COBRA is the Consolidated Omnibus Budget Reconciliation Act and it gives workers and their families who lose their health benefits the right to choose to continue group health benefits provided by their group health plan for limited periods of time under certain circumstances such as voluntary or involuntary job loss, reduction in the hours worked, transition between jobs, death, divorce, and other life events. Qualified individuals are required to pay the entire premium for coverage which is 102% of the cost of the plan.
COBRA requires continuation of coverage to be offered to covered employees, their spouses, former spouses, and dependent children when group health coverage would otherwise be lost due to certain specific events. COBRA continuation coverage is often more expensive than the amount that active employees are required to pay for group health coverage because the employer usually pays part of the cost of the group health coverage. With COBRA, the entire cost plus an administration fee may be charged to the previous employee.
Continuation coverage is the same coverage that the plan gives to other participants or beneficiaries who aren't getting continuation coverage. Each qualified beneficiary who elects COBRA continuation coverage will have the same rights under the plan as other participants or beneficiaries covered under the plan.
Cherry Creek School District provides all employees and their families with notices that explain their COBRA rights. Your COBRA rights are also described in the plan's Summary Plan Description (SPD). The District gives each employee and spouse who become covered under the plan a general notice that will describe COBRA rights, within the first 90 days of coverage.
