--------------------------------------------------------------------- CITY MAMLATDAR'S ORDER VIOLATES SECTION 52 OF T.P. ACT The principles specified in Section 52 of the T.P. Act are in accordance with equity, good conscience or justice because they rest upon an equitable and just foundation that it will be impossible to bring an action or suit to a successful termination if alienations are permitted to prevail
“The Section only postulates a condition that the alienation will in no manner affect the rights of the other party under any decree which may be passed in the suit unless the property was alienated with the permission of the Court.” Section 52 of the T.P. Act reads as follows:"During the pendency in any court having authority within the limits of India of any suit or proceedings which is not collusive and in which any right to immovable property is directly and specifically in question, the property cannot be transferred or otherwise dealt with by any party to the suit or proceeding so as to affect the rights of any other party thereto under any decree or order which may be made therein, except under the authority of the Court and on such terms as it may impose."
Harekrishna Developers has failed to produce certificate from the Court that they have purchased the property with the permission of the Court where the Civil Suit 5827 of 2001 is pending. ----------------------------------------------------------------------
