Rights of Parents and Students Under Section 504


The attached brochure, “Rights of Parents and Students Under Section 504, Subpart D and Hawaii Law and Regulations”dated April 2017, is the most current version of the brochure.  Please note the following:


· Supplies of the brochure will be printed and distributed to schools by the Reprographic Section by early July.  

· If additional brochures are needed for the current school year, schools are requested to reproduce these copies.

Section 504, Subpart D and Hawaii Law and Regulations, Hawaii Administrative Rules, Chapter 61:  


· Prohibits discrimination on the basis of disability in any school (public or private) that receives direct or indirect federal funding.

· Provides students with disability equal educational opportunity and access to the educational opportunities afforded non-disabled peers.


All schools are reminded of their legal obligation to inform parent(s)/legal guardian(s) of their rights as part of the identification, evaluation, and educational placement of these students and the provision of Free Appropriate Public Education (FAPE).  The brochure should be given and explained to parent(s)/legal guardian(s):


· Upon initial referral for evaluation under Section 504.

· Upon giving the parent(s)/legal guardian(s) the Prior Written Notice for any related purpose.

· Upon receipt of a request for due process.

· Upon request.

This brochure informs students and parent(s)/legal guardian(s) of the rights of public school students with disabilities to receive an equal educational opportunity.  In order to fulfill the DOE’s legal obligation to notify students and parent(s)/legal guardian(s) of their civil rights under Section 504, please be sure to give this brochure to:

· Every student at the beginning of school year 2017-2018.

· Any student who transfers to your school from a local, non-DOE school, or from an out-of-state school during the school year.
