These Terms of Use ("Terms") govern your use of the Flashback Cam mobile application ("App") developed by Roch Enterprises ("we", "our", "us"). By downloading, installing, or using the App, you agree to be bound by these Terms. If you do not agree to these Terms, do not use the App.

## 1. ACCEPTANCE OF TERMS
By accessing or using Flashback Cam, you confirm that:
- You are at least 13 years of age (or the minimum age required in your jurisdiction)
- You have read, understood, and agree to these Terms
- You have read and agree to our Privacy Policy

## 2. LICENSE GRANT
Subject to your compliance with these Terms, we grant you a limited, non-exclusive, non-transferable, revocable license to:
- Download and install the App on devices you own or control
- Use the App for personal, non-commercial purposes
This license does not include the right to:
- Modify, reverse engineer, decompile, or disassemble the App
- Rent, lease, lend, sell, redistribute, or sublicense the App
- Copy, distribute, or create derivative works based on the App
- Remove any proprietary notices or labels on the App

## 3. APP DESCRIPTION & FEATURES
Flashback is a camera application that allows you to:
- Record video with a rolling buffer feature
- Save past moments using the buffer system (last 5-30 seconds)
- Store videos locally on your device
All media processing occurs on your device only. We do not upload, transmit, or store your videos on our servers.

## 4. SUBSCRIPTIONS & IN-APP PURCHASES
### 4.1 Subscription Options
Flashback Cam offers the following subscription options:
- **Monthly Subscription** – Billed monthly, renews automatically
- **Yearly Subscription** – Billed annually, renews automatically
- **Lifetime Purchase** – One-time payment, no renewal required
### 4.2 Subscription Features
Pro subscribers receive:
- Access to all buffer duration options.
- All video quality options
- Future premium features
### 4.3 Free Trial
If a free trial is offered:
- The trial period (if any) is specified at the time of subscription
- Your subscription will automatically convert to a paid subscription at the end of the trial unless cancelled
- You must cancel before the trial ends to avoid charges
### 4.4 Billing & Renewal
- Subscriptions are billed through Apple App Store
- Payment is charged to your Apple ID account at confirmation of purchase
- Subscriptions automatically renew unless cancelled at least 24 hours before the end of the current period
- Your account will be charged for renewal within 24 hours prior to the end of the current period
- Renewal price is the same as the original subscription price unless otherwise notified
### 4.5 Cancellation
You may cancel your subscription at any time:
1. Go to **Settings** on your device
2. Tap your **Apple ID** (your name at the top)
3. Tap **Subscriptions**
4. Select **Flashback cam**
5. Tap **Cancel Subscription**
Cancellation takes effect at the end of the current billing period. You will retain access to Pro features until then.
### 4.6 Refunds
Refund requests are handled by Apple. To request a refund, visit [reportaproblem.apple.com](https://reportaproblem.apple.com) or contact Apple Support.

## 5. USER RESPONSIBILITIES
You agree to:
- Use the App only for lawful purposes
- Not use the App to record others without their consent where required by law
- Comply with all applicable laws regarding video and audio recording
- Not use the App to create content that is illegal, harmful, threatening, abusive, harassing, defamatory, or otherwise objectionable
- Not attempt to gain unauthorized access to any portion of the App

## 6. INTELLECTUAL PROPERTY
All rights, title, and interest in and to the App, including but not limited to:
- Software code
- Graphics and user interface
- Logos and trademarks
- Documentation
are owned by Roch Enterprises. These Terms do not grant you any rights to our trademarks, service marks, or logos.

## 7. PRIVACY
Your use of the App is also governed by our Privacy Policy, available at:

By using the App, you consent to the collection and use of information as described in the Privacy Policy.

## 8. DISCLAIMER OF WARRANTIES
THE APP IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO:
- IMPLIED WARRANTIES OF MERCHANTABILITY
- FITNESS FOR A PARTICULAR PURPOSE
- NON-INFRINGEMENT
WE DO NOT WARRANT THAT:
- The App will be uninterrupted or error-free
- Defects will be corrected
- The App is free of viruses or harmful components
- The results of using the App will meet your requirements

## 9. LIMITATION OF LIABILITY
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, ROCH ENTERPRISES SHALL NOT BE LIABLE FOR:
- Any indirect, incidental, special, consequential, or punitive damages
- Loss of profits, data, use, goodwill, or other intangible losses
- Any damages resulting from unauthorized access to your device or data
- Any damages resulting from interruption or cessation of transmission to or from the App
IN NO EVENT SHALL OUR TOTAL LIABILITY EXCEED THE AMOUNT YOU PAID US IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM.

## 10. INDEMNIFICATION
You agree to indemnify, defend, and hold harmless Roch Enterprises and its officers, directors, employees, and agents from any claims, damages, losses, liabilities, costs, or expenses (including reasonable attorneys' fees) arising from:
- Your use of the App
- Your violation of these Terms
- Your violation of any rights of another party
- Your violation of any applicable law

## 11. TERMINATION
We may terminate or suspend your access to the App immediately, without prior notice or liability, for any reason, including if you breach these Terms.
Upon termination:
- Your license to use the App will cease immediately
- You must delete all copies of the App from your devices
- Provisions that should survive termination will remain in effect

## 12. CHANGES TO TERMS
We reserve the right to modify these Terms at any time. Changes will be effective upon posting at:

Your continued use of the App after changes are posted constitutes your acceptance of the revised Terms.

## 13. GOVERNING LAW
These Terms shall be governed by and construed in accordance with the laws of India, without regard to its conflict of law provisions.

Any disputes arising from these Terms or your use of the App shall be resolved through:

2. **Arbitration** – If informal resolution fails, disputes shall be resolved through binding arbitration in accordance with applicable arbitration rules

## 15. SEVERABILITY
If any provision of these Terms is found to be unenforceable or invalid, that provision shall be limited or eliminated to the minimum extent necessary, and the remaining provisions shall remain in full force and effect.

## 16. ENTIRE AGREEMENT
These Terms, together with the Privacy Policy, constitute the entire agreement between you and Roch Enterprises regarding the App and supersede all prior agreements and understandings.

## 18. APPLE-SPECIFIC TERMS
These Terms are between you and Roch Enterprises only, not with Apple. Apple is not responsible for the App or its content.
Apple has no obligation to provide any maintenance or support services for the App.
In the event of any failure of the App to conform to any applicable warranty, you may notify Apple, and Apple will refund the purchase price (if any). Apple has no other warranty obligation with respect to the App.
Apple is not responsible for addressing any claims by you or any third party relating to the App.
Apple is a third-party beneficiary of these Terms and may enforce them against you.
