Employment disputes in Seychelles are not handled exclusively by 1 particular tribunal. In fact, there are 3 tribunals which deal with Employment disputes. The particular tribunal which will deal with an employment grievance depends on the nature of the employment. Where employment is one in the public service (i.e. Government job), employment grievances should be filed before the Public Service Appeals Board ("PSAB"). Where employment is in the private sector, employment grievances should be filed before the Employment Department of the Ministry of Employment. In this process, Competent Officers will first seek to mediate the grievance. If the mediation session proves unsatisfactory, then the matter may be forwarded to the Employment Tribunal by the grieving party. Where employment is under the Seychelles International Trade Zone ("ITZ") Employment Regulations, (e.g. certain foreign-based organizations), grievances should be filed before the Seychelles International Business Authority ("SIBA") in its capacity as the ITZ Employment Authority. In the majority, if not all cases, grievances should be lodged within 14 days from the act causing the grievance. Parties dissatisfied with the decisions of the various employment tribunals may appeal either to the relevant Minister or to the Supreme Court depending on which tribunal made the decision. Dissatisfied parties may also seek judicial review from any of the employment tribunals by petitioning the Supreme Court. Parties need not be represented by a lawyer before the tribunals. |
