JOHN GOEMANS: CRUSADER FOR A COLOR-BLIND AMERICA

 

528 U.S. 495 (2000) was a case filed in 1996 by Big Island rancher Harold "Freddy" Rice against the state of Hawaii and argued before the United States Supreme Court.  In 2000 the court ruled that the state could not restrict eligibility to vote in elections for the Board of Trustees of the Office of Hawaiian Affairs to persons of Native Hawaiian descent.

Rice was represented by attorney John Goemans, an active opponent of programs, public or private, that benefit Native Hawaiians preferentially.  John Roberts (who would later become the Chief Justice of the United States) argued for Ben Cayetano, the governor of Hawaii at the time.

The February 2000 court ruling in Rice v. Cayetano encouraged Hawaiian sovereignty opponents to file a similar lawsuit, Arakaki v. State of Hawai‘i, months later. As the Rice case resulted in non-Hawaiians being allowed to vote in OHA elections, the Arakaki case resulted in non-Hawaiians being allowed to stand as candidates in OHA elections.

Lawyer's work opened OHA voting

John W. Goemans achieved a success few attorneys reach when the U.S. Supreme Court affirmed his stand against discrimination in the precedent-setting Rice v. Cayetano case.

But Goemans was vilified by Hawaiian sovereignty advocates for that case, which opened voting for Office of Hawaiian Affairs trustees to all voters, and a subsequent suit challenging Kamehameha Schools' Hawaiians-only admission policy.

In private practice on his own with limited resources, he challenged the well-funded opponents because of "his big passion for civil rights and constitutional law," said his son, Edward. "He believed there should be equal treatment for Hawaiians and non-Hawaiians -- everyone should have a fair shot."

Goemans, 75, died yesterday at his sister's home in Solvang, Calif. He had pancreatic cancer.

"He was a one-man show. He was dedicated to the law," said Sally Rice of Waimea, Hawaii. "He was very concerned about the native Hawaiian entitlements and their long-term effects on the people of this state, and that's why he took on these lawsuits."

She said the challenge to the OHA Hawaiians-only balloting "was John's idea. He saw the issue and looked for the plaintiff." Her former husband, Big Island kamaaina rancher Harold "Freddy" Rice, signed on.

Goemans was born in Milwaukee, and came to Hawaii after earning a law degree at the University of Virginia. He was a college roommate of U.S. Sen. Edward Kennedy of Massachusetts and they remained close friends through the years, said his son.

Goemans served a term in the state House and ran unsuccessfully for a seat in the U.S. House.

His suit challenging the Kamehameha Schools' admission policy was before the high court when the plaintiff, an unnamed student, agreed to a settlement in 2007. Goemans revealed that the school sought the $7 million settlement, despite a confidential agreement, angering his co-counsel, a California attorney, as well as the school. Both filed motions against him in court.

He is survived by son Edward Kula of Texas; daughter Kara of Mill Valley, Calif.; brother Ron Mayo of San Diego; and sisters Peg Goemans of Solvang, Calif., and Patty Bulger of Fort Lauderdale, Fla.

Services will be held in California. His ashes will be scattered in Hawaii at a later date.

The family suggests that in lieu of flowers, memorial donations may be made to Visiting Nurse & Hospice Care, 222 E. Canon Perdido St., Santa Barbara, CA 93101.

John Goemans, who challenged legality

of Hawaiian programs, dies

Attorney John Goemans, best known for legal attacks on programs favoring Native Hawaiians in government agencies and at the Kamehameha Schools, passed away this morning in California.

Goemans, 75, had been suffering from pancreatic cancer. He died at his sister's home in Solvang, California, said his son, Edward Kula Goemans.

Goemans filed and prevailed in a lawsuit that challenged the legality of Hawaiians-only voting for Office of Hawaiian Affairs trustees, culminating in the groundbreaking February 2000 decision by the U.S. Supreme Court in what is known as the Rice v. Cayetano case.

He also helped draft two suits challenging the Kamehemaha Schools' admissions policy favoring students of Native Hawaiian ancestry.

One of those cases, filed on behalf of a non-Hawaiian student identified only as John Doe, was settled in 2007 just as the U.S. Supreme Court was considering whether to hear an appeal.

Last year, Goemans revealed that the settlement paid by Kamehameha Schools in the case was $7 million.

That disclosure spawned new litigation in federal and state court here filed against and by Kamehameha Schools.

Goemans was amused by perceptions of him that he was a white supremacist.

