    Persuasive Writing and Public Speaking Activity

    Directions: It is time to prepare for court tomorrow. You will be split up into teams of attorneys, jurors, and witnesses. Please read this real case and choose the side you think you want to represent tomorrow. It is your job to make the strongest argument based on the facts of the story to convince the jury that “your side” has the strongest case.

    Court Case: The Turkey that Got Sick

    Hearing Held: T.B.D. (Opening Arguments)

    The Case……In 1823, maple syrup became the cause of a court action between two New York neighbors. Ole McDonald had tapped his maple trees for maple syrup and poured it in a bucket. He quit for the day and, on his return, found his neighbor’s turkey had drunk so much of his maple syrup that it had become sick and could no longer make eggs. The neighbor sued, saying that the syrup had been left uncovered in a bucket and was impossible for the turkey to pass up. (in law this is called an “attractive nuisance”) Ole McDonald counter argued that the turkey was on his property and had no right to be on his property. (in law this is called trespassing)
