And we are so glad that all around the country, so many Religious Gurus have openly supported our cause and demanded for strict legal action against those who bring bad name to the religion... We are also against people using Canopy less generators or machines without proper sound proofing. Any generator without canopy is illegal and we want the police and administration to use I.P.C. 268, 290 and 291 apart from the Environment Protection Act-1986 against Noise beyond fixed decibel limits even during the day.

सामाजिक संस्था 'सत्या फाउंडेशन' के लिये सोमवार का दिन अभूतपूर्व था। बिना किसी पूर्व सूचना के आज सुबह 11.30 बजे वाराणसी के जिलाधिकारी श्री रविन्द्र ने संस्था के सचिव चेतन उपाध्याय (जो आज दिल्ली मे हैं) को फ़ोन् करके, ध्वनि प्रदूषण पर और अधिक प्रभावी लगाम लगाने के उपायो पर चर्चा की। व्यापक जागरूकता के बावजूद तमाम मैरेज् लानो और सामुदायिक केन्द्रो पर बहुत तेज ध्वनि प्रदूषण की शिकायतो और उससे होने वाली दिक्कतो को गम्भीरता से लेते हुए उन्होने कहा कि रात 10 बजे से सुबह 6 बजे के बीच पूर्ण शान्ति के नियम के अलावा दिन के दौरान भी निर्धारित डेसीबल सीमा से उपर ध्वनि प्रदूषण न हो, इसके लिये सभी सम्बन्धित लोगो को नोटिस भेजी जायेगी। और इसके बाद पकडे जाने पर दोषियो के खिलाफ़् कानूनी कार्र्वाई की जायेगी।
ज्ञातव्य है कि दिन के दौरान भी ध्वनि के स्रोत से 1 मीटर की दूरी पर 75 डेसीबल से ज्यादा शोर करना कानूनन अपराध् है और ध्वनि प्रदूषण के प्रति बढती हुई जन- जागरूकता के मद्देनजर जनता की बहुत बडी माग थी कि दिन के शोर पर भी प्रभावी लगाम कसी जाये। संस्था के सचिव ने कहा कि बाजार मे उपलब्ध अधिकतर पटाखे 120 डेसीबल से अधिक की आवाज् करते हैं, इसलिये ऐसे सभी खुले स्थान वाले लानो के अन्दर आतिशबाजी पर पूर्ण प्रतिबन्ध लगना चाहिये। संस्था के सचिव ने आगे सुझाव दिया कि नोटिस देने के साथ् ही ध्वनि-विस्तारक यन्त्र, डी.जे. और मैरेज् लानो की एक बडी जागरूकता बैठक का आयोजन किया जाये जिसमे सभी मजिस्त्रेत और पुलिस अधिकारी भी शामिल हो। और ध्वनि-विस्तारक यन्त्र, डी.जे. और मैरेज् लान के मालिको के लिये डेसीबल मीटर रखना अनिवार्य कर दिया जाये। साथ् ही सभी क्षेत्राधिकारियो, थानाध्यक्षो और चौकी प्रभारियो को डेसीबल मीटर उपलब्ध कराया जाये। लगभग 5 मिनट की वार्ता के अन्त मे जिलाधिकारी ने कहा कि बिना कैनोपी वाले जेनरेटर मालिको को नोटिस देने का कार्य भी शीघ्र शुरु किया जायेगा।

Satya Foundation demands the Chief Election Commissioner for addressing the problems faced by the 'Fariyadis', due to the over-loading of police & administrative officers in election work.
"Sir, the administrative and police officers in all the districts of election states are busy in election meetings and so many rural & urban Fariyadis (people seeking justice and action from the administrative & police officials) are hopelessly returning to their homes, everyday. Due to this dejection & frustration in the people, and the could be fall-outs, a general feeling is emerging that the Election Commission should immediately take some concrete measures to decrease the work-load of the police & administrative officers." That valid point was raised before the Chief Election Commissioner, Mr. S.Y. Qureshi by Satya Foundation Secretary, Chetan Upadhyaya on Sunday evening.
Later, Chetan Upadhyaya told the reporters that the CEC listened to the point very carefully, but sought some alternative option as well. The Chief Election Commissioner was the key speaker today (from 2.30 p.m. to 4.00 p.m.) at seminar organised by 'Foundation for Peace, Harmony and Good Governance' at N.C.Y. U. auditorium, Khelgaon Road, New Delhi. Just after the programme was over, while Mr. S.Y. Qureshi was on his way to the car, the Satya Foundation Secretary Chetan Upadhyaya got the opportunity to share the common pain of the affected masses with him. "It is hoped that even if not now, by the next elections, the Election Commission could devise some strategies to address this serious issue", Chetan Upadhyaya said.

In a lesson for the other districts and states of India, Noida has become the 3rd district of India (after Varanasi & Agra), where anybody suffering from Noise pollution from the canopy-less generators will approach the police & get relief in 15 working days. This was decided by DIG Shri Jyoti Narayan at a programme organised by Satya Foundation at Noida Police Control Room on Monday evening.
Satya Foundation, a national organization working towards regulation & control of Noise apprised today, all the police officers, including C.O.'s, S.H.O.S's and SO's of their powers to lodge FIR against Noise Pollution under IPC 268, 290 & 291 apart from the environment Protection Act, 1986.
The Satya Foundation's Founder Secretary Mr. Chetan Upadhyaya gave a very strong Power Point presentation that why full fledged legal drive against Noise Pollution is necessary. It is worth mentioning that due to consistent efforts by Satya Foundation at multiple levels (in districts of Varanasi, Allahabad, Chandauli, Gorakhpur, Karnal etc.) for the last 4 years, so many cases have been already registered against Noise pollution in different parts of the country. The campaign has got extensive support from the print & electronic media apart from the religious gurus, doctors, patients, children, elderly & the police & administration.
On Monday evening, at the awareness programme at Noida Police Control Room, it was being told that for good health of a human being, 40 decibel of sound is ideal, while the noise level in present society is on a much higher side. No religion allows use of speakers for worship in such a way that it disturbs the tranquility of the common man. And that has been stated by different religious Gurus at conferences organised by Satya Foundation in different parts of the country. On 30th Decmber, 2011, Pandit Chandramauli Upadhyaya of Shri Kashi Vishwanath Temple had said that if the loudspeaker is not used in this temple, what is the logic for loudspeaker in other temples of the world? Similarly, Mahant Kamal Nayan Das of Tulsi Math, Bareilly & Shri Shrikant Mishra of Shri Kashi Vishwanath Temple have said that the power of Mantra is destroyed in using the loudspeaker and any police officer who takes legal action against such nuisance in the name of religion and tradition will get the blessings of God. Similarly, Maulana Junaid Haris (Jamia Milia Islamia, New Delhi) and Maulana Abdul Batin Nomani (Mufti-e-Banaras, Varanasi) have also spoken against the use of loudspeaker in mosques and quoting the Hadees, said that it is sin, if the voice of Namaz reaches the ears of any ill person/patient.
DIG Police of Gautam Buddha Nagar, Shri Jyoti Narayan said that apart from the canopyless generators (day on night), cases would be also registered against Noise from different other sources like loudspeaker, D.J., Band, firecrackers, Horn etc. between 10 p.m. and 6 a.m. so that masses can enjoy sound sleep & good health.