"I've hard people describe me as conservative, right-wing wacko," he said in the 2003 interview. "I think a lot of them would be surprised to learn that I am a left-wing liberal."

Goemans was a college roommate and longtime friend of U.S. Sen. Edward "Ted" Kennedy of Massachusetts and campaigned to help John F. Kennedy win the Hawaii vote in the 1960 presidential election.

Goemans is survived by sisters Peg Goemans and Pat Bulger, brother Ron Mayo and children Edward and Kara.

'Liberal' sparks Hawaiians-only firestorm

Some have concluded that he is, at best, a white supremacist and, at worst, evil incarnate.

John Goemans, who has been in Hawai'i since statehood, has challenged Hawaiian-only programs and policies.

Others believe he is just another malihini lawyer, a carpetbagger who has lined his pockets at the expense of Native Hawaiians by challenging Hawaiians-only voting for trustees to the Office of Hawaiian Affairs and a Hawaiians-preferred admissions policy at Kamehameha Schools.

"I've heard people describe me as a conservative, right-wing wacko," said John Goemans, the slightly rumpled, 69-year-old kama'aina lawyer who has a penchant for loud aloha shirts and a passion for what he believes is justice for all, including non-Hawaiians.

"I think a lot of them would be surprised to learn that I am a left-wing liberal," said Goemans, who is of Dutch and Scottish descent.

He ran with the bulls in Pamplona, Spain, in the 1950s, roomed with now-U.S. Sen. Ted Kennedy at the University of Virginia law school, helped Kennedy's older brother John win the Hawai'i vote and the presidency in 1960 and ran a U.S. State Department office in Hawai'i.

Today, he divides his time between Waimea on the Big Island and Pupukea on O'ahu's North Shore, while a table in the Barnes & Noble bookstore coffee shop in Kahala serves as his office.

He has been in Hawai'i since statehood, served a term in the state House as a Democrat in the early '60s, and was an aide to state Sen. Malama Solomon in the '80s, but still managed to fly "beneath the radar" before the U.S. Supreme Court found in his favor in February 2000 in the Rice v. Cayetano decision. The court held that allowing only Hawaiians to vote for OHA trustees is unconstitutional.

What was left of Goemans' anonymity may be quickly evaporating in the wake of a ruling in August by U.S. District Judge David Ezra that Kamehameha Schools would have to admit a 12-year-old non-Hawaiian boy from Kaua'i, at least temporarily, until the federal courts have a chance to examine the merits of the issue in hearings set for next month.

Goemans helped draft the lawsuit involving the Kaua'i boy, Brayden Mohica-Cummings. Earlier, he filed a very similar lawsuit involving another non-Hawaiian student, identified only as John Doe, who also asserts that Kamehameha's admissions policy is racially discriminatory and illegal.

Goemans said "John Doe's" mother is a friend of his from the Big Island who asked if he could help get the boy into Kamehameha. He said Mohica-Cummings' mother contacted him after learning about the Doe case.

While Goemans came up with the two boys as plaintiffs to challenge Kamehameha Schools' admissions policy, Sacramento, Calif.-based attorney Eric Grant will likely present the arguments next month in the cases before Ezra and Kay.

And while he filed the legal challenge to Hawaiians-only voting in OHA elections, it was a high-powered Washington, D.C., law firm — Gibson, Dunn & Crutcher — that argued the case before the U.S. Supreme Court.

"He appears to be someone who is there to light the fuse, but ultimately the big bang is caused by lawyers who have far greater expertise," said former OHA Chairman Clayton Hee.

Goemans said he had "an epiphany" in the late '80s or early '90s while listening to Solomon talk about plans to use public money to form the "Hawaiian Sovereignty Elections Council." The council was to consist of Native Hawaiians who would meet to discuss methods by which Hawaiians could choose which form of sovereignty they preferred — an independent Hawaiian nation, a nation within a nation or the federal recognition given to American Indian tribes.

"The light went on in my head, and the more I began to think about it, it just seemed to me that something was rotten in the state of Denmark," Goemans said.

He fired off a letter to the local American Civil Liberties Union office believing that restricting all but one racial group from participating in a publicly financed election "was clearly a liberal issue."

He was stunned, though, by the ACLU's response. "They told me their national policy was not to challenge affirmative-action programs," Goemans said.

So he began to look for a plaintiff to take up the cause, and eventually found Big Island rancher Harold "Freddy" Rice.

