Court Related Matters
Providers at Sensible Care do not provide court ordered treatment, and do not complete or submit third party forms/correspondence. In addition, providers do not participate in court related matters as expert witnesses, such as, but not limited to: divorce, custody matters, workers’ compensation/disability, and/or criminal matters. Providers, on occasion, may receive a subpoena to produce a patient record, to testify in court at a trial or hearing, or to appear at a deposition. Providers should seek assistance from their supervisor to determine proper response to a subpoena.
Subpoena Response Procedure
Subpoenas are handled internally by Sensible Care’s Compliance Manager/Custodian of Records. This means while you are employed by Sensible Care, our Compliance Manager/Custodian of Records will review any subpoena received and respond to the subpoena accordingly. As a provider of the patient, you will be informed that a subpoena has come in only for your awareness. However, in the case that you receive a subpoena for records directly, please notify the Compliance Manager.

FMLA, Disability Forms, and Leave of Absences
Therapists at Sensible Care are not able to complete FMLA forms, certify for disability, certify for leave of absences based on disability for any setting, certify or complete any forms for educational settings. Please note this list is not exhaustive.
If a request such as the above is received by any Sensible Care therapy provider, please refer the patient to their PCP, or prescriber if they have one. If it is helpful to the patient, we may release the records directly to the patient so they can furnish their records to the provider that will certify the requested form for them.

Letters Requested by Patients
Providers at Sensible Care may provide letters* requested by their patients with information limited only to dates of attendance, diagnosis applicable to treatment only and/or symptoms, prognosis, and general progress of the patient. Providers must ensure that patient letters do not include opinions or recommendations. Consult with therapy leadership team for assistance with letter review if needed.
*Letters will be charged a standard fee, as this is not an insurance covered service.
