Client Approval

Work will be carried out as requested in a 'Quotation' or on a 'Do & Charge Bases' as specified by the client.

Provides authorise access to the site to carry out requested works and accept the resulting charges (Quotation or 'Do & Charge') and in doing so accepts the Terms and Conditions in this document.


K & J Burns Electrical & Refrigeration shall complete all works in a professional and competent manner to AS/NZS and Artick standards.

Payment Methods

-Cash, Cheques, Money Orders, Direct Deposits and Credit Cards (MasterCard, VISA & American Express) are accepted payment methods.

-Charges which apply to credit card transactions;

VISA / MasterCard 1.9% (Inc GST) per transaction

AMEX 2.6% (Inc GST)

To process credit card payments we utilise the Eway Payment Portal & Stripe Payment Portal.


Minor Work

Is defined by any work $20,000.00 or less.

Casual customers - All minor works requires credit card details provided at the time of booking as security and to process any applicable upfront payments/deposits for a job. When the job is completed and invoiced the balance owing is processed on the credit card (payment terms C.O.D, upon invoice), and the invoice is generally emailed with a receipt (if an email address has been provided). We do extended trading terms to 7 days or accept alternative forms of payment other than a credit card from casual customers when arranged prior to commencing work and is agreed upon by both parties. Under these circumstances, credit card details are still taken as security and are only processed if payment is not made with the alternative payment arrangement period of 7 days.

The below services require an upfront partial payment or payment in full at time of booking for all 'Causal Customers';

1. Appliances/ Air-Conditioner fault finding includes a minimum upfront fee (costs depend on which package chosen). Any excess work is charged out in 15 minutes blocks (for any appliance not covered under manufacturer's warranty)

2. Appliance / Air-Conditioner repairs, payment in full at time of order approval (for any appliance not covered under manufacturer's warranty). Parts once ordered and or installed are non-refundable & non-returnable.

3. Air Conditioner Service 9Clean) payment in full at time of order approval

4. Air Conditioner Unit Sales payment in full at time of order approval (Capital equipment)

5. All ad-hoc minor works include a minimum charge of 1-Hours Labour. Any excess work is charge out in 15-minute blocks.

6. Approved quotes require a 50% deposit (all quotes that include capital equipment E.g. Air Conditioners, require the unit to be paid in full plus 50% on the installation

7. After hours emergency breakdown works include a minimum charge of 4 Hours Labour at After Hours Labour Rate

8. Yacht repairs and fault finding includes a minimum upfront fee which includes the first 1-Hour labour only. Any excess work is charge out in 15-minute blocks

9. Caravan repairs and fault finding includes a minimum upfront fee which includes the first 1-Hour labour only. Any excess work is charge out in 15-minute blocks

Account customersFor payment terms to be 30 days an application for an account must be completed and approved. In accepting the above quotation or work, terms are 7 days net unless a client has an approved 30-day account.

If the customer has any queries or concerns about the work carried out or their invoice K & J Burns Electrical & Refrigeration we will contact the customer within 48 hours from them reporting their query to us to sort out the matter (time frame excluding weekends and public holidays).

Appliances & Air Conditioners (AC) - For electrical appliances and air conditioners (not covered under manufacturer's warranty), please note the following:

A. The upfront minimum fee, 'Basic Pricing Package' is only for  1 Hour labour troubleshooting Only. Any additional time fault finding needed will be charged out in 15min blocks of time at $28ea

Any additional units or work will be charged out in 15min blocks of labour at $28ea after this point for either package chosen. Payment terms C.O.D for additional work, upon invoice as stated in Terms & Conditions.

B. If the appliance/air conditioner requires parts to be replaced we will advise you of the cost of the parts and labour to carry out repairs before proceeding with replacement. This is so you can assess if it is more beneficial for you to repair or replace the appliance. Please note if you wish to replace the part(s) to repair the appliance/air-conditioner we require payment before proceeding. Parts once ordered and or installed are non-refundable & non-returnable.

C. Please note that with appliances & air conditioners it is possible that when the initial fault found are repaired / part replaced that a flow on fault code (secondary fault) may appear. All care will be taken but we are not able to prevent/detect this in advance. We provide this information to assist in your decision to repair or replace the appliance.

D. Fault finding for an additional appliance and/or AC unit while on the site will only incur an additional reduced charge for every additional appliance item at 15min blocks of time at $28ea block.

F. Quote prices for appliances/air conditioners are based on that the unit is ready for the technician to commence work and there are no obstacles or delays. Any of the below examples will incur additional costs.

G. If a client submits a claim under manufacturer's warranty and the manufacturer rejects the claim the client is responsible and liable to pay the cost of work carried out.

H. Some items E.g. Appliances are located or installed in a manner that may require a 2nd tradesmen to attend site to assist with OH&S requirements or to possibly prevent damage occurring to your property. The additional tradesperson will be an additional charge. Alternatively, you can remove the item yourself to prevent incurring any additional cost.

I. All care will be taken when moving Items / Appliances, though in some situations items are installed (built in, silicone or of a large size -not exhaustive)  in a manner that damage to property cannot be prevented. Under these situations, we can not be held accountable or liable for such repairs. Where possible the tradesmen will notify before proceeding such work.

i. No delays accessing the site/unit due to customer E.g Customer running late

ii. Washing Machine and Disher Washer is empty

iii. Air Conditioner is clear of any obstacles in front of/underneath the indoor unit. A clearance perimeter of 1 to 1.5 meters is required for a ladder. An example of obstacles include beds, Televisions, Wall Cabinets, Boxes etc.

iv. Air Conditioner outdoors can be accessed by a technician standing on a standard size ladder. This does not apply to a building that is multi-story or harnesses are required.