Goemans filed the Rice case in April 1996 that led to the U.S. Supreme Court's decision. By June 2000, Goemans was back in federal court in Honolulu asking for $600,000 in legal fees for what he said was the four years he spent working on the Rice case. He eventually got $160,000.

Gibson, Dunn & Crutcher, the Washington firm that had argued the case before the Supreme Court, asked for $2.3 million and was awarded about $1.1 million.

Many Hawaiians, and some others as well, were particularly perturbed by the challenge to the admissions policy at Kamehameha, which some view as a refuge from injustices suffered by Hawaiians over 200 years.

"Haunani Trask even called me 'evil,' " Goemans said.

Trask, a Hawaiian activist and professor of Hawaiian studies at the University of Hawai'i-Manoa, acknowledged directing the term at Goemans during a cable television show she shares with her sister Mililani. "I chose that word with great care; I am a poet and a wordsmith," Trask said.

To injure others as the result of a car accident is one thing, Trask said. "But to systematically try to undo what programs there are to address the problems of the Hawaiians that began as far back as first contact, that to me is morally depraved — it is evil."

Goemans said he never expected the huge backlash to the lawsuits he has filed. He said he is surprised no one had challenged programs that he believes are so obviously constitutionally flawed, but he said he thinks he knows why: "It's called I got mine and you got yours. Rice: It’s about protecting the Constitution, not ‘racist’

The Big Island rancher at the center of a U.S. Supreme Court case disputing whether Hawaiians should be allowed to hold their own elections has been called a racist by some, a pawn by others. Harold "Freddy" Rice lets none of it bother him.

"That just goes over my head. The shoe doesn't fit so I don't put it on," Rice said Monday. "To me, this is all about protecting the Constitution and everyone's right to vote."

The 65-year-old Rice is scion of a family that came to Hawaii as missionaries in the mid-1800s and transformed through the generations into a wealthy, powerful clan of politicians, businessmen and ranchers. Rice said he prefers the lifestyle of a working cowboy who counts team-roping steers among his favorite activities.

Growing up, Rice attended Punahou School in Honolulu and then Cornell University in New York. But a privileged upbringing and Ivy League education did not insulate him from failure. His Big Island ranching operation went broke in 1983 and he spent the next few years working as a charter fishing boat skipper before returning to cattle ranching in 1995.

He now lives in Waimea with his wife, Gail, and runs a cattle ranch on the slopes of Mauna Kea. He has four grown children from a previous marriage and several grandchildren, including two who are part-Hawaiian.

Reached today after the Supreme Court decision, Rice said: "I'm just going to enjoy this. I have no future plans. I think this validates that the question needed to be asked, and now we have an answer."

He said he did not plan to celebrate today. "I'm going up. ... Some cattle need to be moved to a fresh pasture."

Rice says he sued in 1996 to overturn the Office of Hawaiian Affairs Hawaiians-only elections because he believes all residents, who help fund OHA through tax dollars, deserve a vote in how the agency is run.

But critics say his lawsuit put millions of dollars worth of government programs helping Hawaiians at risk. OHA trustee Mililani Trask has described Rice as a modern member of the "missionary gang" who won't be content until all Hawaiian entitlement programs are dead.

She has said that he's just like his great-grandfather, William Hyde Rice, an early missionary appointed by Queen Lili'uokalani as governor of Kauai who later helped engineer the "Bayonet Constitution" that disenfranchised Hawaiians in 1887.

Rice counters that he is not opposed to all programs favoring Hawaiians, but believes they should be based on need, not race.
 
And he's proud of his ancestors, who also include grandfather Harold Waterhouse "Pop" Rice, who was a powerful politician and businessman on Maui, and father Harold Frederick "Oskie" Rice, a champion polo player who owned a Maui ranch.
 
Rice said he has no regrets about taking on the case, backed in part by the Campaign for a Colorblind America, a conservative non-profit group opposed to affirmative action. "I think it's been a good education for the public."

Bullet Theodore B. Olson, who represented Harold "Freddy" Rice before the Supreme Court, is known as a passionate and articulate defender of conservative causes with numerous cases before the high court.

A partner in the Washington law firm of Gibson, Dunn & Crutcher LLP since 1972, Olson co-chairs the firm's Appellate and Constitutional Law Practice Group.

In 1981, he was appointed by then-President Ronald Reagan as an assistant attorney general and served as the executive branch's principal legal adviser before returning to his firm in 1984.