It is worth mentioning that due to consistent efforts by Satya Foundation at multiple levels (in districts of Varanasi, Allahabad, Chandauli, Gorakhpur, Karnal etc.) for the last 4 years, so many cases have been already registered against Noise pollution in different parts of the country, under IPC 268, 290 & 291 apart from the environment Protection Act, 1986. The campaign has got extensive support from the print & electronic media apart from the religious gurus, doctors, patients, children, elderly & the police & administration.
On Thursday afternoon, at the meeting at the official residence of the DIG Police Shri Asim Arun, apart from the Satya Foundation Secretary Chetan Upadhyaya, the Regional Officer of Uttar Pradesh Pollution Control Board (Agra region) Dr. B.B. Awasthi was also present. It was felt in the meeting that with active support from C.P.C.B., there is need for full fledged drive against noise pollution from canopy less generators. For good health of a human being, 40 decibel of sound is ideal, while the noise from any of the open generators in the market is between 100 to 140 db which is creating so many problems for the people. As per the Noise Pollution (Regulation and Control) Rules-2000, any police officer of level of C.O. (D.S.P.) and above can give notice to the owners of machines/generators producing more than 75 db of noise.
For any generator manufacturer, installing canopy and other sound proofing device so as to reduce the noise level to 75 db (at distance of 1 meter from the source) is an essential precondition, but in absence of proper coordination between the different government agencies, people are bound to suffer silently for years and years. It is hoped that today’s meeting will prove to be a big milestone in direction of solution to this very big problem.
DIG Police Shri Aseem Arun applauded the herculean efforts by Satya Foundation and promised for big breakthrough in this direction by empowering the Circle Officers for taking action against Canopyless generators.
U.P. Diesel Engine Manufacturers Association welcomes the Move:
After the afternoon meeting at the DIG’s camp office, Satya Foundation had meeting with the office bearers of the Uttar Pradesh Diesel manufacturers Association in the late evening & apprised them of the serious health consequences faced by the crores of people around the country. Hence, it is imperative that pollution standards are strictly followed by one and all.
During this meeting, the Secretary of U.P. Diesel Engine Manufacturers Association Mr. Manish Doneria lamented that due to irresponsible behavior by few people, the whole generator industry of Agra is getting bad name. Mr. Doneria promised that their association will participate whole-heartedly in battle against those who play with the law, endangering so many human lives. It was also decided that with active support from Satya Foundation, a meeting of all small and major players of Generator industry would be organized in Agra, within the next 15 days. It shall focus on awareness amongst the industry & if even after this, somebody is found in manufacture/distribution of canopy less generators, strict legal action would be ensured with the help of police & administration.

VARANASI to be the 1st district of India where Police will act against Noise Pollution from Canopy-less Generators
This news may be a breath-giver to many and may be a lesson for many of the state governments of India. Varanasi is going to be the first district of India where the people suffering from the menace of Generator's noise will be able to get rid of it by registering complaint with the police station. Earlier, the people used to run from pillar to post for years and even dozens of visits to the Pollution Control Board did not yield results.
Acting on memorandum from Satya Foundation (an organization that has been actively campaigning for reducing the decibel level of holy city for the last 4 years), the Inspector General of Police, Shri R.P. Singh has written to the DIG in this regard. Now, the police shall give notice to the owner of such noisy (read Canopy less) generators and ask them to install canopy within 15 days and if they don't do so, case would be registered under Environment Protection Act-1986 (imprisonment up to 5 years or fine up to Rs. 1 lakh or both).
Before the meeting on 11th January 2012 at IG's office, on 9th January 2012 also, the Satya Foundation Secretary Chetan Upadhyaya had met the IG Police, Shri R.P. Singh with the copy of THE NOISE POLLUTION (REGULATION AND CONTROL) RULES- 2000 wherein it has been clearly mentioned that for any noise above 75 decibel, the Deputy Superintendent of Police (Circle officer) is authorized to seize noise producing equipment/machine & lodge case under relevant provisions.
Though, the Varanasi Police does not have the Decibel meter, it is proven fact that any generator without canopy produces sound of 100 db or more. Hence, the police can take direct action without the involvement of State Pollution Control Board, was the logic put forward by Satya Foundation.
"The IG Police took the letter in a very positive spirit & hopefully, Varanasi may prove to be a role model for the rest of the country", told Chetan Upadhyaya, the founder Secretary of Satya Foundation.
It is worth mentioning that after consistent efforts by Satya Foundation at multiple levels, the police lodged first FIR against Noise pollution in 2009 and since then, so many cases have been already registered against Band, D.J. and marriage lawns for noise beyond fixed limits. Varanasi owes this success to the prompt police-administration, the proactive media, students and the common man on the street.

Satya Foundation is involved in the process of creating awareness on Noise pollution & reducing the decibel level for the last 46 months. With your constant support & action, the results are visible, but still a lot more needs to be done.
This is to bring to your kind notice that in spite of immense public awareness on the issue of Noise pollution, there are thousands and thousands of canopy less generators in whole of Uttar Pradesh. Though the safe limit for human ears is around 50 db, these open and canopy-less generators produce noise of 110-120 decibels and even more. This is causing many kinds of diseases in the people and at the same time, killing the tourism as well.
Madam, there is enough awareness on the issue & I think that time has come for FULL FLEDGED DRIVE AGAINST Canopy less Generators. As per the rules, all those people creating high-decibel noise should be subjected to strict legal action under Amended Noise Pollution Rules-2010 (Penalty up to Rs. 1,00,000 OR jail up to 5 years OR both).
We suggest you to adopt the following line:
1. Through proper Press conference, issue warning to owners of Canopy less generators (5 Kva and more) & invite/motivate suffering public to register complaint with the administration/police. Issue notice against the owners of such Noisy generators (Under the Amended Noise Pollution Rules-2010, the C.O. is authorised to issue such notice, even suo-Moto) & take appropriate action.
2. Generators of 1 Kva or more can’t be sold without standard canopy, but everywhere in the market, you find distributors & sellers openly flouting the rules & selling noisy generators without canopy. So, these shops should be raided from time to time as well.

The residents of colonies near the Central Jail in Varanasi will no longer be irritated by sound of loudspeakers from the temple inside the jail premises.
The Senior Jail Superintendent Captain S.K. Pandey on Thursday decided that NO LOUDSPEAKER SHALL BE USED IN THE TEMPLE during the restricted hours (10 p.m. to 6 a.m.). Means there will be worship of God, but without the loudspeaker.
Earlier, one local resident, Advocate Mr. Rajesh Kumar Chaturvedi apprised the Satya Foundation Secretary Chetan Upadhyaya of the problems faced by the high decibel level of the loudspeaker, specially between 4 a.m. and 6 a.m. In turn, Upadhyaya (presently in Delhi) called up Captain S.K. Pandey and Pandey's such a positive response made Upadhyaya, simply speechless.
On Friday, the residents were surprised to not listen to loudspeaker at 4 a.m. in the morning. We earnestly wish and pray that other places of worship also follow the same path.

Inspite of public assurance by ALL MAJOR & MINOR BAND PLAYERS at a conference organized by Satya Foundation on 17.04.2011, on Saturday night (26th November, 2011), the MUMTAZ BAND people played band till police intervention at 10.30 p.m… And when confronted, they did not pay heed to the problems faced by pedestrians & as well as those in vehicles. Ashok Bhattacharya was not a lone passer-by. But he taking cue from Satya Foundation’s media reports and display boards & so many cases against Noise pollution, Ashok decided to stand against the noise after 10 p.m. & the today’s FIR is just the symbol of his strong anger against those who take law in their hands & disturb the tranquility of the area.

