Short Term Rental Agreement  

This agreement is hereby made between _______________, hereafter known as OWNERs, and _______________________, hereafter known as RENTER. RENTER shall rent the premises at __________________ FL , USA from 4:00 pm on ________(check-in date) to 11:00 am  on ________ (check-out date) for a total of ________ nights.

  1. Rental Payments: The total rent for this Lease shall be US$           .  This payment is due in full with the signed agreement 60 days before check-in date. If signing date of this agreement is within 60 days of the check-in date above, the rental is due immediately. Cashier check, money order and traveler's check are preferred, personal check is accepted under certain conditions. Owners reserve the right to cancel the booking if payment has not been received in accordance with above statement. A notify email will send out to remind the renter.
  2. Security Deposit: $300 US DOLLARS refundable security deposit is required to make reservation. The payment is due with signed agreement. The premises shall be reserved under renter's name as soon as the deposit reaches owner. Please note any oral reservation shall not lock up the property. One week after checkout date, the deposit shall be sent back to renter. In case the property has any damage that leads to repair, the deposit may not be fully returned. Renter is responsible for all loss or damage to the property or its inventory during the rental period. The owner can deduct sums from the security deposit to cover eventualities.  If loss or damage to the property, the inventory, or the equipment exceeds the amount of the security deposit, the owner will bill the guest for the shortfall, and the guest agrees to pay.  In the event that Renter fails to pay any such shortfall, the owner reserves the right to exercise any legal remedies to pursue the amount owed from the renter.
  3. Lawful Purposes: Renter agrees to use the premises exclusively for a private residence and in compliance with local municipal ordinances, board of fire underwriter's rules and regulations, and for lawful purposes. In the event the premises are used at any time for unlawful purposes, at owner's option, the owner may declare this Lease null and void.
  4. Liability for Property Damage: Owner shall not be liable for any loss or damage to personal property belonging to renter, members of renter's family, servants, employees or visitors regardless how such damage or loss that may arise and whether such property is contained in the leased premises, or any portion of the premises. Renter agrees to hold owner harmless of any property claims. Owner is not liable for any damage to renter regardless of the cause of damage.
  5. Liability for Personal Injury: Owner shall not be liable for any personal injuries sustained by the renter, members of renter's family, servants, employees or visitors regardless how such injuries may occur. Renter agrees to hold owner harmless from any such personal injury claims. Owner is not liable for any damage to renter regardless of the cause of injury. They may appear without warning, especially if any opened food is left around, so you need to bear this in mind for full enjoyment of your holiday. All properties are treated regularly for pest control but insects or bugs etc may still appear. As home owner as well as local management company, we are not liable for any personal injuries from insects or bugs sustained by the renter, members of renter's family, servants, or visitors regardless how such injuries may occur, or any adverse reactions sustained by renter or guests due to any allergens or conditions present in the home. The owner and booking agent make no representations as to the existence or non-existence of any such conditions.
  6. Cancellation: Renter may cancel their booking at any time. Cancellation must be in writing in the form of a letter or email. The following cancellation charges will apply to all rentals canceled:
    o    Over 90 days prior to check in: deposit refunded minus $50 processing fee.
    o    Between 60 to 90 days prior to check in: as the credit towards the house to be used within a year
    o    Between 30 days - 60 days: lost of 50% Rental and full deposit.
    o    Within 30 days: lost of 100% of rental and full deposit.
  7. Late Check-out: In case the renter(s) need to stay longer than 11 am on check-out date, notice should be given to the owner at least 48 hours in advance.  $30 will be charged for 1 hour late check-out, $50 for each additional hour late check-out.
  8. Check-in Inspection: Once renter checks in the house, renter should inspect the entire house. If there are any damages or functional problems in the house, renter should immediately report to owners or booking agents by email. Meanwhile, renter should call the local management company to make things corrected ASAP. The purpose of doing checkin inspection is to protect renter and avoid deduction from renter's deposit.
  9. Damage to Rental Property by Renter: In case the rental property is not returned in its normal condition, wear and tear from reasonable use excepted, based on the inspection report, owner shall supply renter with an itemized list of charges, renter agrees to pay the cost of repair in full, not limited to the deposit amount.
  10. Accommodation: The accommodation provided is only for the use of persons named by the client on the booking form. Subletting, sharing or assigning is prohibited. Any changes to the persons booked to occupy the house must be notified for insurance reasons.
  11. Smoking: No smoking is allowed in the villa. Smokers may do so in the pool/patio area. The will be additional cleaning charge if the client and or guests choose to ignore this condition of booking.
  12. Safety and Security: Due to State Fire Regulations under no circumstances may more than the maximum number of persons identified on the Booking Form occupy in the property. Children must be supervised at ALL TIME whilst in the pool area. Glass is NOT permitted in the pool area. The owners or our management company reserve the right to enter the premises at any time for whatever reason.
  13. Use of BBQ: A high power electric BBQ is provided for a fee. It is locked and located in garage. You have to move it to the Lanai area to use it. Please don't expose it to sky (rain will damage the electric BBQ). After use, please clean it, empty the grease can, put the temperature control back under the cover, lock the BBQ with chain and lock,  and move it back to the garage (please be careful not to stain the carpet during moving).
  14. Limitation on Damages: In the event that the Owner is unable to deliver said property to Renter under this agreement prior to occupancy because of fire, eminent domain, act of nature, double booking, delay in construction or any other reason whatsoever, renter hereby agrees that booking agent’s and Owner’s sole liability as a result of these conditions is a full refund of all consideration previously tendered by renter.  Pursuant to the terms of this agreement, renter expressly acknowledges that in no event shall booking agent or Owner be held liable for any consequential or secondary damages, including but not limits to, any expenses incurred as a result of moving for any damage, destruction or loss or expense associated with securing alternative accommodations.
  15. Website information: All descriptions given on the website are made in good faith, but no liability can be accepted for error or omissions.
  16. Animals and Pets: We regret that animals and pets are not permitted in the home. This condition is strictly enforced.
  17. Force Majeure: We accept no responsibility for, and shall not be liable in respect of loss or changes caused by Force Majeure, e.g. strikes, Fire, Flood, Closure of Airports, Weather Conditions, War, Riots, Terrorist Activity, or any other event beyond our control.  
  18. Indemification: Renter releases Owner and/or Booking Agent from liability for and agrees to indemnify Owner and Booking Agent against losses, incurred by Owner and/or Booking Agent as a result of (a) Renter's failure to fulfill any condition of this Agreement; (b) any theft, damage or injury happening in or about Rental or premises to Renter's invitees or such person's property; and (c) any judgment, lien, or other encumbrance filed against Renter as a result of Renter's action.
  19. Disputes: This Agreement shall be governed by and interpreted in accordance with the laws of the State of Pennsylvania. Any action relating to this Agreement shall be instituted and prosecuted in the courts of Chester County, Pennsylvania. Renter shall pay reasonable attorney's fees and all costs in the event that Renter fails to comply with its obligations under this Agreement and the matter is referred to an attorney by Owner and/or Booking Agent. If any action at law or in equity shall be brought under this Agreement, or for or on account any of any breach of, or to enforce or interpret any of the covenants, terms, or conditions of this Agreement, or for the recovery of possession of the Rental Unit, the prevailing party shall be entitled to recover from the other party, reasonable attorneys fees and costs, the amount of which shall be fixed by the court and shall be made a part of any judgment or decree rendered.
  20. Duty to Read: It is your responsibility to check that the information contained in this agreement is accurate and corresponds to the unit you reserved with the booking agent. If you find any discrepancies, it is your responsibility to immediately contact the booking agent
