LA FLOR by JT Terms and Conditions
1. Definitions
"We," "us," or "our" refers to LA FLOR by JT (ABN 39 486 519 707).
"You" or "your" refers to the client.
"Services" refers to the floral design and related services provided by us.
"Site" refers to www.laflorjt.com and any other platforms we use to offer our services.
"Event" includes weddings, parties, corporate functions, and other similar occasions.
"Order" refers to a purchase of floral arrangements or other products.
2. Agreement to Terms
By engaging our Services, whether through our Site, phone, email, or in person, you agree to be bound by these Terms and Conditions. Please read them carefully before proceeding. If you do not agree with these Terms and Conditions, please do not engage our Services.
3. Changes to Terms
We reserve the right to amend these Terms and Conditions at any time. The most current version will be available on our Site. It is your responsibility to review these Terms and Conditions periodically for any changes. Continued use of our Services after changes are posted constitutes acceptance of those changes.
4. Scope of Work
The scope of work for larger weddings and events will be detailed in a separate agreement, quote, or proposal (the "Agreement") provided to you. This Agreement will outline the specific floral arrangements, quantities, delivery details, and other relevant information. Orders will be detailed in a separate invoice and provide the specific floral arrangements, delivery details and other relevant information. Verbal agreements will not be considered binding unless confirmed in writing.
5. Booking and Payment
Events/Weddings: A non-refundable deposit of 25% of the total quoted price is required to secure your event date. No date is considered booked until the deposit is received and the Agreement is signed.
Orders: Full payment is required upon placement of the order.
Payment Methods: We accept bank transfer and credit card payments. Please note credit card payments will incur a 1.75% surcharge.
Final Payment (Events/Weddings): The remaining balance is due 4-6 weeks prior to the event date, as specified in the Agreement. Failure to make the final payment by the due date may result in cancellation of the booking and forfeiture of the deposit.
Overdue Payments: We reserve the right to charge interest on overdue payments at a specified rate.
6. Cancellation Policy
Events/Weddings:
Cancellations 90 days or more prior to the event date will result in forfeiture of the deposit.
Cancellations less than 90 days prior to the event will require payment of 50% of the total quoted price.
Cancellations less than 60 days prior to the event date will require payment of 75% of the total quoted price.
Cancellations less than 30 days prior to the event date will require payment of 100% of the total quoted price.
Orders: Cancellations for orders may be accepted up 5 business days before the scheduled delivery/pickup date, subject to a cancellation fee of 25% of the total cost of the order. No refunds will be given for cancellations made after this time.
7. Flower Substitution
While we make every effort to provide the flowers as discussed, we reserve the right to substitute flowers of equal or greater value and similar appearance if necessary due to availability, seasonality, or other unforeseen circumstances.
8. Care and Maintenance
We will provide you with care instructions for your flowers. We are not responsible for any damage to the flowers after they have been delivered or picked up, including damage caused by improper care, handling, or storage.
9. Inclement Weather (Outdoor Events)
For outdoor events, we will take all reasonable precautions to protect the floral arrangements from inclement weather. However, we are not responsible for any damage caused by weather conditions beyond our control. We reserve the right to make necessary adjustments to the designs to ensure safety and longevity of the flowers.
10. Photography and Social Media
We may photograph the floral arrangements we create for marketing and portfolio purposes. By engaging our Services, you grant us permission to use these photographs on our website, social media, and other marketing materials. We will not identify you or your event without your prior consent. We appreciate you sharing professional photos of our work and tagging us on social media where appropriate.
11. Allergies and Sensitivities
You are responsible for informing us of any allergies or sensitivities that you or your guests may have to flowers or foliage. While we will take reasonable precautions, we cannot guarantee that our arrangements will be completely allergen-free. We are not liable for any allergic reactions or other health issues arising from contact with our floral arrangements.
12. Limitation of Liability
Our liability to you for any loss or damage arising out of or in connection with our Services shall be limited to the total amount paid by you for the specific Services in question. We are not liable for any indirect, consequential, or incidental damages, including but not limited to loss of profits, emotional distress, or other indirect losses.
13. Force Majeure
We are not liable for any failure or delay in performing our obligations under these Terms and Conditions if such failure or delay is caused by circumstances beyond our reasonable control, including but not limited to acts of God, natural disasters, war, terrorism, riots, embargos, acts of civil or military authorities, fire, floods, accidents, strikes, or shortages of transportation, facilities, fuel, energy, or materials.
14. Intellectual Property
All floral designs, photographs, and other materials created by us are our intellectual property and may not be reproduced or used for commercial purposes without our prior written consent.
15. Governing Law
These Terms and Conditions are governed by the laws of New South Wales, Australia. Any disputes arising out of or in connection with these Terms and Conditions shall be subject to the exclusive jurisdiction of the courts of New South Wales.
16. Entire Agreement
These Terms and Conditions, together with the Agreement for events and weddings, constitute the entire agreement between you and us regarding the Services and supersede all prior discussions and agreements, whether written or oral.
