Ohio laws do not address what must be done with patient records after a physician closes his/her practice.

Usually the medical records are destroyed to prevent highly personal information from falling in the wrong hands.

OHIO STATE LAW ON CHARGES FOR MEDICAL RECORD

Ohio law sets limits on the amounts that all health-care providers and medical record companies may charge for copies of medical records. See O.R.C. §3701.741. The total costs for copies and all services related to those copies cannot exceed the sum of the following: 

If the request is made by the patient or the patient's personal representative
(as defined by Ohio Revised Code 3701.74)

The total costs for copies and all services related to those copies shall not exceed the sum of the following: 
With respect to data recorded on paper, the following amounts: 
• Two dollars and eighty-three cents ($2.83) per page for the first ten pages; 
• Fifty-nine cents (59¢) per page for pages eleven through fifty; 
• Twenty-four cents (24¢) per page for pages fifty-one and higher; 
• The actual cost of any related postage incurred by the health care provider or medical records company.

If a person other than the patient or the patient’s personal representative makes the request

(such as a request by an “authorized person”), total costs for copies and all services related to those copies shall not exceed the sum of the following:
• An initial fee of seventeen dollars and forty-two cents ($17.42),
which shall compensate for the records search;
With respect to data recorded on paper, the following amounts:
• One dollar and fifteen cents ($1.15) per page for the first ten pages;
• Fifty-nine cents (59¢) per page for pages eleven through fifty;
• Twenty-four cents (24¢) per page for pages fifty-one and higher;
• The actual cost of any related postage incurred by the health care provider or medical records company.

These maximum charges are in effect as of January 31, 2010 and remain in effect through December 31, 2010. The maximum charges will be annually adjusted (increased or decreased) by the Ohio Director of Health to reflect the average percentage of increase or decrease in the Consumer Price Index. The adjusted amounts will be posted on The Ohio Department of Health’s Website. (www.odh.ohio.gov)

Exceptions and Exemptions from Maximum Fees

Providers and medical records companies may enter into a contract with a patient, a patient's representative or an insurer, other than a health insurer, for the copying of medical records at fees that differ from the maximum fees.

The maximum fees also do not apply to copies of medical records provided to health insurance companies, health insuring corporations or to medical records covered by O.R.C. §173.20 (consent and access to records of long-term care residents by the long-term care ombudsman) or 42 CFR 483.10 (long-term care facility resident rights). Physicians may bill health insurers and health insuring corporations for the costs of providing copies of records, provide records free of charge to health insurers and health insuring corporations, or enter into agreements with health insurers and health insuring corporations regarding provision of records.

The following entities are entitled to one free copy of a medical record

The Bureau of Workers' Compensation; the Industrial Commission; the Department of Job and Family Services; and the patient or patient's representative if the medical record is necessary to support a claim for Social Security Disability or Supplemental Security Income (SSI). The request must be accompanied by documentation that a claim has been filed.
