This article is scheduled for publication in the Seton Hall Journal of Sports & Entertainment Law in Spring 2009. The article examines morals clauses in talent contracts and what talent needs to know about them. After a discussion of the history and broad contours of morals clauses, the article analyzes the various issues of which entertainers and athletes should be cognizant when dealing with such clauses. The subject of a $345,000 grant from the American Bankruptcy Institute, this study of professional fees in Chapter 11 cases is the most comprehensive empirical study on the topic to date. Professor Stephen Lubben of Seton Hall Law School wrote the report.
