Q.     If I contract a potentially incinerator – related illness 20 years from now, will the Navy be responsible?

A.  If you become ill and think the illness is related to the incinerator, you can file a claim.  As a precaution, make sure that you document your residence at NAF Atsugi in all your family members’ health records.  NAF Atsugi Branch Medical Clinic has a form, which takes about two minutes to fill our and it becomes a permanent entry in your health records.

We are able to provide the following procedure on submitting Military Claims in accordance with JAGINST 5890.1A - ADMINISTRATIVE PROCESSING AND CONSIDERATION OF CLAIMS ON BEHALF OF AND AGAINST THE UNITED STATES. 

 

In order to make a claim attributing an injury to the conduct of the Department of the Navy personnel acting within the scope of their employment, a claimant must submit the attached Standard Form 95  with evidence which substantiate the chain of causation.  Please note the following points:

 

1.    Claims against Department of the Navy must be presented in writing within two years after they accrue. 

 

2.    Any claims for the personal injury or death of a member of the Armed Forces or civilian employee that is incident to service are normally not payable under the Military Claims Act.  10 U.S.C. §2733(b)(3).

 

3.    5th Air Force Claims Office is the single-service claims office for Japan.  Their procedures require that all the substantiating documents must be submitted on paper not electronically or on other media (CDs, DVDs, etc.).

 

4.    A claim is normally submitted by claimants to the Claims Office nearest to where the incident allegedly causing the injury occurred, in this case, that would be the legal office here at NAF, Atsugi.