In continuation of its crackdown on those violating the noise pollution norms in residential zones, a case was registered on Sunday morning (27.11.2011) at Luxa police station under IPC 268, 290 and 291 against a big player of Band industry in Varanasi. On the written complaint from one Ashok Bhattacharya of Sidhagiribagh-Shrinagar Colony, First Information Report was registered by Luxa Police station head (S.O.) Shri Gajanand Chaubey, against Mumtaz Band of Chowk area for using Band-Baja at 10.30 p.m. Ashok Bhattacharya said in his complaint that he had read in media reports and also the NDTV link on Satya Foundation's site that how the Band, Dhol-Nagada & Firecracker professionals had taken joint pledge not to give any kind of service between 10 p.m. and 6 a.m. But on Saturday night, he saw it happening in Gurubagh area. How can they use band at 10.30 p.m. ? This angered him so much that he took help from an ex-television journalist & the Founder Secretary of Satya Foundation, Chetan Upadhyaya in booking the Noise offenders. The matter was recorded immediately on a camera… Upadhyaya & his team just did the needful & the case has been registered against Mumtaz Band, Varanasi.
Upadhyaya doesn't feel any threat from any of those against whom cases have been registered. Rather, all of those offenders have already sent their due apology for creating such situation. And such is the conviction of Chetan & his team at Satya Foundation that there is practically 0% chance of any partiality in implementation of Noise Pollution laws. And this helpline service is free, though donations of any amount are always welcome.
After continuous crackdown on late night Noise, of late, Satya Foundation has taken strong exception to the death of patients in ambulance due to frequent and long traffic jams by unruly dancing Baratis (in drunken state) & first such case was registered against Harish Lalwani, owner of Shubham marriage lawn and the unidentified Baratis on 22nd November, 2011 by Sigra Police station head Mr. Anand Singh. Compared to the last year, this year's Diwali was less polluting. This was stated by Uttar Pradesh Pollution Control Boards's Assistant Scientific Officer Mr. S.B. Franklin at the Press Conference organised by Satya Foundation at Shri Naivedyam Restaurant, Mahmoorganj, Varanasi on Saturday afternoon.
The Satya Foundation Secretary Chetan Upadhyaya has attributed this phenomenal success to media, police, administration, people and the students. It's worth mentioning that due to intensive campaigning by Satya Foundation, thousands of students had taken pledge to boycott the firecrackers completely. Apart from that, Satya Foundation had raised demand for seizing the illegal firecrackers, all across the state. Under the leadership of D.M. Shri Ravindra, ADM City Shri M.P. Singh & the SP City, the city witnessed series of raids on firecracker shops before Diwali. As a result, people witnessed very low sale & usage of firecrackers & today's data is only testimony to this.
The minimum noise level recorded last year was 74 db while this year, it was 63 db(Reduction of about 15%).
On the other hand, air pollution was also very less this year. Which clearly proves very less consumption of firecrackers in the city.
Last year, the overall average of PM 2.5 (it denotes level of pollution and on a normal day, it is around 60 microgram/m3) ) was 427 microgram / m3 while for this year, it was 249 microgram / m3. In other words, last year, Diwali was 7 times more polluting than normal day, while on this Diwali, it was just 4 times more polluting than the normal day. ( Reduction of about 42%)
Similarly, the average value of NOX for normal day is around 80 microgram/m3. Last year, its average value on Diwali day was 243 microgram/m3 while this year it was just 212 microgram / m3.
The values for SO2, NO and NO2 also decreased in the year 2011.

The pollution is at its height at midnight. Last year, the average value of PM 2.5 at 12 midnight on Diwali was 985 microgram/ m3, while in 2011, it was just 598 microgram / m3 (Reduction of 39.2 %)

Last year, the city witnessed the PM 2.5 of 324 microgram / m3, while in 2011, it was just 164 microgram / m3. (Reduction of about 50%) which means that the consumption of firecrackers on Choti Diwali (1 day before Diwali) was very insignificant compared to last year.

Regarding: Testing & Seizure of High-decibel firecrackers in whole of Uttar Pradesh
Dear Sir,
Satya Foundation is a registered society under Indian Societies Act, 1860. We organise programmes and workshops for people and officers in different states on the issue of Noise Pollution. Our campaign against Noise Pollution has already gained momentum in cities of Varanasi, Gorakhpur, Bareilly, Allahabad & Chandauli.
Sir, as you know, on every Diwali, we organise series of awareness programmes in various educational institutions and do multimedia campaigning for reducing the use of firecrackers. But our experience tells that not only the monitoring by UPPCB on the night of Diwali, but strict implementation of noise laws is equally necessary.
The ideal decibel level for human beings is 35-40 but the decibel level of many of the firecrackers is more than 130 db. So, every year we witness that inspite of all warnings, the high decibel firecrackers ruin the life of common citizen. Lakhs of human beings, especially the little children & patients suffer in silence because practically there is no legal crackdown on the people involved in distribution & sale of such highly hazardous, high-decibel firecrackers.
Sir, as discussed with you over phone in the morning, it is very much necessary that with active participation of local police & administration, you raid the firecracker distributors & their go downs all across the state and check whether the noise levels are within the maximum permissible limits or not. After the testing, if found guilty, such firecrackers should be seized and offenders must be booked under Environment Protection Act-1986 & other related provisions of the law. For this, strong coordination between the various district magistrates & U.P.P.C.B. is a must.
Hoping to see a historical crackdown on High-decibel firecrackers in all the Districts of Uttar Pradesh.

Noise Pollution awareness in Allahabad: A gentle beginning....
The Satya Foundation team was in Allahabad from 25th June to 27th June. It was for the cause of educating the police personnel on Noise Pollution. With help from IG Shri R.P Singh and DIG Shri Ram Kumar, it was a highly productive journey. Now one can see Noise Pollution awareness boards on all police stations and police offices. Plus the 25 page book on Noise Pollution (edited by Secretary, Chetaqn Upadhyaya) with copy of Amended Noise Pollution Rules-2010 has been also distributed amongst all the senior officers/C.O./S.O..

