ALSO SERVING THE FOLLOWING MIDDLE SCHOOL FOOTBALL PROGRAMS: AZALEA, COQUILLE VALLEY, HARBOR LIGHTS, MYRTLE POINT, NORTH BEND, POWERS, RILEY CREEK, REEDSPORT, SUNSET AND THE SW OREGON RAIDERS AND THE SISKIYOU SAVAGES OF THE OREGON FOOTBALL LEAGUE.

SECTION 1. PURPOSE:
This agreement is to provide a statement of the terms and conditions by which football officiating services shall be provided to High School districts in the Southwestern Oregon area.
SECTION 2. PARTIES:
A. The current 5A High School district in the Southwestern Oregon area is Marshfield High School; the 4A High School districts are: Brookings-Harbor High School and North Bend High School; the 3A High School districts are Bandon High School, Coquille High School, Gold Beach High School, Myrtle Point High School, and Reedsport High School; and the 1A High School district is Powers High School; hereinafter referred to as the Member Schools.
B. The Southwestern Oregon Football Official’s Association, hereinafter referred to as the Association.
C. The Commissioner of the Southwestern Oregon Football Official’s Association; hereinafter referred to as the Commissioner.
SECTION 3. RELATIONSHIP OF ASSOCIATION MEMBERS:
It is understood and mutually agreed, individual members of the Association, while in the performance of the duties and obligations of this Service Agreement, shall be deemed to be independent contractors and that no other relationship shall be implied or construed between the individual members, the Association or Member Schools.
SECTION 4. DURATION OF THIS AGREEMENT:
A. The Association, Commissioner, and Member Schools enter into this agreement for the period of time beginning January 1, 2003.
B. This agreement is automatically extended and updated unless revised by mutual agreement of the parties hereto.
C. This agreement may be terminated with mutual agreement of all parties involved in the agreement.
SECTION 5. THE ASSOCIATION AGREES TO:
A. Use its best efforts to recruit and maintain a membership of qualified officials adequate to meet the needs of the Member Schools.
B. Provide regular and ongoing training and educational programs for its members.
C. Provide officials for one preseason scrimmage at $50 (paid to the Association) and regular travel reimbursement (for the crew). A scrimmage involves only one school. A request for officials must be made by August 15.
D. Provide officials for a jamboree at $100 (paid to the Association) and regular travel reimbursement (for the crew). A jamboree is a contest involving more than one school at the beginning of the season per OSAA definition. A request for officials must be made by August 15.
E. Conduct a rules clinic for Member Schools at a time and site to be determined by the Association. New rules, rules emphasis and procedures will be discussed for the upcoming season. Schools will be notified at the beginning of the season late of the time and location.
F. Provide, in part, the Commissioner’s compensation in accordance with the By-Laws of he Association.
G. Provide Member Schools with:
1) Roster of the Association Membership,
2) By-Laws of the Association, and
3) Schedule of the Association meetings.
H. Provide Member Schools with a check writing and bookkeeping service for the purpose of compensating game officials and agrees to reimburse any surplus monies. Each Member School will receive the game charges (known at the time for the season) by August 1, provided that the school's schedule(s) has been submitted.
SECTION 6. THE COMMISSIONER AGREES TO:
A. Be responsible for assigning officials to all scheduled games.
B. Notify Member Schools two weeks before a home school’s contest of such assignments.
C. Be the primary liaison between Member Schools and the Association and shall attend league or other meetings as requested by either party.
D. Provide Member Schools a means of obtaining specific rules interpretations during the season.
E. Provide Member Schools with information concerning complaints of conduct by coaches, players, or followers; or conditions that hinder officials in the proper performance of their duties.
F. Designate the officials to work any Play-off or State Tournament game as requested by OSAA subject to the following restriction: Upon completion of the season, and prior to any play-off games, the Commissioner shall provide a list of eligible officials to the Athletic Directors of the member schools. The Athletic Directors may, by majority vote, remove any official from eligibility.
SECTION 7. MEMBER SCHOOLS AGREE:
A. To be responsible for the conduct of their coaches, players and followers.
B. To provide dressing and shower facilities with hot water for the officials that affords reasonable privacy and security. A priority is to give officials immediate access to these facilities prior to, at half-time, and after the game.
1. To comply with the OSAA Official's Safety Committee's directive to provide two reserved parking spaces for the officiating crew that are very near the official's dressing area.
C. To provide adequate crowd control and protection for the officials during and after the contest on the field, dressing room, and area surrounding the playing area. Neither coach nor spectators shall be allowed in the official’s dressing room at any time.
D. To provide incentive for all coaches and athletic directors to attend rules clinics.
E. To provide the Commissioner with notice of canceled or postponed games or of changes in starting time, at least forty-eight (48) hours prior to the scheduled game. Failure to provide said notice shall require fees and travel reimbursement to be paid to the assigned officials.
F. To provide the Commissioner a schedule of contests by the last day of school prior to the season. Changes in game schedules made after August 15 prior to the season will have a $10 charge for each schedule change per occurrence.
G. To pay compensation to game officials in accordance with the fee schedule attached hereto as EXHIBIT "A" and travel reimbursement in accordance with the reimbursement schedule attached hereto as EXHIBIT "B".
H. To pay compensation to the Commissioner in accordance with the fee schedule attached hereto as EXHIBIT "A".
I. To pay to the Association, prior to the Friday before Labor Day, a sum equal to the various fees and travel reimbursements, and such other agreed upon charges, as to enable the Association to compensate Officials in accordance with the terms of this Agreement.
1. Participants agree to reimburse, upon notification, the Association for any deficit in accounts deemed proper under the terms of this agreement.
J. To provide capable personnel to serve as timers, and Chain Crew during home contests. Individuals selected are to be trained prior to the contest by the home school. Chain Crew and clock operations will make themselves available on the field 30 minutes prior to the start of the game. The same individuals and/or appropriate substitutes need to be doing their duties for the entire game(s).
K. To provide the Association with an updated copy of your league’s SOP (standard operating procedures) as they apply to football and football games.
L. To provide the Commissioner with information concerning complaints about an officials conduct that may be in violation of the Association’s By-Laws, or which hinders the proper administration of the game.
SECTION 8. THE ASSOCIATION AND MEMBER SCHOOLS AGREE TO SHARE RESPONSIBILITY FOR:
A. The proper administration of all games.
B. The objective evaluation of officials.
C. The administration of any member school has the right to restrict an official from officiating for that Member School, as per OSAA handbook. Recognizing that restriction of an official’s right to officiate any game of a Member School is a request that should be taken very seriously, the procedure outlined below must be followed. Officials may also be restricted by the Commissioner or SWOFOA Executive Board for repeatedly failing to properly administer the rules of the game, conduct in violation of Association By-Laws, or being an employee of that High School.
1) The Principal or designee of a Member School shall notify the Commissioner of any restriction prior to the first scheduled contest for the school. Such notification shall be in writing.
2) Restrictions applied by a Member School are limited to one per season.
3) All restrictions become null and void upon completion of the season in the calendar year such restriction is requested.
D. Election of a Commissioner. Upon election of a Commissioner by the Association, Member Schools shall confirm or deny said election by a majority vote.
E. The resolution of disputes. The parties hereto agree to mutually resolve disputes concerning the interpretation of this agreement or matters not specifically covered by this agreement.
SECTION 9. AMENDMENTS TO THIS AGREEMENT:
In the event it becomes necessary to modify this agreement, any such modification shall be in writing and signed by the parties to be bound thereby.
Exhibit "A"
Compensation Schedule
A. Officials compensation:
Each official shall be paid for each game officiated in accordance with the OSAA Fee schedule:

The referee shall be paid a game administration fee of $3.00 for each game officiated.
5th quarter: Each official shall receive an additional $15.00.
B. Commissioner’s compensation:
The Commissioner shall be compensated by each Member School prior to the start of the season at the rate of $51.75 (53.25 in 2009 and 54.75 in 2010) for each team schedule submitted per school, as per OSAA fee schedule.
C. Bookkeeping fees:
The Commissioner (or designated bookkeeper) shall be compensated at the rate of $51.75 (53.25 in 2009 and 54.75 in 2010) for each team schedule submitted by a school utilizing the check writing service provided by the Association, as per the OSAA fee schedule.
Exhibit "B"
Mileage Fees--Travel Reimbursement
A. Travel reimbursement shall be paid to the designated driver, in addition to the official’s compensation, at the IRS maximum allowable rate per mile. For the calendar year 2007 the rate is 48.5 cents with a minimum mileage charge of $5.00 per official to be paid by the host school.
B. Travel reimbursement for trips in excess of 150 miles round trip from Coos Bay shall be three (3) cents per mile less than the IRS maximum allowable rate per mile.
C. Travel reimbursement shall be paid for one car per scheduled game.
D. Reimbursement schedule from Coos Bay shall be at the miles listed below multiplied by the appropriate IRS allowance to be determined prior to the start of the season.

E. Travel reimbursement to Coos Bay-North Bend shall be paid in addition to the official’s compensation, at the IRS maximum allowable rate, one way from an official’s city of residence. For trips of 75 miles or more, the rate will be the IRS maximum allowable rate per mile less three (3) cents per mile.
