1. Acceptance of Terms

Welcome to AR Drawing: Easy Sketch, Trace ("App"), developed and published by APEX TECH GLOBAL LIMITED ("APEX TECH GLOBAL", "Company", "we", "our", or "us").

These Terms of Use ("Terms") constitute a legally binding agreement between you and APEX TECH GLOBAL LIMITED governing your access to and use of the App and its related services.

By downloading, installing, accessing, or using the App, you acknowledge that you have read, understood, and agree to be bound by these Terms, together with our Privacy Policy.

If you do not agree to these Terms, you must not access or use the App.

If you use the App on behalf of a company or other legal entity, you represent and warrant that you have the authority to bind that entity to these Terms.

• image tracing using the Android System Photo Picker;

• additional Premium features available through subscription;

• advertisements provided by trusted third-party advertising partners, where applicable.

Certain features, Premium content, subscription offerings, advertisements, or services may vary depending on your device, geographic region, platform, or future updates.

The App is intended solely as a creative drawing and educational tool.

The App is not intended to provide professional artistic, educational, legal, financial, medical, or other professional advice.

4. License to Use

Subject to your compliance with these Terms, APEX TECH GLOBAL LIMITED grants you a limited, personal, non-exclusive, non-transferable, non-sublicensable, and revocable license to install and use the App on compatible devices solely for your personal and non-commercial purposes.

This license does not transfer ownership of the App or any intellectual property rights.

Except as expressly granted in these Terms, all rights remain reserved by APEX TECH GLOBAL LIMITED.

You may not sublicense, distribute, lease, rent, sell, or otherwise make the App available to any third party without our prior written permission.

5. Premium Subscription

Certain features of the App require an active Premium Subscription.

Available subscription plans may include:

• Weekly Plan;

• Monthly Plan;

• Yearly Plan.

Promotional free trial periods may be offered from time to time.

Premium features, subscription pricing, promotional offers, and available plans may change as the App evolves.

We reserve the right to modify Premium features, subscription plans, pricing, or promotional offers where permitted by applicable law.

6. Payments

All purchases and subscription payments are securely processed through Google Play Billing.

We do not receive, process, or store:

• payment card numbers;

• bank account information;

• payment passwords;

• payment security codes.

Google Play is responsible for:

• payment processing;

• recurring billing;

• subscription renewals;

• purchase verification;

• cancellations;

• refunds where applicable.

Your purchases are subject to Google's applicable Terms of Service and payment policies.

7. Free Trial and Auto-Renewal

Where offered, your subscription may begin with a free trial.

Unless cancelled before the applicable renewal date, your subscription will automatically renew through your Google Play account.

To avoid future charges, you must cancel your subscription through your Google Play account before the renewal date.

Subscription management, cancellation requests, and refund requests are handled according to Google's applicable policies.

Any unused portion of a free trial may be forfeited upon the purchase of a subscription where permitted by applicable law.

8. User Responsibilities

You are responsible for using the App in a lawful, respectful, and responsible manner.

By accessing or using the App, you agree that you will:

• use the App only for lawful purposes;

• comply with all applicable local, national, and international laws and regulations;

• respect the intellectual property, privacy, and other legal rights of third parties;

• use only content that you own or have the legal right to use;

• maintain the security of your device and your Google Play account;

• use the App in accordance with these Terms and our Privacy Policy.

You acknowledge that you are solely responsible for all activities performed using the App.

You are also responsible for ensuring that any images selected or imported into the App do not infringe any copyright, trademark, patent, privacy right, publicity right, or any other legal right of a third party.

9. User Content

The App may allow you to select images from your device using the Android System Photo Picker solely for drawing, tracing, and creative purposes.

You retain ownership of any images or other content you choose to use within the App.

You represent and warrant that:

• you own the content you use; or

• you have obtained all necessary rights, permissions, or licenses to use such content.

You agree that you will not use the App with any content that:

• infringes copyrights, trademarks, patents, or other intellectual property rights;

• violates privacy or publicity rights;

• contains unlawful, defamatory, obscene, abusive, hateful, discriminatory, or offensive material;

• violates any applicable law or regulation.

APEX TECH GLOBAL LIMITED does not claim ownership of your selected images.

As described in our Privacy Policy:

• images selected through the Android System Photo Picker are processed locally on your device;

• images are not uploaded to our servers;

• images are not permanently stored by us;

• images remain under your control.

You remain solely responsible for all content that you choose to use with the App.

10. Intellectual Property

The App and all related intellectual property are owned by or licensed to APEX TECH GLOBAL LIMITED.

This includes, without limitation:

• application design;

• source code;

• software;

• user interface;

• graphics;

• icons;

• logos;

• trademarks;

• illustrations;

• animations;

• built-in drawing templates;

• text;

• documentation;

• branding;

• visual assets;

• application architecture.

These materials are protected by applicable copyright, trademark, trade secret, and other intellectual property laws.

Except as expressly permitted by these Terms, you may not:

• copy;

• modify;

• reproduce;

• distribute;

• publish;

• transmit;

• sublicense;

• sell;

• lease;

• rent;

• reverse engineer;

• decompile;

• disassemble;

• create derivative works from;

• exploit

any part of the App without our prior written consent.

Nothing in these Terms transfers ownership of any intellectual property rights to you.

