague usernames on sites like Facebook, Twitter, Instagram, and others allowing users to impersonate brand owners and, in some cases, commit fraud.  We have been able to put a stop to account name abuses through formal complaints and our relationships with the legal teams at various social media providers.

Trademarks

Your brand is your reputation and, in business, your reputation is your life.  It's critical that trademarks be chosen in a safe way and properly used and protected from abuse by others.  If a conflict does arise, swift and effective action can minimize any customer confusion and harm to your brand and your reputation.  We have decades of experience in researching and registering trademarks whether it involves one product line in the US or the management of a global, multi-line trademark portfolio.  Our network in the industry is extensive and we have a long and proud track record of helping clients to avoid expensive disputes before they occur.  Of course, we can forcefully protect client's trademarks and creatively resolve disputes when they do arise.