All General Adhoc & After Hours Emergency Breakdown Work - Is charged out as follows (if applicable);

1. Minimum upfront charge (deposit) - Adhoc work 1-hour labour or Emergency After hours 4-hours labour

2. All additional labour required charged out in 15 minutes blocks

3. Parts, Hire Equipment / Subcontracted Services

4. Safety and Compliance Forms as required by regulatory bodies

5. Credit card charge  

6. Administration fee

7. Plus GST

Progress payments will be lodged periodically (generally at the end of each month) if a project is to be completed over an extended period.

Major Works

Is defined by any work $20,000.00 or more.

  • All works by K & J Burns Electrical & Refrigeration a 20% deposit will apply prior to commencing work on capital equipment.

  • Progress payments will be lodged periodically (generally at the end of each month) due for payment as per trading terms or contract terms (if applicable).

  • The balance of payment is due in full 7 days from work completion or unless stated otherwise on quotation or invoice. For payment terms to be 30 days and application for the account must be completed and approved.

Overdue Payments

Interest is chargeable on overdue accounts at 20% per annum accrued daily. The client is responsible for any bank fees associated with dishonored cheques, debt collection or legal costs incurred collecting overdue payments.


Ownership of materials transfers to the client once all outstanding monies are received in full. Prior to this, ownership of all materials remains the property of K & J Burns Electrical & Refrigeration which shall have the right to remove without liability for trespass or damage in the event the client defaults on these terms or becomes bankrupt or insolvent.

Site Identification

The client shall be responsible for correctly identifying the site and its boundaries. K & J Burns Electrical & Refrigeration may position a temporary sign on the street boundary.


K & J Burns Electrical & Refrigeration offer twelve-month service warranty. Any defects should be notified immediately for rectifying. Warranty does not include situations of misuse, modification, lack of maintenance, lack of care, or loss caused by factors beyond our control. Once parts are installed on site liability becomes the responsibility of the client. Warranty is limited to parts and labour. Labour may be charged to rectify faulty equipment not covered under warranty as explained above due to situations or factors outside of our control. An example of this is where the manufacturer only covers the replacement of the faulty item or part in the item and not the labour, the client is to pay any additional costs such as labour and or additional materials required to rectify the fault item and or part. Manufacturer’s warranty will apply but varies between different parts depending on the materials and the manufacturer (manufacturer’s warranty).

Out of Scope Works

The quoted value is a fixed cost; no work beyond the scope of this quotation will be undertaken without the approval of the client. Any additional work and or items not listed in the quotation will incur an additional cost which is not included in this quotation. This may also apply to any variation to the quoted works noted above.

Order / Job Cancellation

In the event that a client cancels an order, materials and labour costs incurred up to that date (which may precede on-site work as purchasing of materials and project management begins when the job is scheduled/approved) shall be chargeable to the client. Ownership of these materials transfers to the client when full payment is received. The deposit is non-refundable. This clause does not void any right or entitlement under the Australian Consumer Law (ACL).


A quotation is valid for a period of 30 days from the date of the quotation unless stated otherwise in our quotation.

Trading Terms

K&J Burns Electrical and Refrigeration trading terms are C.O.D once invoiced. If arranged prior to work commencing, payment terms can be extended to 7 days from date of invoice and must be paid in full without retention or discount. K&J Burns Electrical & Refrigeration may make progress claims against the Project / Works on a monthly basis.

For payment terms to be 30 days an account application must be completed in full by the client. If the application is approved a written notification will be issued by our office.

Project Details

The Project is defined in the documentation referenced in this quotation. Any intellectual property supplied by K&J Burns Electrical & Refrigeration remains the property of K&J Burns Electrical & Refrigeration.


K&J Burns Electrical & Refrigeration will provide Public Liability Insurance with respect to the Project / Works. K&J Burns Electrical & Refrigeration will provide Workers Compensation Insurance for its employees involved in the Project / Works.


K&J Burns Electrical & Refrigeration shall not be liable for any consequential damages, including, but not limited to, loss of profits or business. If liquidated damages are applicable to the Project / Works due to late completion, these claims shall be capped at 5% of the K&J Burns Electrical & Refrigeration contract sum. For liquidation damages to apply completion dates and a schedule of works for the proposed project must be provide by the head contractor at the beginning of the project, and both parties must agree upon the timeframes and schedule of work before work is commenced. This clause does not void any right or entitlement under the Australian Consumer Law (ACL).


K&J Burns Electrical & Refrigeration reserves the right to request an extension of time or claim costs if the Project / Works are delayed by factors outside of our control.


Once and item E.g. Appliance is finished and ready for collection our quote has been sent for repair we will contact you 4 times and after 4 weeks of last point of contact if the item is not collected from K&J Burns Electrical Pty Ltd have the right to dispose of the with no dispute or repercussion.


Any change to the scope of the Project / Works shall be deemed a variation and K&J Burns Electrical & Refrigeration reserves the right to claim a cost variation and / or an extension of time to complete the works.

Site access

Our quotation is based upon K&J Burns Electrical & Refrigeration having free and uninterrupted access to the site and on being of a continuous nature. Should K&J Burns Electrical & Refrigeration be forced to leave / return to site, additional costs may be applicable. No allowance has been made for lifting equipment unless otherwise stated in our quotation.

Force Majeure

K&J Burns Electrical & Refrigeration cannot be liable for any failure to complete the tasks defined in this quotation caused by any of the following events;

• Acts of God

• Industrial disturbance – Strike, Work to Rule, Ban, Embargo

• Act of Violence – riot, war, insurrection, vandalism, sabotage, national emergency, piracy, hijack, act of terrorism

• Act of Government – legislation, acts, regulations

• Accidents

• Transportation Delays

• Delays in obtaining resources

• Default by other Organisations or Contractors