In the continuation of awareness programmes on Noise Pollution, the social-cultural-spiritual organization- Satya Foundation cautioned the students & teachers of W.H. Smith Memorial School, Sigra, Varanasi against Noise pollution on Thursday morning.
Speaking as the Chief Guest, the priest (Archak) of Shri Kashi Vishwanath Temple, Shri Shrikant Mishra said that any religion can never advocate use of loudspeaker for the worship of God. Rather, the use of loudspeaker destroys the power of Mantras and makes the people sick- both physically & mentally. He further said that people must boycott the speakers in the name of Manas Path or Devi Jagran & police must not hesitate in booking such Noise offenders. The temples and people must switch off the speakers COMPLETELY between 10 p.m. and 6 a.m. & even during the day, nobody should be allowed to disrupt normal life in the name of religion. He further said that administrative & police personnel involved in such legal action (seizure of loudspeaker; using IPC 268, 290 and 291 & also Environment Protection Act-1986) will be getting 'Punya' & not Paap (sin).
The Founder Secretary of Satya Foundation, Chetan Upadhyaya said that the main reason for Noise Pollution is the fact that People hate noise except when they themselves are the organizers or part of the programme. We must not do the things which we don't expect from others. The first step has to be taken from our own homes by enjoying Television or Radio in minimum volume. The students were told that ideal decibel level for healthy body and mind is less than 45 decibels while any pressure horn or hooter has sound level between 90 and 110 decibel. Even the decibel level of normal horn is high enough to create anxiety and irritation. That's why people in foreign countries normally don't use horn. And even in India, one can't blow horn near Court, hospital or educational institutions. And no horn can be used in any residential area between 10 p.m. and 6 a.m. But for lack of awareness, people are suffering from so many diseases.
The students took pledge not to create any noise & also that they will report any such incident to the Police but never suffer in silence.
The role of Principal Mrs. Anita Dey and Manager Mr. Pradeep Dey was very instrumental in making the programme successful. The programme was conducted by Mr. C.J. They chalked out strategies for unity so that no one can dare to press them for giving services between 10 p.m. and 6 a.m.
Yes, after the D.J. professionals, now the Band Kalakar Sanchalak Samiti (BAND ARTIST ASSOCIATION) headed by Mr. Mukhtar Hashmi & Haji Munnawar Ali has joined hands with Satya Foundation for fighting late night noise pollution.
Satya Foundation, headed by Rajyogi Ashish Chatterjee & co-headed by Dr. Adinath Upadhyaya is actively pitching for reduction in levels of Noise in Varanasi for the last 3 years (details available on Internet)
The marathon meeting went on for about 4 hours.
So the owners of these band firms alongwith the Dhol-Nagada & Aatishbaji (firecrackers) took pledge that they will now go for legal agreement with the party/organisers in advance for services only till 10 p.m. & in case they face any verbal threat or pressure (drunken baratis often resort to violence), they will report the matter to the police but will never play with the law of land.

SATYA FOUNDATION is a registered society under Indian Societies Act, 1860. With headquarters at Varanasi and operations mainly from New Delhi, our organization is involved in doing many kinds of awareness programmes on Noise Pollution throughout India.
Madam, as you know, Noise Pollution is proving to be a big menace for the community. Be it the noise from D.J. & canopy-less generators or the Loudspeakers (in High decibel level) used in the name of religion/tradition, Noise Pollution is causing many kinds of inconvenience & diseases in the population. Since 10th February, 2008, Satya Foundation has launched its massive drive against the Noise pollution, especially after 10 p.m.
As per the Supreme Court guidelines, nobody can use any kind of loudspeaker, band, firecrackers, D.J. etc. between 10 p.m. and 6 a.m.
This is very pathetic to see that even during this time of examinations, the administration & police force are not acting tough against Noise pollution. Inspite of all those G.O.'s and directives from govt., there is no seizure of noise equipments nor any cases are generally registered against such a big crime and crores of students and people are suffering.
Madam, you are requested to take this matter on a high priority and ensure implementation of court & government orders in this regard in all the districts of Uttar Pradesh.

Yes, we had organised NOISE POLLUTION AWARENESS PROGRAMME for all magistrates, police officers, banquet halls, marriage lawns, D.J., Band, Loudspeaker, Generator & firecracker industry in Karnal on last 29th November, 2010. In fact, as of today, all the police stations, police offices & administrative offices in Karnal are equipped with Satya Foundation's innovative and big display boards on Noise Pollution plus the full file of new rules. As per the Amended Noise Pollution Rules, 2010 any kind of Noise (even Construction Activity, Machine or even Horn) after 10 p.m. is illegal and offenders can be fined up to Rupees One Lakh (1,00,000) or jailed up to 5 years or both.
Soucrces close to Satya Foundation say that this year, all the marriage lawns and Banquet halls are going to follow the rules religiously. The people in this city (which is just 2 hours drive from National capital Delhi) were sick of the late night noise pollution. And many of them approached Satya Foundation (which is fighting for enactment of Noise Pollution laws in many cities of India including Varanasi, Gorakhpur, Bareilly, Cyberabad etc.) in February 2010. After brain storming sessions and discussions with many influential people, 2 big programmes were organised under the banner of Satya Foundation. People were told that too much of Noise in name of celebration/religion/tradition is very much against the teachings of religion/Medical science and law of land. And during the major programme at Panchayat Bhawan on 29th November, 2010, it was clear that the Deputy Commissioner and S.P.'s stand on this issue of health & sleep is going to be very tough.

It is unbelievable but true. Probably in a lesson for other cities and states of country, the police and administration, for the first time in history of Varanasi, tried to enforce the Noise Pollution Rules and did all out efforts to stop people from bursting firecrackers after 10 p.m. In a major relief for students, patients, expecting mothers & literally all sections of society, the whole police force including all the CO's & Station Officers were literally on the road to seize firecrackers and teach lesson to the law-breaking citizens.
The firecracker shops were forcibly shut down after 10 p.m. (so that law-breaking people can't buy them & create nuisance) & youth were chased & forced to be in their homes. The happier part is: the people readily bowed to the wishes of administration/police & with a few exceptions, in most of the areas, bursting of firecrackers was over by 11 p.m.
In an interesting episode, a doctor was caught red-handed burning firecrackers on his rooftop at 11 p.m. The local SO in a satirical tone, rebuked the doctor for destroying the environment for short-timed pleasure. THIS IS JUST ONE CASE. SEVERAL SUCH CASES WERE REPORTED FROM VARIOUS AREAS.
In another incident, some influential people in a prestigious society in a posh area tried to avert police action by locking the main gate and all the channel gates before engaging in full-fledged recreation with firecrackers at the cost of environment. After complaint from local people, the police swung into action and stopped them. If taken into custody, the people and media would have seen the how the rich, mighty and educated break all the laws. The atmosphere against Noise Pollution is so strong that their own society members are so agitated & the demand for strict legal action is still in the air.
It is worth mentioning here that earlier the people in this oldest city Kashi were somewhat 'addicted' (due to non action against Noise) to high level of Noise in the name of religion & tradition. But after herculean efforts for the last 33 months by an NGO Satya Foundation, the people are now realising the problems arising due to high level of Noise. This Puja & Diwali alone, Satya Foundation put hundreds of banners and flex all across Varanasi, urging people not to produce any kind of Noise in the name of religion & tradition. The students were told that Diwali is synonymous with Diyas and not firecrackers. In just 6 days before Diwali, Joint Pledge programmes for not using firecrackers were organised in 12 big schools of Varanasi. And the role of media in highlighting the issue was very positive. Many of the media gave full page stories & many published it with multiple photographs. The TV Channels were very active too.
"The Satya Foundation through all its programmes made it clear that without stern legal action against firecrackers, nothing concrete can be achieved. The delegation of 30 children from 10 schools met the Divisional Commissioner Mr. Ajay Kumar Upadhyaya on 26th October & demanded that those using firecrackers after 10 p.m. must be penalised. Altogether, it was a wave against Pollution in the name of tradition & religion which made a conducive atmosphere for administration to come in motion (if not legal action)", tells Chetan Upadhyaya, Secretary of Satya Foundation. Earlier, on eve of Durga Puja too, Satya Foundation's innovative banners were very much in news because they told that use of loudspeakers, beyond permissible time & decibel limits is against Religion, Medical Science & law of land. Most of the Puja Pandals closed the speakers by 10 p.m.
According to the Amended Noise Pollution Rules-2010, anybody engaging in any kind of noise after 10 p.m. can be fined up to Rs. 1,00,000 (One lakh) or imprisonment up to 5 years or both.
The people in Varanasi are very happy that even on Diwali night, the police force took lots of pains to give due sleep & peace to them as per the Supreme Court guidelines. And due credit must be given to the Divisional Commissioner, Mr. A.K. Upadhyaya, District Magistrate Mr. Ravindra & D.I.G. Mr. D.K. Thakur for taking this historical initiative. An initiative which was never heard or even thought of- deploying the whole force for enforcing the law of land & stopping the firecrackers after 10 p.m. and that too on eve of Diwali. Though not full success was achieved, but with this kind of passion & public movement, one can always hope for better results next time.

