Data Privacy

Over the years, school districts have been following various state and federal privacy laws and regulations. The newest law, New York State Education Law Section 2-d, was established in April 2014 to provide clear protections for student data.

Information on Education Law 2D - Part 121

New York State Department of Education has recently released the adoption of a new law that focuses on increasing the security measures of information to safeguard the Personally Identifiable Information (PII) of students and certain school personnel. Since the New York State Department of Education has committed to promoting the least intrusive data collection policies practicable, they have been working with an advisory group and has held statewide forums in order to receive input to develop implementing regulations. The goal was to improve academic achievement, empower parents with information and advance efficient and effective school operations while minimizing the collection and transmission of personally identifiable information. The recommended adoption of Part 121 Regulations for Ed Law 2-d was reviewed by the Board of Regents and adopted at their January 13, 2020. The regulations are effective as of January 29, 2020.
