Approach to Providing Unbundled Legal Services:
In many circumstances, people are well able to understand and deal with their legal issues on their own. Everyone needs resources, though, and everyone should have access to expertise and assistance if it becomes necessary. If lawyers maintain an all or nothing retainer policy in that they will only take on a file if they have control over every aspect of the file, many people will be priced out of the advise that they desperately need. I want to provide legal advise and services that suit the specific needs, abilities and budget that each client has.
Mediation: I have family mediation training. I have acted as counsel in 11-15 mediations in the last 5 years. I do not act as mediator.
Approach to Supporting Clients in Mediation:
The legal issues raised in mediation are the same as would be raised in court. Clients need to understand the law in order to understand how realistic their expectations are going into mediation. I am able to help prepare a client to go into a mediation fully understanding what will be negotiated. I can also help a client understand the dynamics of mediation, the difference between mediation and what happens in a courtroom, and strategies that will help a client maximize their results in mediation. Some clients will want assistance in the mediation setting itself, and I am able to accompany clients to the mediation to assist as it proceeds. Finally, I am willing to make myself available to clients by phone, email or video conference during the course of a mediation to give them assistance and answer questions that arise.
Cultural Diversity Experience: I have learned through my years as a family lawyer that cultural competence is something that has to be consciously worked on. My client base consists many different cultures and backgrounds. Each one of those has its own ramifications in a family law settings - one client's culturally influenced priorities may be wholly different than another's, and each are as valid as the other. One's culture and background may influence how one might perceive issues of power imbalance, family dynamics and family violence. They may also have an influence on a client's perception of property ownership, right to maintenance and roles vis a vis children. It is so important to keep an open, informed mind when meeting a client and when continuing a relationship with that client.