11. Third-Party Services

The App relies on trusted third-party service providers to deliver certain functionality and improve the overall user experience.

These providers operate independently and maintain their own Terms of Service and Privacy Policies.

• reverse engineer, decompile, disassemble, or otherwise attempt to discover the source code of the App;

• bypass, disable, or interfere with security-related features;

• use bots, automated scripts, crawlers, scrapers, or similar technologies to access the App;

• misuse subscription features, payment systems, or advertising systems;

• create or distribute unlawful, harmful, misleading, or infringing content using the App;

• infringe the copyrights, trademarks, patents, or other intellectual property rights of APEX TECH GLOBAL LIMITED or any third party;

• impersonate another person or entity;

• interfere with another user's enjoyment or use of the App.

We reserve the right to investigate suspected violations of these Terms and to suspend or terminate access to the App where permitted by applicable law.

13. Disclaimer of Warranties

The App is provided on an "AS IS" and "AS AVAILABLE" basis.

To the maximum extent permitted by applicable law, APEX TECH GLOBAL LIMITED expressly disclaims all warranties and representations of any kind, whether express, implied, statutory, or otherwise, including but not limited to:

• merchantability;

• fitness for a particular purpose;

• non-infringement;

• uninterrupted availability;

• accuracy;

• reliability;

• compatibility;

• security;

• availability of Premium features;

• availability of advertisements or third-party services.

The App is intended solely as a creative drawing and sketching tool.

We do not guarantee that:

• the App will operate without interruption or error;

• every defect or software issue will be corrected immediately;

• the App will meet every user's expectations or requirements;

• drawings or creative works produced using the App will achieve any particular artistic, educational, commercial, or professional outcome.

Your use of the App is entirely at your own risk.

14. Limitation of Liability

To the fullest extent permitted by applicable law, APEX TECH GLOBAL LIMITED, its directors, officers, employees, affiliates, licensors, contractors, partners, and suppliers shall not be liable for any indirect, incidental, consequential, exemplary, special, or punitive damages arising out of or relating to:

• your access to or use of the App;

• your inability to access or use the App;

• loss of data;

• interruption of service;

• device malfunction;

• subscription or payment issues handled by Google Play;

• advertising services provided by third-party advertising partners;

• failures or interruptions of third-party services;

• unauthorized access beyond our reasonable control;

• any actions or content of third parties.

Where liability cannot be excluded under applicable law, our total aggregate liability shall not exceed the amount you paid for Premium services during the twelve (12) months immediately preceding the event giving rise to the claim.

Nothing in these Terms excludes or limits liability where such exclusion or limitation is prohibited by applicable law.

15. Indemnification

You agree to indemnify, defend, and hold harmless APEX TECH GLOBAL LIMITED, its affiliates, officers, directors, employees, contractors, licensors, and partners from and against any claims, liabilities, damages, losses, costs, expenses, or legal fees arising out of or relating to:

• your use of the App;

• your breach of these Terms;

• your violation of applicable laws or regulations;

• your infringement of any intellectual property, privacy, publicity, or other rights of any third party;

• any content you choose to use with the App.

This obligation survives the termination of these Terms.

16. Termination

We reserve the right to suspend, restrict, or terminate your access to the App, with or without prior notice, where permitted by applicable law, including if:

• you violate these Terms;

• your use of the App creates legal, security, or operational risks;

• required by law;

• necessary to protect the rights, safety, property, or legitimate interests of APEX TECH GLOBAL LIMITED, our users, or third parties.

Upon termination:

• your license to use the App immediately ends;

• you must stop using the App;

These surviving provisions include, without limitation:

• Intellectual Property;

• Disclaimer of Warranties;

• Limitation of Liability;

• Indemnification;

• Governing Law;

• any other provisions that by their nature should survive termination.

17. Governing Law and Jurisdiction

These Terms shall be governed by and construed in accordance with the laws of the Hong Kong Special Administrative Region, without regard to its conflict of law principles.

Any dispute arising out of or relating to these Terms or your use of the App shall be subject to the exclusive jurisdiction of the competent courts located in Hong Kong, unless otherwise required by applicable law.

18. Changes to These Terms

We may revise these Terms from time to time to reflect:

• improvements to the App;

• new features or services;

• changes to subscription offerings;

• updates to advertising services;

• changes in applicable laws or regulations;

• security enhancements;

• changes in our business operations.

When material changes are made, we will update the "Last Updated" date shown at the beginning of these Terms.

Your continued use of the App after revised Terms become effective constitutes your acceptance of the updated Terms.

20. General Provisions

These Terms, together with our Privacy Policy, constitute the entire agreement between you and APEX TECH GLOBAL LIMITED regarding your use of AR Drawing: Easy Sketch, Trace.

If any provision of these Terms is determined to be invalid, illegal, or unenforceable by a court of competent jurisdiction, the remaining provisions shall remain in full force and effect.

Our failure to enforce any provision of these Terms shall not constitute a waiver of that provision or any other rights.

You may not assign or transfer your rights or obligations under these Terms without our prior written consent.

We may assign or transfer our rights and obligations under these Terms in connection with a merger, acquisition, corporate restructuring, or sale of assets.

In the event of any inconsistency between translated versions of these Terms and the English version, the English version shall prevail to the fullest extent permitted by applicable law.
