By downloading and using the Duxbe Business app (“the App”), you agree to comply with and be bound by these Terms and Conditions.
1. APPLE MINIMUM TERMS ACKNOWLEDGEMENT 1.1 Acknowledgement: This EULA is concluded between You and Hancod Digital Pvt Lmt only, and not with Apple. Hancod Digital Pvt Lmt is solely responsible for the App and its content. 1.2 Scope of License: The license granted to you is a non-transferable license to use the App on any Apple-branded Products that you own or control and as permitted by the Usage Rules set forth in the Apple Media Services Terms and Conditions. 1.3 Maintenance and Support: Hancod Digital Pvt Lmt is solely responsible for providing any maintenance and support services. You acknowledge that Apple has no obligation whatsoever to furnish any maintenance and support services with respect to the App. 1.4 Warranty: Hancod Digital Pvt Lmt is solely responsible for any product warranties. In the event of any failure of the App to conform to any applicable warranty, you may notify Apple, and Apple will refund the purchase price for the App. To the maximum extent permitted by applicable law, Apple will have no other warranty obligation whatsoever. 1.5 Product Claims: You acknowledge that Hancod Digital Pvt Lmt, not Apple, is responsible for addressing any claims relating to the App, including: (i) product liability claims; (ii) any claim that the App fails to conform to any applicable legal or regulatory requirement; and (iii) claims arising under consumer protection or privacy legislation. 1.6 Intellectual Property Rights: In the event of any third-party claim that the App or your possession and use of the App infringes that third party’s intellectual property rights, Hancod Digital Pvt Lmt, not Apple, will be solely responsible for the investigation, defense, settlement, and discharge of any such claim. 1.7 Legal Compliance: You represent and warrant that (i) you are not located in a country subject to a U.S. Government embargo or designated as a “terrorist supporting” country; and (ii) you are not listed on any U.S. Government list of prohibited or restricted parties. 1.8 Developer Contact: Questions or claims should be directed to: Hancod Digital Pvt Lmt, 1st Floor, Sahara Center Complex, opposite Polytech Quarters, Pallippuram, Perinthalmanna, Angadipuram, Kerala 679321. Phone: 88484 56819. 1.9 Third Party Terms: You must comply with applicable third-party terms of agreement when using the App (e.g., your wireless data service agreement). 1.10 Third Party Beneficiary: You acknowledge and agree that Apple, and Apple’s subsidiaries, are third-party beneficiaries of the EULA, and that Apple will have the right to enforce the EULA against you as a third-party beneficiary.
2. ACCOUNT & USAGE 2.1 Account Creation: You must provide accurate information and keep credentials confidential. 2.2 Use of App: Usage is limited to lawful business management. Reverse engineering or tampering is prohibited. 2.3 Account Deletion: You may delete your account at any time. Personal info will be removed, but transaction history will be retained as "inactive" for legal audit purposes.
3. PAYMENTS & SUBSCRIPTIONS 3.1 Payment Terms: Some features require payment. Payments are processed via Apple's In-App Purchase system. 3.2 Auto-Renewal: Duxbe Pro subscriptions (Monthly/Yearly) automatically renew unless auto-renew is turned off at least 24-hours before the end of the current period. Your account will be charged for renewal within 24-hours prior to the end of the current period. You can manage or turn off auto-renew in your Apple ID Account Settings any time after purchase.
4. LIABILITY & GOVERNING LAW 4.1 Liability: We are not responsible for indirect damages. Liability is limited to the amount paid for the App in the last 12 months. 4.2 Governing Law: These terms are governed by the laws of India. Disputes shall be resolved in the courts of India.