IT IS FACT THAT Not all areas were covered by police (the ratio of Police personnel to population is very apalling in India & Varanasi), but even THE SYMBOLIC STRICTNESS which we saw this year was never heard of. So we must not PRESUME that it was very effective exercise, but it was not totally futile exercise too. Though people are complaining that legal cases should have been registered, but they must not forget that the joint operation on night of Diwali has already given message. Though there should be many more things including legal action, BUT The people got the message for the next years. Everybody must appreciate the good actions, positiveness of approach & contribute to a better society. We can't just condemn the system without actually adding something good to it or appreciating the first gentle step in direction of NOISE-FREE SOCIETY...
If something good has happened & if the ice has started melting (may be even by 5, 10 or 25 percent, due recognition and credit must be given to the media which DARED TO ACT AGAINST THE FIRECRACKER LOBBY & wrote solid articles in favour of Noise-free Diwali. And to the officers who DARED TO MOVE FORWARD. And to the students & doctors who had long brain-storming sessions on issue of Cracker-free Diwali. Nothing can change overnight, BUT YES there is definite change (even if a little bit) in children and people. WE need your positive energies to be more practical and focussed for future results. And that needs more exchange of ideas, opinions & thoughts. I am sure you are there!!!

In a first of its kind in Varanasi, a meeting of Puja Pandal organisations was held under the joint banner of Satya Foundation and Kendriya Dev Deepawali Mahasamiti Kashi at Marriage Point, Sigra, Varanasi. The meeting was aimed at creating awareness about the Noise & water pollution generated during the Puja season.
Two resolutions were unanimously passed in the meeting, viz:
2. To prevent pollution of Ganges, the statues of Gods and Goddesses should be made from non-toxic, water-soluble material. And they should be given farewell in ponds/sandpits specially created for this purpose & not in Mother Ganges.
Speaking at the gathering, News Editor of Dainik Jagran, Varanasi Shri Raghvendra Chaddha praised the single-handed initiative taken by Satya Foundation for bringing down the Noise Pollution in Varanasi & extended his good wishes to this new inititative. He said there was need to specify an alternative roadmap for safe disposal of statues from the next year.
Well-known heart specialist Dr. Ajay Kumar Pandey from Heritage Hospital also shed light on the dangers to public health caused by noise and water pollution & said there was an urgent need to take concrete steps to stop the pollution created by high noise & disposal of chemicals in form of statues in river Ganges.
Pandit Vagish Dutt Mishra, president of Kendriya Dev Deepawali Mahasamiti Kashi said that if the Puja Samitis in Kanpur can create an artificial pond for immersion of idols, then why the same can not be done in Varanasi? Secondly, if there is consciousness and unity, all Puja Pandals can together decide for idols free from chemicals & Plaster of Paris. Also, the Puja Pandals must think what is the use of such a high noise for worshipping the Gods and Goddesees.
Shri Chetan Upadhyaya, Secretary of Satya Foundation stressed that We are not against religion or tradition, but celebrations should be done in such a way so that there is no physical/mental torture to the people.

Mayank, a student of B.Tech Part III at the prestigious Institute of Technology (proposed to be IIT in future), Varanasi had gone for party with his 1 dozen friends at a famous Dhaba in Varanasi. It is being said that they also had drinks over there. While returning, everyone returned to the hostel whille Mayank Ahuja, Tarun, Mihir Jha and Saksham Chandra decided to have more fun. At 1.30 in the night, without realising the danger, the three friends jumped into Ganges (one by one) while the 4th friend Saksham Chandra started taking Video of this 'fun' activity. Within minutes, the first three students drowned and resultantly, 4th friend-Saksham Chandra panicked seeing all this. He first ran to Lanka Police station, very close to the spot and then came to his hostel, about 4-5 kms from there and informed the students and Hostel Warden.
After herculean efforts by local divers, 2 bodies were recovered while the third body, that of Mayank Ahuja is still missing.
Mayank's mother, Sudha Ahuja with her sister and two brothers camped till 6th day at Ravidas Ghat near Lanka Police station in Varanasi in the anticipation & hope that they may get the floating dead body of their son. This went till 11.30 a.m. on Monday, 4th October. Of late, it seems they have agreed to their 'fate' and left the Ghat about 2 hours ago.
The question is big: Why did Military not step in, inspite of request sent by District administration (through 39 GTC, Varanasi)? Why sometimes some people make the rules for breaking them? Why are there different parameters for different persons? If it was the dead body of a VIP, would it have taken more than a few hours? How much more time will be needed by Military to step in?
Satya Foundation is doing all-out efforts (since 2nd October) for calling of Military to trace the body of Mayank Ahuja, who alongwith 2 other hostel-mates drowned in Mother Ganges on the night of 28-29 September. And when local divers failed to spot the body of Mayank, on Friday, 1st October, the idea of calling Military was first mooted by local & University administratration. And when even after passing of 72 hours, there is no trace of Military coming in, Satya Foundation has just sent SOS messages (mostly through Phone & Internet) to:
"This is lethal for the self-respect of Indian citizen that a few powerful people control the treasures of the world, while others are suffering. If this was the dead body of a VIP, so many helicopters & ships would have come and trace it by now. But for my son, standards are different, bemoans mother Sudha Ahuja, who has already lost her husband about 2 years ago.
Sudha Ahuja is silent and is not talking, most of the times. She is hoping for some miracle- like may be my son's body was seen by someone on the bank of river and local people have got his son hospitalised.
"Can you relay this information with photograph to all such hospitals in 33 km length of river from Ravidas Ghat, Lanka to Markandeya Mahadev, Kaithi (border of Varanasi-Ghazipur) so that truth can come out?", mother Sudha Ahuja asks this correspondent, who is also Secretary of Satya Foundation.
The locals and the some specialists' suggestion that chances of survival are very bleak, doesn't appeal to her.
..She wants the body-either live or dead.
On Monday, the second and final round of search operation by trained marine divers from Mumbai, ended just before noon. Almost ten hours of hard work by the professional divers of a private firm from Mumbai and their complete no has upset all. Everybody is feeling down and tired.
"... But we can't be mute spectators. And hence, even in these clouds of uncertainity, denial and mistrust, we strongly demanded for implementation of the idea of trained Military personnel with highly sophisticated gadgets to step in, tells Chetan Upadhyaya, Secretary of Satya Foundation. We are constantly communicating the whole situation to all those who matter in Varanasi & Delhi. The Commissioner Mr. Ajay Kr. Upadhyaya and D.M., Mr. Ravindra are working hard in this direction & one can always hope for the best even in the worst times.
"Everybody shares the same demand- there should be fool-proof and uniform system for tracing the bodies in accidents. And there should be constant vigilance system, preferably with CCTV cameras on ghats. And most importantly, employing highly-trained & fit Professional Divers at important ghats is the need of hour", tells Chetan Upadhyaya, Secretary of Satya Foundation.
Unfortunately, in big tourist centre like Varanasi, there is not even one government diver. To take body out of the river, the police and people have to shell out money in 5 figures (and never less than 1,000 even for unclaimed bodies or those belonging to poor people. Mostly all divers want an additional gift: A pouch of home-made (Deshi) Wine. This situation can change if the government acts fast.

