These Terms and Conditions ("Terms") apply to the Rejecto app (the "Application") for mobile devices, developed and operated by Better Apps Better You LTD (the "Service Provider"), a company registered in the United Kingdom. By downloading, installing, accessing, or using the Application, you agree to be bound by these Terms.

1. License and Restrictions

The Service Provider grants you a limited, non-exclusive, non-transferable, revocable license to use the Application for personal, non-commercial purposes. You may not:

Copy, reproduce, modify, or create derivative works from the Application or any part of it.
Disassemble, decompile, reverse-engineer, or otherwise attempt to extract the source code of the Application.
Use the Application for any unlawful, harmful, or abusive purpose.
Exploit any part of the Application for commercial gain.

All intellectual property rights in and to the Application and its content remain the sole property of the Service Provider.

2. Modifications and Charges

The Service Provider reserves the right to modify, suspend, or discontinue the Application (or any part or content thereof) at any time without notice. We may introduce new features or paid services, and any such changes will be clearly communicated in advance.

3. User-Generated Content (UGC)

By submitting, uploading, posting, or sharing any content through the Application, including but not limited to photos, text, videos, audio, and retrospections ("User Content"), you grant the Service Provider a worldwide, perpetual, irrevocable, royalty-free, transferable, sublicensable license to use, reproduce, modify, adapt, publish, translate, distribute, publicly display, and otherwise exploit such User Content for any purpose, including promotional and commercial uses, in any media or platform.

You acknowledge and agree that:

You retain ownership of your User Content, but grant us extensive rights to use it.
You waive any moral rights or rights of attribution to the extent legally permitted.
The Service Provider has no obligation to monitor, review, or remove any User Content, but reserves the right to do so at its sole discretion.

Do not upload content unless you have the necessary rights and permissions.

4. Data Storage and Security

The Application collects, stores, and processes personal data in accordance with our Privacy Policy. You are solely responsible for securing your device and maintaining the confidentiality of your login credentials and other personal data.

The Service Provider is not liable for any loss or damage arising from unauthorized access due to your failure to protect your device.

5. Third-Party Services

The Application incorporates third-party services that are governed by their own terms and privacy policies. These include but are not limited to:

Apple App Store
Google Play Services
AdMob
Google Analytics for Firebase
Firebase Crashlytics
RevenueCat
Algolia

We are not responsible for the actions or content of these third parties.

6. Internet Connectivity

Some features of the Application require an active internet connection. You are responsible for any data usage or fees charged by your mobile network provider, including roaming charges if applicable.

7. User Responsibilities

You are responsible for:

Keeping your device charged and functional.
Maintaining internet access where required.
Using the Application in a lawful and respectful manner.

The Service Provider is not responsible for any inconvenience, loss, or damage caused by your failure to fulfill these responsibilities.

8. Disclaimers and Limitation of Liability

The Application is provided "as is" and "as available" without warranties of any kind. To the fullest extent permitted by law, the Service Provider disclaims all express and implied warranties, including fitness for a particular purpose, merchantability, accuracy, or non-infringement.

We are not liable for any direct, indirect, incidental, consequential, or punitive damages, including but not limited to loss of data, loss of profit, or business interruption, arising from your use of the Application.

9. Updates and Termination

We may update or modify the Application at any time. You agree to install such updates to continue using the Application. We do not guarantee continued compatibility with all operating systems or devices.

We reserve the right to terminate or suspend your access to the Application at any time without prior notice. Upon termination, you must delete the Application from your device.

10. Changes to These Terms

We may revise these Terms from time to time. Any changes will be posted within the Application or on our website. Your continued use of the Application after such updates constitutes your acceptance of the revised Terms.

These Terms are effective as of 2024-06-18.

11. Governing Law and Dispute Resolution

These Terms are governed by the laws of England and Wales. Any disputes or claims related to these Terms shall be subject to the exclusive jurisdiction of the courts of England and Wales.
