Update for HB 1058, HB 1541, SB 0104

HB 1058 had a hearing on 3/29/2011.  HB 1058 passed out of committee by a vote of 7-0. There were no amendments.
 
HB 1058 is on the Senate's calendar for second reading on 4/4/2011.  It is now eligible for amendments.
 
HB passed from 2nd to 3rd reading without amendments.  It will be eligible for 3rd reading on 4/7/2011.

Reminder: Political Sign Law went into effect July 1, 2010

SB 0104 - Barrett law funding for retention pond barriers

Barrett law funding for retention pond barriers. Specifies that Barrett Law funding may be used to finance a mound, guardrail, barrier, or other structure necessary or useful to: (1) limit access by children to a retention pond; or (2) reduce the likelihood that a vehicle will enter a retention pond. Provides that if such an improvement is constructed under the Barrett Law within a platted subdivision, the works board may assess all or part of the lots in that subdivision for the improvement.

HB 1058 - Homeowners Association Bill

It is up on Monday, January 24 in House Judiciary at 10:30a in 156-5D.  The amended bill (HB1058Passed.pdf) passed 8-0 out of the Committee.
 
Summary: Provides that the statute that authorizes judicial dissolution of nonprofit corporations applies to homeowners associations. Requires a homeowners association to comply with its grievance resolution procedure upon receiving a complaint or grievance from a member. Prohibits the board of directors of a homeowners association from making a material misrepresentation to a member concerning the procedures or application of the procedures to a complaint or grievance. Authorizes the attorney general to bring an action against the board of directors of a homeowners association or the homeowners association to enjoin knowing or intentional violations of the statute governing homeowners associations. Provides for judicial remedies for violations of the statute governing homeowners associations. 

H.R. 4202 Green Infrastructure for Clean Water Act

This is a critical time to support H.R. 4202, the Green Infrastructure for Clean Water Act, which would encourage communities to use landscape architectural techniques to address stormwater management and other water issues.
 
Not only will this measure bring important opportunities to landscape architects, it will also help communities deal with stormwater, water pollution, flooding, and other water quality issues in a sustainable and cost effective manner.
 
H.R. 4202, the Green Infrastructure for Clean Water Act would:
•    provide grants to states, localities and other entities to plan, design, and implement green infrastructure projects that address water issue.
•    recommend changes to ordinances, permitting process and other zoning regulation to encourage more green infrastructure techniques.
•    establish a green infrastructure program within the Environmental Protection Agency (EPA) to promote the use of green infrastructure and provide technical assistance to states, local governments and the private sector
•    establish up to five Centers for Excellence for Green Infrastructure which would conduct research, develop recommendations, and provide training and technical assistance for implementing green infrastructure best management practices.
