Constitutional Law for a Changing America Archive

This page is devoted to helping students delve deeper into how the Court decides cases it hears. It contains archival materials associated with various aspects of the justices' decision making process in this case -- from the docket sheet where Justice William J. Brennan recorded his colleagues' votes, to Justice Harry Blackmun's oral argument notes, to Brennan's and Justice William O. Douglas' conference notes, to the memoranda the justices sent to each other as the final opinion was crafted. Where possible we annotate the materials so the student can tie them directly to the opinion in Epstein and Walker (Rights and Liberties 9th Edition).
