State of Colorado Family and Medical Leave Insurance Program
Colorado voters approved the Family and Medical Leave Insurance (FAMLI) program in 2020. The FAMLI program ensures all Colorado workers have access to paid leave to take care of themselves or their family members during life circumstances that necessitate absences from their jobs. Pursuant to the FAMLI law, school districts are permitted to opt-out of this program. In June 2022, Cherry Creek School District Board of Education has voted to opt-out. However, employees may still voluntarily opt into FAMLI benefits by contacting the FAMLI Division at the Colorado Department of Labor and Employment.
Employees can opt into FAMLI and apply for leave benefits to help them get through the following circumstances:
Caring for a new child during the first year after the birth, adoption, or foster care placement of that child.
Caring for a family member with a serious health condition.
Caring for your own serious health condition.
Making arrangements for a family member's military deployment.
Obtaining safe housing, care, and/or legal assistance in response to intimate partner violence, stalking, sexual assault, or sexual abuse.
If you opt into FAMLI and receive payment, please know the following:
You must be on an approved, UNPAID leave of absence with the District while receiving FAMLI benefits
You will be charged by the State to participate
You will NOT receive PERA credit while you are on unpaid leave of absence with the District
If you are not on FMLA or another approved leave with the District, your health benefits may terminate.
