Official Rules for the New York Sash $10,000 Summer Home Makeover

The Contest:  The Giveaway is the New York Sash $10,000 Summer Home Makeover. Contestants must enter to qualify from July 4, 2009 12:00 am to August 13, 2009 11:59 pm. On August 14, 2009, 100 finalists will be chosen from the qualified contestant applicant pool at random. Contestants must meet qualifications outlined in the rules and regulations to continue in the Giveaway as a finalist. The Grand Prize Giveaway will be August 15, 2009 at New York Sash, 349 Oriskany Blvd. in Whitesboro, NY. Ten drawings will be held to eliminate finalists until only one finalist is remaining; said finalist will win be the Grand Prize Winner. Must be present to win.

 Entry: No purchase necessary and you do not have to receive a sales presentation to win. Enter online through Regent Broadcasting of Utica/Rome radio station websites (WFRG-FM, WLZW-FM, WIBX-AM, WODZ-FM); www.newyorksash.com; filling out an entry form at New York Sash, 349 Oriskany Boulevard, Whitesboro, NY 13492 or in other designated locations. Only one entry per household will be accepted.

 Qualifications: To become a finalist all contestants must meet the following restrictions. Contestant must be a legal resident age 18 years and older and a homeowner in Oneida, Herkimer, Madison, Lewis, Onondaga, Otsego, Fulton or Montgomery counties of New York State. This contest is void where prohibited by law. Contest is not open to employees, officers or directors of New York Sash or Regent Broadcasting of Utica/Rome or their immediate families (including spouse, parents, grandparents, children, brothers, sisters, aunts, uncles and cousins). No employee of any competing electronic media in the Utica/Rome metro is eligible to win any prizes from Regent Broadcasting.

 Prize: One Grand Prize will be awarded. The Grand Prize is $10,000 Retail Value of New York Sash products, limited to any combination of the following: vinyl replacement windows, doors, insulating vinyl siding, gutters, gutter protection and acrylic bath system.

 Conditions: Grand Prize winner must take possession of the Grand Prize. Grand Prize is non-transferrable. All components of Grand Prize, including all products and installation must be used and applied to household listed on entry form. Winner must supply proof of home ownership upon registration in the form of Legal Identification and copy of one of the following items: paid tax bill, mortgage payment coupon or deed. Winner will be required to sign an Affidavit of Eligibility within three (3) days of acceptance of prize.  If the winner has purchased New York Sash products (vinyl replacement windows, doors, insulating vinyl siding, gutters, gutter protection and/or acrylic bath system) between July 4, 2009 to August 13, 2009, the $10,000 prize may be refunded. Should the purchase order exceed the retail value of $10,000 the winner will be responsible for the list value over the allotted prize amount of $10,000.

Grand Prize winner will be required to sign a liability release within three (3) days of acceptance of prize and agree to hold New York Sash, Regent Broadcasting of Utica/Rome, media partners, affiliated companies and the officers, shareholders, directors, employees, agents and representatives of each of them harmless against any and all claims or liability arising directly or indirectly from the prize or participation in the Giveaway.

Grand Prize winner hereby agrees to the use of their name(s), voice, or likeness and video or photos of their home and personal photos in any advertising or broadcasting material for promotional purposes without any additional financial or other compensation. Winner must sign a Media Model Release Form and Property Release Form within three (3) days of acceptance of prize.

All liability for reporting and paying any and all federal, state and other taxes on Grand Prize are the sole responsibility of Grand Prize winner. Any valuation of the components of the Grand Prize stated above is based on available information and the value of the Grand Prize may be reported for tax purposes as required by law. Each winner must provide valid identification and a valid taxpayer identification number or social security number before any prize will be awarded. Grand prize winner will receive an IRS form 1099 at the end of the calendar year and a copy of such form will be filed with the IRS.

Grand Prize winner is responsible for acquiring any and all permits required for the distribution of components of the Grand Prize. Winner is responsible for payments of all permit fees and for any expense not specified herein and relating to the acceptance and use of their prize.

Distribution of components of the Grand Prize is contingent upon the winner’s compliance of all prevailing local laws and will take place at the discretion of New York Sash.

New York Sash, Regent Broadcasting of Utica/Rome, media partners, affiliated companies and the officers, shareholders, directors, employees, agents and representatives of each are not responsible for any printing or typographical errors in any Giveaway related materials or for stolen, lost, late, misdirected, damaged, incomplete, or illegible. While every care will be taken, above entities cannot be held responsible for the non-delivery, delay or loss of an entry. Proof of posting is not accepted as proof of delivery. Multiple entries will be discarded. Odds are based on the number of entrants. All finalists must meet all restrictions outlined in the qualifications section of these official rules and regulations. The decision of New York Sash as to the acceptance of an entry will be final. All entries become the property of New York Sash and cannot be returned.

By entering this Giveaway, contestant(s) hereby grant New York Sash permission to contact them via mail, e-mail and telephone for the purpose of verifying the entry, additional product information, sales promotions now or in the future and for soliciting the sale of home improvement products.

New York Sash, in its sole discretion, reserves the right to disqualify any person tampering with the entry process or who is in violation of the rules and regulations of the Giveaway or for any reason deemed justifiable by its management, agent or sponsors with no restitution. In the unlikely event that the Grand Prize winner is disqualified from the Giveaway, the second runner up may receive the Grand Prize. New York Sash reserves the right at its sole discretion to suspend, modify or terminate the Giveaway without notice at any time if it is not capable of completion as planned, including infection by computer virus, bugs, tampering, unauthorized intervention or technical failures of any sort. Official decisions by New York Sash are final and not subject to litigation. New York Sash reserves the right to make changes in the rules of the Giveaway, including the substitution of Grand Prize of equivalent value, which will become effective upon announcement.

Failure to comply with the Giveaway rules and regulations may result in a contestant’s disqualification. This Giveaway is void where prohibited by law.