Olson received his law degree in 1965 from the University of California (Boalt Hall), where he was a member of the California Law Review and Order of the Coif, and his bachelor's degree from the University of the Pacific.

Olson took the case pro-bono. The Campaign for a Color-Blind America, a national legal defense foundation that supports anti-affirmative action causes, has helped pay other costs.

Almost two years ago, Goemans moved to Washington, D.C., to be of counsel to Gibson, Dunn and Crutcher LLP, which represented Rice before the U.S. Supreme Court.

Goemans, a Wisconsin native, moved to Hawaii directly after his graduation from the University of Virginia Law School. At the time he was Edward Kennedy's assistant in the 1960 presidential elections. He was admitted to the bar in 1962, while working as director of the U.S. Department of State in Honolulu. In 1964, he set up a private practice, which currently represents clients in Honolulu, Kamuela, Los Angeles and Washington, D.C.

From 1965 to 1967, Goemans served in the state House of Representatives. He traveled as a delegate to the Democratic National Conventions in 1964 and 1968. He was state Deputy Attorney General from 1967 to 1970, and in 1968, he was a member of the First Hawaii State Constitutional Convention.

Bullet U.S. Solicitor General Seth P. Waxman, filed what Hawaiian activists hailed as an eloquent "friend of the court" brief and also helped present the state's case during oral arguments.

Sometimes known as the "10th justice," the Solicitor General represents the U.S. government in proceedings before the Supreme Court and federal courts of appeals. Waxman has been in the post since 1997 and before that held a variety of jobs in the U.S. Department of Justice, which he joined in 1994.

He received his bachelor's degree from Harvard in 1973 and his law degree in 1977 from Yale Law School, where he was managing editor of the Yale Law Journal.

FOR THE STATE

Bullet John G. Roberts Jr. has presented oral arguments before the U.S. Supreme Court in more than 30 cases and it was that experience and an impeccable legal pedigree that prompted the state to hire him to present its side.

Roberts, a partner in the Washington law firm of Hogan & Hartson, concentrates on Supreme Court and appellate litigation as head of the firm's appellate practice group.

Early in his career he clerked for William H. Rehnquist, who at the time was an associate justice on 2nd Circuit U.S. Court of Appeals and is now Chief Justice of the U.S. Supreme Court.

In 1982, then-President Reagan appointed Roberts to the White House staff, where he served as associate counsel to the president until joining Hogan & Hartson in 1986.

Roberts left the firm from 1989 to 1993 to serve as principal deputy U.S. solicitor general, representing the federal government in cases before the Supreme Court and federal courts of appeals.

Roberts earned his bachelor's degree from Harvard in 1976 and his law degree in 1979 from Harvard Law School, where he was managing editor of the Harvard Law Review.

John, as I reflect upon the hours that we spent together in our long fight against the might of "The Evil Empire", I just want to say that I truly appreciated your help and counsel and the efforts you made to present the truth and to preserve justice for the people of Hawaii, regardless of their race, religion or creed. You first brought to my attention the concept of a "color-blind society" with equal opportunity and justice for all.  I remember that you were living in the YMCA at the time, and did not ask for any pay except to cover expenses for filing briefs. You truly will go down in Hawaiian history as a person who was willing to give up Earthly comforts and treasures in order to use your considerable talents and experience to help your fellow men try to find justice in an unjust society.

Dear President Obama, Attorney General Holder, Trustee Farmer, Mr. Guttman, Ms. Neustadter, Judge Kevin Chang, Judge David Ezra, and All Concerned:

I refer you to the referenced Exhibits as they directly relate to this lawsuit which violates my constitutional rights of Free Speech and a Fair Trial, and Federal and State Anti-SLAPP statutes.

Mr. Farmer and Mr. Guttman, in spite of all this factual evidence (not just "political opinions" or "conspiracy theories" as you have previously alleged), I am again asking that we attempt to reach a global settlement of this matter through confidential negotiation or mediation rather than continuing these costly and seemingly-endless court proceedings.

However, if you and your insurance carriers are still not willing to attempt to negotiate or mediate settlement in these cases, then I ask that you perform your mandated review of these two Exhibits in accordance with Judge Ezra's Order, and advise me, whether or not, you find that they are relevant and if they contain any so-called "protected subject matter".

I respectfully request your immediate reply. If I do not receive a response from you or your insurance carrier within 15 days, I will assume that you have found no "PSM" in these updated pages, and that you will NOT file any objections to my Motion.
