The state wide deadline for requesting absentee or early mail ballots by mail for the 2024 General Election has passed.

Attention Military, Federal, and Overseas (UOCAVA) Voters: we had to make a routine formatting correction to our civilian absentee ballots yesterday (9/23/24). This correction caused emails to absentee voters who have requested their ballots by email to be resent. If you received a second email, it is a legitimate email, but you can disregard it.

THERE IS NO CHANGE TO YOUR BALLOT. You can print your ballot from either email link, both ballots are identical. Please follow the instructions and only return one ballot to us.

Attention Germantown Voters: due to construction, your poll site has been temporarily changed to the Germantown Town Hall located at 50 Palatine Park Rd, Germantown, NY 12526, until further notice.

ABSENTEE VOTING CHANGES FROM 2022 THAT REMAIN IN EFFECT

In 2022 a law was enacted by the State of New York that is a major change for voters who may want to vote by absentee ballot.

A voter who has been issued* an absentee ballot MAY NOT CAST A BALLOT ON THE VOTING MACHINE, either at Early Voting or on Election Day.

( * Technically, it is the issuing of the absentee ballot by the Board of Elections to the voter that bars the voter from voting on the machine, but after ballots are printed--in mid-May for the Primary--ballots will be issued promptly upon receipt of the application, so submitting the absentee application will effectively bar the voter from voting on the machine.)

A voter who has been issued an absentee ballot IS permitted to vote by AFFIDAVIT ballot at Early Voting or on Election Day.

This is the case regardless of whether the voter actually returns the absentee ballot. It is the ISSUING of the absentee ballot that triggers this restriction, not the return of the absentee ballot itself.

The voter’s affidavit ballot will be counted if the Board of Elections has not received an absentee ballot from the voter and the voter is otherwise qualified. If, at the time the Board reviews affidavit ballots, the Board of Elections has received both an affidavit ballot and an absentee ballot from the voter, the absentee ballot will be counted and the affidavit ballot will not be.

In summary, once you submit an APPLICATION for an absentee ballot, you should plan to vote either by ABSENTEE ballot or by AFFIDAVIT ballot (if you go to Early Voting or to your Election Day polling place). Once an absentee ballot is issued to you, you may not cast your ballot on the voting machine.

APPLICATION DEADLINES FOR ABSENTEE BALLOTS ARE EARLIER: ANOTHER IMPORTANT CHANGE WAS ENACTED IN 2021 AND REMAINS IN EFFECT. Applications for absentee ballots that are submitted to the Board of Elections by mail or via the State portal must be received by the Board of Elections at least fifteen (15) days ahead of the election.

After this 15-day cutoff, only applications for absentee ballots that are PERSONALLY delivered to the Board of Elections can be accepted. Personally delivered applications for absentee ballots may be brought to the Board of Elections as late as the day before the election. The Board, upon such personal delivery of the application, will then give the ballot to the voter or to the designated agent, but will not mail out a ballot.

EXTREMELY IMPORTANT NOTICE REGARDING ABSENTEE VOTING at the 2021 General Election

Four important changes to Election Law were enacted this year, which apply to the November 2, 2021 General Election:

1). The most significant new law requires that an application or request for an absentee ballot that is TO BE MAILED TO THE VOTER must be RECEIVED BY THE BOARD OF ELECTIONS AT LEAST FIFTEEN (15) DAYS PRIOR TO THE ELECTION. Absentee ballots will not be MAILED to voters unless the application for the ballot is RECEIVED by the Board of Elections by October 18, 2021. This is a major change. Until now, such an application had to be MAILED by the voter at least seven (7) days prior to the election. Importantly, an absentee ballot application that requests that the ballot be GIVEN to the voter or to the voter’s designated agent at the Board of Elections can still be received by the Board as late as the day before the election. The reason for this change is that the old deadline did not work with actual mail delivery time frames. So, if voters want absentee ballots MAILED to them, they need to get their applications in by October 18. (Chapter 273; A5783/S264)

2). Voters can again request an absentee ballot via the State Board ONLINE PORTAL or by submitting an ELECTRONIC REQUEST VIA EMAIL. (Portal or email requests are subject to #1, above.) This law is good for 2021 only and expires at the end of this year. (Chapter 249; A6046/S6379)

3). Again, for the November 2021 General Election, the risk of exposure to Covid is a valid reason for obtaining an absentee ballot. A voter desiring to vote by absentee ballot due to Covid concerns should select "temporary illness" as the reason given on the application for the ballot.  (Election Law § 8-400[1.][b]. This was allowed by Executive Order in 2020)

4). The last day for a voter to POSTMARK an absentee BALLOT mailed to the Board of Elections is Election Day. This makes permanent the alteration of the law that has recently been in effect. (Chapter 250; A6047-A/S6429)