An informal meeting with the Band/DJ business persons was organized today in the city. With the help from Mr. Kishori Lal, President of Lucknow Band Association and Mr. Munnan of the Lucknow D.J. Industry, the meeting was highly successful. Those who attended it were given the pamphlets and posters related to the noise pollution. They were also told about the Amended Noise Pollution (Regulation and Control) Rules, 2010. The audience appreciated the efforts of Satya Foundation and gave many interesting suggestions and ideas for implementation of laws in capital city of Uttar Pradesh.

With the initiative of Satya Foundation, a meeting on Noise pollution was organized on Wednesday at the residence of the Commissioner, Mr. Ajay Kumar Upadhyaya. The meeting focused on practical steps to curb noise pollution and lasted for more than 30 minutes.
The Commissioner congratulated Satya Foundation for the fact that Varanasi is leading in the field of control and regulation of noise pollution and even big cities like Lucknow, Kanpur etc. are lagging behind. The members of Satya Foundation said that this is just the beginning and credit for whatever has been achieved goes to the religious leaders, police-administration, and proactive media and of course the alert people of the city. At the same time, need for constant legal action was reiterated for the long-lasting success of the campaign.
Various issues were raised in the meeting, the synopsis of which is produced below:
Generators:
The members of Satya Foundation were very vocal against the indiscriminate use of canopy-less generators which are cause of deafness, headache, migraine, depression and many other diseases. Under the present laws, no generator of 5 KVA or more can be run without official permission and that too only when one installs standard sound-proof canopy and chimney. In Banaras, so many sufferers run from pillar to post for legal and remedial action, but to no avail. So many people die every year of this serious problem. So there is need for centralized window and telephone helpline for registering such complaints. The identity of the complainant should be strictly confidential and matter should be redressed in a time-bound period of 3 working days.
The Commissioner immediately decided to hold high-level meeting of concerned officers on this issue of Generators on coming Monday (14.06.2010). The meeting is likely to be attended by all the DM, ADM, magistrates and the officials of the Uttar Pradesh Pollution Control Board. If this meeting is able to fulfill the above-mentioned demand, people of Varanasi and also the tourists may feel lot of peace in Varanasi and it will ultimately increase the tourist flow and at the same time, it will also save the people from a host of diseases.
Non-action against Hooter and Pressure Horn:
The Satya Foundation Secretary, Chetan Upadhyaya expressed deep shock that inspite of the Government orders from Lucknow, the hooters and pressure horns are still very much in use by the government officials. If you can't remove them from the government vehicles, how can you book other people?', asked Chetan Upadhyaya. The Commissioner accepted the point & promised to take up this issue very soon.
Holding of programmes at Ghats and other places even after 10 p.m. in the name of Tradition & Religion:
Inspite of appeals by religious leaders and the intellectuals plus so many awareness programmes in different institutes/corporate, some programmes are being still run till late in the night.
So, the members of Satya Foundation registered their strong protest against the 'silent' permission to so many programmes after 10 p.m. involving use of loudspeakers, DJ, Music System and Firecrackers. The Commissioner, Mr. Ajay Kumar Upadhyaya took no time in instructing ADM (city) Mr. A.K. Rai for granting 'conditional permission' to organisers. From now onwards, the magistrates will have to write on the permission letter itself that the programme is being granted the permission only up to 10 p.m. and the defaulters will be suitably punished under various provisions of IPC and also the Amended Noise Pollution (Regulation & Control) Rules, 2010.
The overall mood of the meeting was quite good and the Commissioner agreed to the demand of making Varanasi a role model in this field and promised to take the issue on high-priority basis. Those present in the Wednesday meeting were Chetan Upadhyaya, Advocate Rohit Maurya, Mrs. Krishna Somany, Shashikant etc.

A Vacation Bench of Justices G. S. Singhvi and C. K. Prasad while dismissing the PIL on Tuesday cautioned that any such stay would affect the career of over four lakh students and might lead to serious consequences including suicides by the aspirants. Though our counsel was quick enough to reply that actually the reverse might be true too as non-selection or low ranks of highly meritorious candidates may lead them to commit suicide.
The bench also asked the petitioner if he was willing to deposit 4 crores of rupees to the government exchequer, as any order for re-examination would entail huge costs.
The counsel for the petitioner Mr. Ajay Kumar contended that petitioner is a genuine person working for upliftment of students in various states and has no previous record of filing any PIL. The questions raised by the petitioner are very important having wide ramicifications and should be gone into. Questions involved in petition pertaining to errors in the instructions and in the question paper of prestigious IIT JEE of the year 2010 were incurable in nature and they vitiated the entire process of examination. In an examination where even difference of one mark can change the results and future of so many brilliant students, Corrective measures suggested by Joint Admission Board was not the answer and the re-examination was the only solution, but the petition was rejected by the honorable judges with a warning that any such PIL in future would invite huge costs for the petitioner.

Delhi High Court rejects the petition for Interim Stay on Results of IIT JEE-2010
New Delhi, May 19 (IANS) The Delhi High Court Wednesday declined to stay the declaration of this year’s results for the Indian Institute Of Technology (IIT) exams but asked the institutes to explain as to why so many mistakes crept in during the all-India test.
A division bench of acting Chief Justice Madan B. Lokur and Justice Mukta Gupta declined to stay the declaration of IIT-JEE (joint entrance examination) result but directed the IIT to explain by way of affidavit how the mistakes occurred.
“Demonstrate to us the software with which you set these papers and also how the papers are scrutinised,” the court said when the counsel for IIT claimed that their system is foolproof and is up to standard.
The court directed the IIT to file an affidavit by June 2.
The court was hearing a public interest litigation (PIL) of a non-government organisation (NGO) that has sought a stay on the declaration of result of the Indian Institutes of Technology (IIT) entrance exam held April 11.
Raising the issue of errors in the instructions for examinees who took the IIT-JEE in Hindi, the NGO, Satya Foundation, filed the PIL.
Chetan Upadhyaya, secretary and counsel of Satya Foundation, Wednesday submitted before the court a list of serious blunders in the IIT-JEE 2010 and said that instead of accepting the faults and re-conducting the examination, the Joint Admission Board was trying to cover up the issue with “corrective measures” which are “totally illogical and can’t be digested by anybody”.
“The IIT-JEE board evolved corrective measures May 2 to ensure that genuine candidates were not affected by the examination errors. It formulated a point-by-point remedial action and posted the same on the IIT-JEE website,” Upadhyaya argued.
However, after dismissal of Upadhyaya’s petition, he said he will approach the Supreme Court.
The result of the IIT-JEE is expected to be declared May 26.

