This profiles covers Water & Latex based paints that are unused or out of specification.  


Generator Knowledge 
  1. Generators can generally use the knowledge clause in RCRA to determine that these paints are not ignitable 
  2. Generators can generally use the knowledge clause in RCRA to determine that these paints are not corrosive 
  3. Generators can generally use the knowledge clause in RCRA to determine that these paints are not reactive 
  4. Generators can generally use the knowledge clause in RCRA to determine that these paints do not contain regulated levels of pesticides
  5. Generators can generally use the knowledge clause in RCRA to determine that these paints are not a a K, U, or P listed waste.  Paint is not listed on the U or P RCRA List
  6. Generators can generally use the knowledge clause in RCRA to determine that these paints F listed solvents for the following reasons:
    • Paints are a virgin product
    • The generator has consolidated only latex and water based paints (no solvents) into the mixture

Common Analytical Parameters for this Waste Stream
  • Generators should use testing & analysis to determine if the paints have leachable concentrations of metals (DOO4 thru D011) or organic constituents (D012 thru D043) excluding pesticides and herbicides.  
  • ENSAT recommends that a Flash point to confirm the paints are not ignitable.  

Do and Don't
  • 1 and 5 gallon paint cans can be consolidated into 55 gallon drums without triggering a RCRA treatment activity.  
  • Virgin and spent solvents are not paint and should not be consolidated with paints when consolidating small containers. 
  • The empty small paint cans can be recycled or disposed of as solid waste.
  • Oil based paints should be containerized separately.  A small amount of solvent based paint can turn the whole drum hazardous. 
  • Water based paint are likely to be solidified & landfilled.  Generators can put the empty containers in the drum with out incurring surcharges. 
  • The full cans can be packaged in 55 gallon drums or other authorized containers.  the container can be filled with other water and latex paint liquid  because this material is going to be shredded, solidified and landfilled.
