Also you must watch the video below and determine how many fields of data you need and what kind of fields and email this to me. 49. In class or online (if you have Access on your home computer but if you are online student then see above as to what to do) But use the following video (see below) as a basis for your Access database fields - watch it and take notes - then create a database that has a field for every relevant discrete piece of information. This is called creating a taxonomy for a case database. Remember that the types of fields you need to categorize both the type of near miss and other relevant factual information. I watched the following video and determined that I would need at least 15 fields of data in my taxonomy. One of the fields you will need is called an OLE field. Into that field you will need to put a picture from the video below - pausing the video and using the Snipping tool to capture the area of the stilled video you want, saving the snip to a file and then insert it into the OLE field in the database. In class students will be shown on how this is done, online students must watch the video as to how it is done. How to Insert a Picture - one method: https://youtu.be/C3TZfWpLxkY Pretend you know the names of the persons in each of the incidents and companies and locations as well as types of vehicles, etc. After you create the database with the necessary fields enter 3 records into the database, save it to your usb stick and for in-class students I will look over your work in class but if you are an online student save it to your usb stick and email it to me. 50. IOLTA Accounts - http://www.iolta.org - what are they? Email me your definition. What is IOLTA? Interest on Lawyers Trust Accounts (IOLTA) is a unique and innovative way to increase access to justice for individuals and families living in poverty and to improve our justice system. Without taxing the public, and at no cost to lawyers or their clients, interest from lawyer trust accounts is pooled to provide civil legal aid to the poor and support improvements to the justice system. A lawyer who receives funds that belong to a client must place those funds in a trust account separate from the lawyer's own money. Client funds are deposited in an IOLTA account when the funds cannot otherwise earn enough income for the client to be more than the cost of securing that income. The client - and not the IOLTA program - receives the interest if the funds are large enough or will be held for a long enough period of time to generate net interest that is sufficient to allocate directly to the client. Every state, along with the District of Columbia and the Virgin Islands, operates an IOLTA program. In 2009, the U.S. IOLTA programs generated more than $ 124.7 million nationwide. These funds, together with state and federal appropriations as well as private grants and donations, enable nonprofit legal aid providers to help low-income people with civil legal matters such as landlord/tenant issues, child custody disputes and advocacy for those with disabilities. 59. There are rules regarding what you can do to enhance a digital image. We will go over these in the in-class version of the course but online students need to read the following and send me a synopsis - See: http://www.thirdamendment.com/photos.html Check with Your Legal Advisor When beginning a new procedure for collecting evidence or recording a crime scene, it is always prudent to check with your legal advisor. Consider the Federal Rules of Evidence, your state's rules of evidence, and other court decisions. Two court decisions regarding digital images include: State of Washington vs. Eric Hayden, 1995: A homicide case was taken through a Kelly-Frye hearing in which the defense specifically objected on the grounds that the digital images were manipulated. The court authorized the use of digital imaging and the defendant was found guilty. In 1998 the Appellate Court upheld the case on appeal. State of California vs. Phillip Lee Jackson, 1995: The San Diego (CA) Police Department used digital image processing on a fingerprint in a double homicide case. The defense asked for a Kelly-Frye hearing, but the court ruled this unnecessary on the argument that digital processing is a readily accepted practice in forensics and that new information was not added to the image. 67. See: http://www.crime-scene-investigator.net/admissibilityofdigital.html and email me a synopsis Assignment Set 9 68. In preparation for this session read chapter 17 69. Review for Mid-term - see the glossary terms in the back of each chapter.
71. How to Recover data from a hard drive that won't boot or when the "shell" it is in won't work using Apricon hard drive recovery unit. 72. The reason why external USB hard drives that have power units go "dead" is usually because the power supply circuit goes bad - but the data on the drive is still good - hence you must remove the drive from the USB shell and use a devise like the Apricorn unit to power it up and plug it into your computer using its usb interface 73. YOUTUBE that shows how: https://www.youtube.com/watch?v=c3t5mPMyy-w Online students are to watch this video - create a Powerpoint slideshow in which you insert some of the images from this video and add your text explanations of the process. In-class students will watch the video and take notes as to how this is done. It is important for you to know in ediscovery how to get data off of a drive in this very inexpensive way if the drive won't 'boot' anymore or if the power unit in the usb shell is broken. The reason to know this has to do with recovery of important ediscovery requested data - either data your lawyer has requested or the other side has requested. It is possible that the drive mechanism - the 'motor' inside the drive or the sprint mechanism is broken - in that case you can't recover the data yourself - but you can possibly get it all back by sending the drive to a forensic recovery company like this one: https://datarecovery.com/services/hard-drive-data-recovery/ 74. And Example of how an object can be removed from a digital image - this is not permitted regarding evidential image and forensic experts can detect this modification: https://www.youtube.com/watch?v=ifhEx4adAa8 Online students are to watch this video and then email me an explanation of how an object can be removed from a digital image - in-class students will watch this together and discuss it in class.
