“User profile” refers to a profile posted by a user on the EverEx RTM Service.

Information you provide

By voluntarily creating a user profile on the EverEx RTM Website, you agree to the EverEx RTM Terms of Use, and consent to EverEx RTM’s collection of personal information. To establish Your user profile, EverEx RTM collects your name and email address, and in some cases your clinical discipline.

You may give us information about you by filling in forms on our Website https://www.everex.ai and by corresponding with us by email, phone, mail or otherwise. This includes information you provide when you use the “contact us” section of our site located at https://www.everex.ai, discuss with us the provision of and/or receive services from EverEx RTM, interact with us via our social media accounts (e.g., Linkedin) and when you report a problem with our Service.

You may give us additional information when You continue the use of the site and agree to our Terms of Use in order to use our Services and access our Content. When you assign education courses or patient exercises on the EverEx RTM Website, EverEx RTM may collect data relating to the assignment of and/or completion of courses and/or exercises.

The types of personal information we collect includes, but is not limited to, the following:

Identifying information (e.g., name, address, date of birth)
Contact information (e.g., phone number, email address)
Health information and medical records
Payment and billing information

Much of the information collected by EverEx RTM is necessary for proper functioning of the EverEx RTM Website and use of the EverEx RTM Service. For example, you may not be able to create a user account or reset your password without provision of a valid email address

Additional Information Use

We may use your email for transactional purposes, as well as for promotional purposes. Transactional purposes include confirmation and notification of changes to your account. Promotional purposes include sending you newsletters about new features, special offers, promotional announcements, consumer surveys, and other items concerning our service. During registration at the EverEx RTM Website, you may be signed up to receive promotional email newsletters from EverEx RTM, unless disallowed by your jurisdiction of residence. Email messages may contain code that enables our database to track your usage of the emails to determine whether the email was opened and what links, if any, were clicked. Should you prefer not to receive promotional emails from us, please edit the preferences in your account menu or click unsubscribe at the bottom of any promotional emails.

Non-personally identifiable information may be provided to other parties for marketing, advertising, or other uses.

You have the right at any time to prevent us from contacting you for marketing purposes. You can opt-out of promotional communications by following the unsubscribe instructions provided in each promotional email that we send to you. We may continue to send you administrative emails; for example, periodic updates to our Privacy Policy, even if you indicate that you no longer wish to receive promotional email from us.

Data Breach Protocol

In the event of a data breach, EverEx RTM will adhere to the applicable Federal and/or State data breach regulations of the impacted user(s). For purposes of this policy, a breach is any unauthorized acquisition of computerized data that compromises the security, confidentiality, or integrity of personal information that we maintain.

EverEx RTM takes various security measures—physical, electronic, and procedural—to help defend against the unauthorized access and disclosure of your information. Notifications will be sent via email to all impacted users. Written notice may be sent in addition to email. Depending on where the impacted user lives, they may have a legal right to receive notice of a security breach in writing.

EverEx RTM is not responsible for circumvention of any privacy settings or security measures of the EverEx RTM Service. You understand and acknowledge that, even after removal, copies of personal information on user profiles may remain viewable in cached and archived pages or if other users have copied or stored your personal information.

The EverEx RTM Website might be linked to other apps and websites, including but not limited to Facebook, LinkedIn, or Twitter, in order to better interact with its users and the public. Please be aware that EverEx RTM is not responsible for the privacy policies of those other services. If users provide information directly to services other than EverEx RTM, different rules may apply for the use of personal information.

6. Retention and modification of personal information

You can correct, update, or remove your personal information if it changes or if you no longer want to receive information from us beyond information related to our services. On the EverEx RTM Website you can correct, update, review, or delete information you have submitted by going back to the specific tool and making the desired changes. If you are unable to make the changes on the EverEx RTM Website, you can request EverEx RTM to change, correct, or delete information by contacting us at support@everex.ai. We may not be able to completely remove your personal information from our systems in certain circumstances. For example, we may retain your personal information for legitimate business purposes, if it may be necessary to prevent fraud or future abuse, if required by law, or as retained in our data backup systems or cached or archived pages. All your personal information that we keep will continue to be subject to the terms of this Privacy Policy to which you have previously agreed.

We keep personal information until it is deleted, or until we no longer need it to provide you with the Service. EverEx RTM stores and retains personal information based on the level of sensitivity of this information, and for the period specified by the applicable legal and regulatory requirements. For some healthcare data, your individual provider and/or their organization may require EverEx RTM to retain data based on their individual legal and contractual requirements.

We will not retain personal information for any longer than is necessary to provide the Service for which we receive or collect the personal information, or for legal obligations.

You have the right to withdraw consent to EverEx RTM’s use or processing of your personal information at any time. If you refuse to consent to, opt out of, or withdraw your consent, we may not be able to offer you certain services or benefits.

You may have a right to request access to Your information collected or processed by EverEx RTM. You can request such access by contacting us at support@everex.ai. Upon verification of Your identity, we will make sure to provide you with a copy of the data we process about you.

8. Children’s privacy rights

EverEx RTM does not collect any information from anyone under 18 years of age. Our Services are directed at people who are older than 18 years.
