1. Legal Custody & The Mother’s Status

Who has legal custody? By court order, custody was awarded to the father. Following an investigation into the child’s wellbeing, the DSWD confirmed this arrangement on 13 April 2020.
Is the mother a fugitive? Yes. There are active warrants for her arrest regarding Perjury and Failure to Return a Minor.
Why was the child taken from her originally? In September 2019, the mother was arrested for using falsified documents. At that time, she attempted to send Madeline to an orphanage rather than allow her to live with her father.