पूरे विश्व में अपनी अलग छवि के लिए प्रसिद्ध इंडियन इंस्टिट्यूट आफ टेक्नालोजी यानी आई.आई.टी. की २०१० की प्रवेश परीक्षा के प्रश्न पत्र में भारी भूलों और उससे होने वाले नुकसान की जहां देश भर में चर्चा हो रही है, वहीं गुरुवार को दिल्ली उच्च न्यायालय ने परीक्षा परिणाम पर रोक लगाने और नए सिरे से परीक्षा आयोजित करने के लिए एक जनहित याचिका को विचार के लिए स्वीकार कर लिया है.
मुख्य न्यायाधीश श्री मदन बी. लोकुर और न्यायमूर्ति सुश्री मुक्ता गुप्ता की बेच ने याचिकाकर्ता चेतन उपाध्याय के पक्ष को सुनने के बाद यह आदेश दिया. याचिका में कहा गया है कि ११ अप्रैल २०१० को हुई प्रवेश परीक्षा में हिन्दी माध्यम के विद्यार्थियों को मुद्रण की त्रुटियों और गलत अंक वितरण के चलते नुकसान उठाना पड़ा. अंग्रेजी में जिस भाग को ४८ अंकों का बताया गया था उसे हिन्दी में १८ अंकों का बताया गया. इसी तरह हिंदी माध्यम में ३ अंक का सवाल ही गायब था. इसके अलावा उत्तर पुस्तिका और प्रश्न पुस्तिका के क्रम में भी अंतर था जिसकी वजह से विद्यार्थियों का अमूल्य समय बर्बाद हुआ और प्रतिभाशाली विद्यार्थियों के चयन की उम्मीदों पर सवालिया निशान लग गया है. इस मामले में स्वयं बहस करते हुए सत्या फाउंडेशन के सचिव चेतन उपाध्याय ने कोर्ट को यह भी बताया गया कि गलतियों को स्वीकारने के बावजूद आई.आई.टी. पुनर्परीक्षा नहीं करा रहा है और अपने बचाव में निरर्थक उपायों को अपनी वेब साईट पर जारी करके पूरे मामले को रफा-दफा करने में जुटा हुआ है. याचिकाकर्ता ने कोर्ट से परीक्षा परिणाम पर रोक लगाने और दुबारा प्रवेश परीक्षा कराने की मांग की. कोर्ट ने याचिका को यह कहते हुए स्वीकार किया कि आई.आई.टी. के ही मामले में पिछले ७ अप्रैल, २०१० को आई.आई.टी. खड़गपुर के डा.राजीव कुमार की जनहित याचिका संख्या २२७५/२०१० के साथ जोड़कर नई जनहित याचिका २७८४/२०१० की एक साथ सुनवाई अगली १९ मई २०१० को होगी. ज्ञातव्य है कि डा. राजीव कुमार वाले मामले की वकालत प्रसिद्ध अधिवक्ता प्रशांत भूषण कर रहे हैं.
बहसकर्ता चेतन उपाध्याय ने दोनों याचिकाओं को एक साथ जोड़ने का यह कहकर विरोध किया कि डा. राजीव कुमार की पुरानी याचिका में आई.आई,.टी. की संपूर्ण परीक्षा पद्धति और पारदर्शिता की बात है जबकि उनकी याचिका ११ अप्रैल, २०१० को हुई परीक्षा के परिणाम पर अंतरिम रोक और दुबारा परीक्षा कराने को लेकर है और दोनों को जोड़ना ठीक नहीं है. मगर विद्वान न्याधीश ने कहा कि चूँकि परीक्षा पारिणाम २६ मई को आने है, इसलिए १९ मई को दोनों याचिकाओं की सुनवाई एक साथ होने से विद्यार्थियों का कोई नुकसान नहीं होगा, लिहाजा १९ मई २०१० को ही कोर्ट इस पर सुनवाई करेगी. इस दिन मानव संसाधन विकास मंत्रालय, आई.आई.टी. कौंसिल और संयुक्त परीक्षा बोर्ड भी अपना पक्ष कोर्ट के सामने रखेंगे.
कोर्ट से निकलने के बाद याचिकाकर्ता ने कहा कि उनका न्यायपालिका पर पूरा विश्वास है और उम्मीद जताई कि १९ मई को हिंदी माध्यम के विद्यार्थियों के भविष्य का ख्याल रखते हुए कोर्ट दुबारा प्रवेश परीक्षा कराने का आदेश देगी

सत्या फाउंडेशन' ने जन सूचना अधिकार के तहत पुलिस से यह पुछा था कि रात दस बजे के बाद ध्वनि प्रदूषण करने वालों के खिलाफ कितने मुकदमे दर्ज किये गए. १२ नवम्बर, २००९ को पुलिस ने अपने जवाब में स्वीकार किया था- एक भी मुक़दमा नहीं. इसके बाद अनेक रैलियों और कार्यक्रमों में आम जनता के साथ ही धर्म-कर्म और चिकित्सा विज्ञानियों के इस मुहिम में कूदने और मुखर होने की वजह से अंततः
पिछले दिनों धारा २६८, २९० व २९१ के तहत पुलिस ने कई मुकदमे दर्ज किये, जिसकी तारीफ पूरे हिंदुस्तान ही नहीं, बल्कि विश्व के मीडिया में छपी थी. और अब महमूरगंज क्षेत्र में दो मैरेज लानों के खिलाफ पर्यावरण संरक्षण अधिनियम
(आई.पी.सी. २६८, २९० व २९१ के अलावा)
लगाने से पर्यावरण प्रेमियों और आमजनों, विशेषरूप से मरीजों और डाक्टरों में हर्ष की लहर व्याप्त है.

सत्या फाउंडेशन के सचिव चेतन उपाध्याय ने कहा कि यह सब कुछ जनता, मीडिया और शासन की संयुक्त जीत है और जरूरत है कि लोग खुद जागरूक हों और धर्म व परंपरा के नाम पर हो रहे जानलेवा ध्वनि- प्रदूषण का अपने इलाकों में जोरदार विरोध करें. हम आनंद के विरोधी नहीं हैं, मगर यह इस तरह से मनाना चाहिए कि आसपास के लोगों के काम या विश्राम में कोई खलल न पड़े. जिन लोगों के घरों के आसपास मांगलिक स्थल है, उनकी जिन्दगी तो आये दिन होने वाले कानफाडू स्पीकर और डी.जे.-आतिशबाजी की आवाज से जीते-जी ही खत्म हो जाती है.
कानून के मुताबिक रात दस बजे के बाद किसी भी शादी-विवाह, धार्मिक या सामाजिक कार्यक्रम में बैंड-बाजे, लाउड स्पीकर, डी.जे., बिना कैनोपी का जेनेरेटर, आतिशबाजी आदि का प्रयोग या रिहायशी इलाकों में मशीन अथवा निर्माण की आवाज या सड़क पर बेवजह हार्न बजाना- यह सब कुछ अपराध की श्रेणी में आता है. और रात दस से पहले भी ध्वनि का स्तर इतना ही होना चाहिए कि आसपास के लोगों को सामान्य बातचीत में किसी प्रकार की तकलीफ न हो. पुलिस को यह अधिकार है कि वह जनता की शिकायत पर नियम तोड़ने वालों के माइक्रोफोन, लाउडस्पीकर या इसी प्रकार की ध्वनि-उत्पादक मशीनों को जब्त कर सकती है.

