At the Public Inquiry into Wainhomes' appeal of the Planning Authority's initial refusal of their planning application, the Inspector found for Wainhomes. Outline planning permission has therefore currently been granted to Wainhomes for a mixed housing and industry development linked to a Country Park application subject to a number of conditions, including many matters of planning detail which will be of interest to the Wootton Bassett Community. WB4BH is disappointed with and concerned regarding both the content of the Inquiry and its outcome. Specific concerns relate to:
WB4BH has written expressing its concerns to Wiltshire Council seeking to clarify whether or not Wiltshire Council is intending to challenge the Inquiry outcome in the High Court and, if not, why the Council is content that its Local Planning process can be overridden so easily. It seems Wiltshire Council were also disappointed at the Inquiry outcome but, regrettably, see no grounds to challenge the decision (see reply 29 April 2010 in 'Attachments' below). Readers can only wonder at the nature and timing events of 2009 which saw the previous consultant's report classifying Brynards Hill as a development site of last resort in Wootton Bassett abandoned, Brynards Hill emerge as the preferred strategic site for Wootton Bassett in the Wiltshire 2026 Strategy initial discussion documents and Wainhomes' development application and ultimately successful appeal. The ultimate fate of the area currently allocated to the Country Park remains uncertain since it appears the developer seeks to retain ownership, restrict public rights over the land and to retain the right to prevent public access to any part of it for which future planning permission for other development is obtained (see Schedule 4 on p26 of the Unilateral Undertaking of 29 Jan 2010, which may be viewed or obtained below, 2Mb) As anticipated, in July 2010 Wainhomes applied to change the use of part of the Country Park before it was even established |
