IS MY CASE AN UNCONTESTED CASE?
An uncontested divorce is the type of divorce case where the parties have an agreement and wish to relay that agreement to an attorney. We do not advocate for either side in these cases but instead take the role of a document preparer and can provide suggestions based on my experience when the parties get stuck on an issue.
HOW LONG DOES AN UNCONTESTED DIVORCE TAKE ?
- Parties can be divorced as soon as all the required legal pleadings are preapred in cases where there are no children and the parties have been separated more than 60 days. Cases involving children must pend for atleast 60 days before they can be resolved.
HOW LONG MUST I BE SEPERATED BEFORE FILING A DIVORCE?
Parties must be seperated for 60 days in order to file for divorce. However, while this usually means one party has moved out of the marital home, it can mean that the parties agree they have not lived together as man and wife for atleast 60 days. (This can occur even though the parties are residing under the same roof)
HOW LONG WILL IT TAKE TO GET DIVORCED?
We can process your divorce fast if you assist us by completing our online questionnaire. After you complete that, we have had cases ready as early as the same day. More often it takes a few days to a week to prepare everything. A meeting is required with both parties present. Then electronic filing speeds up the process of presenting your agreed case to the Court. We can efile same day from the office and the Family Court Judge can sign your divorce decree from chambers, or from a tablet or phone. The process can move a lot more swiftly than in days past.
If parties have minor children, a case must pend for 60 days before it can be settled. So these cases take 60 days + the time required to file a divorce petition and meet to sign the settlment agreeement and other required documents.