Noise Pollution is proving to be a big menace for the community. Be it the noise from horns and the outdated noisy vehicles or canopy-less generators and the Loudspeakers/DJ (in High decibel level) & firecrackers used in the name of religious/marriage ceremonies, Noise pollution is causing many kinds of diseases like sleeplessness, anxiety, depression, deafness, blood pressure, heart attack, peptic ulcer and even cancer.
A weaker immunity system of an individual means lesser GDP of the nation and more and more expenditure on medicines and hospitals. So, with this philosophy and clear vision in mind, SATYA FOUNDATION has launched its drive against the Noise pollution, especially after 10 p.m.
As per the Supreme Court guidelines, nobody can use any kind of loudspeaker, band, firecrackers, D.J. etc. (except in the closed sound proof room/auditorium) between 10 p.m. and 6 a.m. Even before 10 p.m., the decibel level should be such that any two people talking to each other in nearby area should have no problem in listening to each other. Police/local administration (of course it needs guts and strong will power of the state in giving the citizens their due right of 8 hours of sound sleep) can seize any such Microphone/Loudspeaker/ Amplifier/D.J. or any other noise producing equipment after 10 p.m. The offenders can be booked under I.P.C. 268, 290 and 291 (imprisonment up to 6 months or penalty or both) and also under Environment Protection Act (Penalty up to Rupees One Lakh or imprisonment up to 5 years or both). With the consistent efforts by SATYA FOUNDATION at various levels, the U.P. police is becoming very sensitive on the issue and has begun the legal action in Varanasi. Anybody facing the late night noise pollution can get his/her area totally silenced by just dialing toll free 100 or the nearest police station. Police team reaches the spot within minutes and stops all the nuisance in the name of 'religion' and 'tradition'. This situation has come after constant awareness campaign and efforts at multiple levels by SATYA FOUNDATION. Not only pamphlets, posters and the coverage by print and electronic media, our interactions with masses in schools, and the Nukkad meetings in villages and Mohallas have helped the mission in its growth.
We truly believe that man is simply medium of doing cosmic work, assigned by the invisible and the infinite. And since 10th February, 2008, we are just doing our assigned work, without caring/worrying for the results.

रविवार की शाम को सिगरा थाना क्षेत्र में अरिहंत काम्प्लेक्स के पास एक मांगलिक स्थल पर एक धार्मिक कार्यक्रम चल रहा था. आयोजकों ने बहुत बड़े-बड़े कानफाडू स्पीकर्स लगा रखे थे और आवाज इतनी ज्यादा थी कि मानो पूजा अपने लिए नहीं बल्कि पूरे बनारस के लिए कर रहे हों. स्थानीय नागरिक और पढ़ाई करने वाले बच्चे 'धर्म' के नाम पर हो रहे इस अधर्म के खिलाफ कुछ बोल नहीं पा रहे थे. तभी एक स्थानीय अस्पताल के चिकित्सक ने संस्था द्वारा डी गयी जानकारी के आधार पर शाम ५.५५ पर पुलिस कण्ट्रोल रूम के टोल फ्री 100 नंबर और एस.पी. सिटी के मोबाइल नंबर ९४५४४०११२४ पर कड़ी शिकायत दर्ज कराई. लोगों के आश्चर्य और खुशी का उस समय ठिकाना नहीं रहा जब सिर्फ १४ मिनट में पुलिस फ़ोर्स ने मौके पर पहुंचकर ठीक ६.०९ बजे स्पीकर की ध्वनि को बिलकुल कम करा दिया. सुप्रीम कोर्ट के नियमों के मुताबिक रात 10 बजे के बाद किसी भी हालत में ध्वनि प्रदूषण नहीं हो सकता मगर रात १० बजे से पहले भी ध्वनि का स्तर इतना ही होना चाहिए कि आसपास के लोगों को बातचीत करने या पढ़ाई-लिखाई या फिर अस्पताल के मरीजों के आराम में कोई खलल न पड़े.
इस घटना के सन्दर्भ में श्री काशी विश्वनाथ मंदिर के अर्चक श्री श्रीकांत मिश्र ने कहा कि वेद मन्त्रों में इतनी शक्ति है कि ध्वनि विस्तारक यंत्रों की की कोई जरुरत ही नहीं है. दुर्भाग्य से आजकल अनुष्ठान एक दिखावा हो गया है जबकि शास्त्रों में तो इसे गुप्त रूप से करने का विधान है. उन्होंने स्पष्ट किया कि धर्म के नाम पर ध्वनि विस्तारकों के प्रयोग से अनुष्ठान की शक्ति क्षीण होती है और इसे रोकना जनता के हित में है. श्री श्रीकांत मिश्र ने कहा कि बनारस से शुरू 'शोर' के खिलाफ इस जंग को पूरी दुनिया बहुत आशा से देख रही है और इस अभियान के लिए 'सत्या फाउंडेशन', मीडिया व पुलिस-प्रशासन, समान रूप से बधाई के पात्र हैं.

People come in open protest against the use of Loudspeakers/DJ in the name of religion and also the marriage ceremonies etc. With our consistent efforts, the people of Varanasi can now hope for a sound sleep. The people have been cautioned about the bad effects of Noise and how to stop it. Marriage Lawns now stop all the music by 10 p.m. and in case of any offence, police acts within minutes. A person has to just dial toll-free 100. And in case there is no action, just call/ s.m.s. on 09212735622 and the sound has to stop. But a lot still needs to be done. We thank our esteemed volunteers, police/administration, sponsors, well-wishers, media and the common man for running the awareness campaign so smoothly and effectively. We need generous donations from people/organizations to further strengthen and consolidate our efforts. All donations are exempted from Income Tax under Section 80G.

throw open challenge upon the Union Railway Minister (with copy to the Chairman, Railway Board and EDME- Freight) for an open public debate so that there is no more confusion and terror amongst the farmers in any part of India.
On Monday, 4th January, 2010, Mamata Banerjee said in Kolkata that she had amended the railways’ land acquisition policy “chupi chupi” to be able to provide a job to every family that gives its land for a railway project.
“I have got amendments made to the railway land acquisition act (policy) secretively (chupi chupi). From now on, each landloser family will get one job in the railways over and above the compensation,” the railway minister said after laying the foundation stone for the Bagnan-Amta line in Howrah.
A senior official confirmed that the railway minister had the power to amend the policy on compensation and other benefits for those who lose land to railway projects.
Sources said changing the policy was a political compulsion for Mamata after the railways faced “Singur-like protests” in Chandauli district of Uttar Pradesh. Even before the railways had served a land acquisition notice to farmers there for the western freight corridor, the Satya Foundation and Krishi Bhumi Bachao Sanghrash Samiti started a movement for saving the highly fertile land. As a result, all the major political parties at the local as well as national level, including Congress, BJP, SP, CPI(M) etc. raised their voice in favour of farmers. And the matter was also raised in Loksabha as well as the Rajysabha in month of December, 2009.
Providing jobs will be easier said than done, said a senior railway official. Mamata had earlier said that over 21,500 acres would be required for the western and eastern freight corridors. “It means several thousand jobs have to be created to meet the minister’s commitment.”

If we have a middle route (which causes least acquisition of land and freight corridor is also made) the government must consider it on logical grounds. Agriculture is the heart-beat of India. If there is no agriculture, no freight train/corridor will be actually needed.
