ABSTRACT

The renewal of criminal procedural law through the enactment of Law Number 20 of 2025 concerning the Criminal Procedure Code (KUHAP Nasional) NATIONAL CHANGE brings a significant paradigm shift in the Indonesian criminal justice system, especially in the realm of proving corruption crimes. This normative legal research with a regulatory approach, conceptualization, and comparison aims to analyze the transformation of the system of proving corruption crimes after the enactment of the National Criminal Procedure Code, compare it with the previous system, and identify various obstacles in the implementation stage. The results of the study show that if the old evidentiary system (KUHAP 1981) only recognizes five types of conventional evidence and places digital evidence in a limited manner, the National Criminal Procedure Code expands its scope to eight types of evidence and confirms the position of electronic evidence as valid independent evidence. On the other hand, the integration of the State Officials' Wealth Report (LHKPN) in the last five years now has a strategic position as a supporting electronic document to track irregularities in asset increases. However, the effectiveness of this modern system still faces serious obstacles in the field which are dominated by internal factors of law enforcement, namely Differences in interpretation due to the persistence of old paradigms account for 35%, followed by limited digital and forensic competencies at 25%, and suboptimal database integration between institutions. Therefore, the successful implementation of the National Criminal Procedure Code requires strengthening the capacity of judicial officials, harmonizing technical regulations, and equalizing information technology infrastructure.
