It really comes down to inside the fence vs. outside the fence. Outside the fence it's fair game if it's journalism. A photo of an Olympic venue with all its decorations taken across the street in the context of a photo for a story or a standalone with a cutline, for instance, won't be a problem at all. But the IOC might notice and create a stink if that same photo became part of a calendar or poster for sale. 

The Canadian trademark law written for VANOC expressly exempts media reporting on the Games and does not make a distinction. 

Had Richard Giles posted photos from outside the fence, he would not have attracted the IOC's attention.
