The Facts: Setting the Record Straight

There is significant misinformation regarding this case. Below are the documented legal facts verified by the Philippine court system and the DSWD.

1. Legal Custody & The Mother’s Status

  • Who has legal custody? By court order, custody was awarded to the father. Following an investigation into the child’s wellbeing, the DSWD confirmed this arrangement on 13 April 2020.

  • Is the mother a fugitive? Yes. There are active warrants for her arrest regarding Perjury and Failure to Return a Minor.

  • Why was the child taken from her originally? In September 2019, the mother was arrested for using falsified documents. At that time, she attempted to send Madeline to an orphanage rather than allow her to live with her father.

2. The "Fake Marriage" Fraud

The mother claimed to be my legal wife to file for assets and criminal charges. After a 6-year legal battle, the truth was proven in court:

  • The Verdict: In 2023, the Court issued a resolution declaring the marriage a forgery. It was officially removed from the registry in April 2024.

  • The Evidence: There was no wedding ceremony. There are no wedding pictures. Forensic analysts proved my signature was falsified. The "Solemnizing Officer" testified he had never seen either parent. The marriage license was confirmed fake by the Registrar of Nueva Ecija. Under oath, the mother claimed she has no memory of the wedding, where it was held or celebrated.

  • The Motive: The "marriage" was used to file for false criminal charges (concubinage, domestic abuse), spousal support, property claims, and a deportation order against me.

  • Were the abuse claims true? No. The 2018 domestic abuse case filed by the mother was dismissed. There was no medical evidence, and I was not living with her at the time of the alleged incidents. The court found her testimony lacking credence and inconsistent with someone speaking the truth.

  • The Father’s Support: Despite the conflict, I provided child support of 40,000 Pesos/month, paid for international schooling, and purchased a home for Madeline and her mother to live in before custody was legally transferred.
