Pursuant to Art. 13 of the Regulation of the European Parliament and of the Council (EU) 2016/679 of April 27, 2016 on the protection of individuals with regard to the processing of personal data and on the free movement of such data (hereinafter: GDPR) informs that in connection with the conclusion of the insurance contract.

1. The controller of your personal data is We Care Insurance Sp. z o.o. with headquarters in Katowice (40-265), at ul. Murckowska 14A, registered in the Register of Entrepreneurs kept by the Katowice-Wschód District Court in Katowice, 8th Commercial Division of the National Court Register under the KRS number 0000751962, NIP: 954-279-73-53, REGON: 381493361 share capital PLN 5,000 (fully paid-up) (hereinafter: "controller").

Your personal data such as name, surname, e-mail address, date of birth, telephone number, e-mail address, information regarding the concluded insurance contract will be processed for purposes related to the conclusion and execution of the insurance contract with the Insurer indicated on the insurance policy, based on art. 6 (1) b) GDPR, your personal data may be be also processed in connection with the legitimate interest pursued by the data controller, e.g. determination, investigation and defense of claims (Article 6 (1) (f) of the GDPR) as well as in connection with the need to fulfill legal obligations incumbent on the data controller (Article 6 (1) (c) of the GDPR related to the payment of taxes, including the keeping and storage of tax books and documents related to the keeping of tax books and the storage of accounting documents. The legal basis for data processing are then the legal obligations resulting from tax regulations (tax ordinance, act on tax on goods and services, act on accounting).

4. Your personal data may be disclosed to appropriate recipients, in particular to external entities dealing with IT or legal services for the administrator, or institutions authorized to control the administrator's activities or institutions authorized to obtain personal data on the basis of legal provisions.

5. Your personal data will be kept for the period necessary to perform the contract, and after its termination or expiry - for the mandatory period of keeping the documentation, determined by separate regulations.

6. You have the right to access your personal data, rectify it, delete or limit processing, as well as the right to object, request the cessation of processing and the right to transfer data - in the cases and on the terms specified in the provisions of the GDPR.

7. You have the right to lodge a complaint with the President of the Personal Data Protection Office.

8. Providing personal data is a prerequisite for the conclusion and implementation of the insurance contract. If you do not provide your personal data, it may not be possible to implement it.

9. Your personal data will not be subject to automated decision making or profiling.

Zgodnie z art. 13 Rozporządzenia Parlamentu Europejskiego i Rady (UE) 2016/679 z dnia 27 kwietnia 2016 r. w sprawie ochrony osób fizycznych w związku z przetwarzaniem danych osobowych i w sprawie swobodnego przepływu takich danych (dalej: RODO) informuje, iż w związku z zawarciem umowy ubezpieczenia.

1. Administratorem Pana/Pani danych osobowych jest We Care Insurance Sp. z o.o. z siedzibą w Katowicach (40-265), przy ul. Murckowskiej 14A, zarejestrowana w rejestrze przedsiębiorców prowadzonym przez Sąd Rejonowy Katowice-Wschód w Katowicach VIII Wydział Gospodarczy Krajowego Rejestru Sądowego pod numerem KRS 0000751962, NIP: 954-279-73-53, REGON: 381493361 wysokość kapitału zakładowego 5.000 PLN (wpłacony w całości) (dalej: „administrator”).

Pana/Pani dane osobowe takie jak imię, nazwisko, adres email, data urodzenia, numer telefonu, informacje dot. zawartej umowy ubezpieczenia będą przetwarzane w celach związanych z zawarciem i realizacją umowy ubezpieczenia ze wskazanym na polisie ubezpieczeniowym Ubezpieczycielem w oparciu o art. 6 ust.1 lit. b) RODO, Pani/Pana dane osobowe mogą być przetwarzane w związku z uzasadnionym interesem realizowanym przez administratora, np. ustalenie, dochodzenie i obrona roszczeń (art. 6 ust.1 lit. f) RODO) a także w związku z koniecznością wypełnienia obowiązków prawnych ciążących na administratorze (art. 6 ust.1 lit. c) RODO związanych z płaceniem podatków, w tym prowadzeniem i przechowywaniem ksiąg podatkowych i dokumentów związanych z prowadzeniem ksiąg podatkowych oraz przechowywaniem dowodów księgowych. Podstawą prawną przetwarzania danych są wówczas obowiązki prawne wynikające z przepisów podatkowych (ordynacja podatkowa, ustawa o podatku od towarów i usług, ustawa o rachunkowości).

4. Pani/Pana dane osobowe mogą być ujawniane odpowiednim odbiorcom, w szczególności podmiotom zewnętrznym zajmującym się obsługą informatyczną lub prawną administratora albo instytucjom uprawnionym do kontroli działalności administratora lub instytucjom uprawnionym do uzyskania danych osobowych na podstawie przepisów prawa.

5. Pana / Pani dane osobowe będą przechowywane przez okres niezbędny do wykonania umowy, a po jej rozwiązaniu lub wygaśnięciu – przez obowiązkowy okres przechowywania dokumentacji, ustalony odrębnymi przepisami.

6. Przysługuje Panu/Pani prawo dostępu do swoich danych osobowych, ich sprostowania, usunięcia lub ograniczenia przetwarzania a także prawo sprzeciwu, zażądania zaprzestania przetwarzania i prawo przenoszenia danych – w przypadkach i na zasadach określonych w przepisach RODO.

7. Przysługuje Pani/Panu prawo do wniesienia skargi do Prezesa Urzędu Ochrony Danych Osobowych.

8. Podanie danych osobowych jest warunkiem niezbędnym do zawarcia i realizacji umowy ubezpieczenia. W przypadku nie podania danych osobowych może nie być możliwa jej realizacja.

9. Pani/Pana osobowe nie będą podlegać zautomatyzowanemu podejmowaniu decyzji lub profilowaniu.
